Could a Child Choose Which Parent to Live With?

I hope you can help. My sister left the father of her children a couple of years ago and married another man. Her oldest child, my niece, is having an awful time as her step father will not accept her and seems to want to do nothing but make her life a misery and it is ruining her self confidence.

She would rather live with her father and although my sister, her mum, got residency, I don't think she would object to her living with him. I wondered whether she had any say now she is 15? If not, what happens when she is 16? Can she choose to live with her father even if her mum says no? I hope you answer this so I can try and help a very unhappy child.

This is a very sad situation, although there is light at the end of the tunnel. You have stated that your sister got residency so I presume that there was a Residence Order put in place when your sister separated from the father of this child. Just in case, I have also outlined the situation if there was no such residence order.

Residence Orders – If Everyone Agrees

If this is the case, then a residence order should be adhered to, although if everyone involved consents to your niece going to live with her father, there may be no need to go back to court. Your niece can simply live with her father with everyone’s blessing by way of an informal arrangement.

Residence Orders – If Everyone Does Not Agree

If your sister decides that she’s not happy for your niece to live with her father, it may be that the matter should be referred back to the family courts in order to have the residence order amended. In such a situation (when the parents cannot agree) it is important to return to court, because if one party merely acts without the consent of the other party and without court intervention, not only could the other party threaten legal action but they would also be in contempt of court.

If your niece’s biological father applies for a residence order, he will have parental responsibility until your niece reaches 18 (it’s only 16 if the mother has parental responsibility). When your niece reaches 16, she will be able to decide where she lives in any event.

No Residence Order

If there is no residence order in place in terms of your niece, there should not be a problem. If both your sister and your niece’s father agree about where your niece should live, she can simply go and stay there. If your sister is not happy about your niece living with her father, her father can go to court to apply for a residence order. If such an order is granted, it will automatically give him parental responsibility.

Timing

Given that your niece is already 15 years old, it’s important to bear in mind that the process of obtaining a residence order can take between six months and a year. Your niece can also apply for a residence order herself, but will have to ask permission from the court (called ‘leave’) to do so.

The Court’s Decision

In deciding whether or not to grant a residence order the court always considers the welfare of the child first. They will also look at your niece’s specific needs: physical, emotional and educational, as well as her age, background and the effect the change in circumstances will have. Also, they will look at how capable her father is of looking after her, and very importantly any harm the child has suffered, or may suffer in the future.

Hi me my ex split about 5 years,, got a new girlfriend. But my boy doesn't like her he's 6. She pinched him few times shouted out him .. been to a solctoiiter and the police. Say not be on own.. today found out. She picked from school. Even got a solicitor. Stating not do this.. teacher are worried about he's safety as anything can do.. . We are going two parenting course and agree my son go see a council.. don't want her near my son..

Hi my daughter in law has dumped her two young boys on me she hasn't given me any money to support them even though she receives benefits for them. I have had them living with me for over three months now I need some kind of legal paper so I can change their school and doctors as she do not care about their health and wellbeing I need some structure to ensure they are safe with me I do not want her further down the road to tug them back from me I love my grandsons very much and I do not want to see them damaged later in life due to their mums behaviour can I get some advice please on what to do to protect my grandsons.

Hi me and my husband have been separated for over a year. 5 months ago I moved to the other side of the country to get away from him.
My daughter is 14 was coming with me but changed her mind the last minute and decided she wanted to stay with her friends and boyfriend so stayed with her dad.
I’ve been worried about her she been drinking alcohol most weekend and smoking drugs at her friends house. Her dad knows this but does nothing good about it.
She practically does what she wants.
Last night she got took home by the police for being drunk. In front of the police he grabbed her by her hair and pushed her up the stairs.
Police went up there after and asked if she wanted to talk about it but she said no.
Tonight she called me crying that he grabbed her by the collarbone and threatened that she was being sent to live with me ( which she doesn’t want to as her friends are down south,) she is so upset. I really worried about her what can I do to make her safe? I was under the impression she can choose where she lives is this true? She would be better taken care of being with me her mum.
Her dad is addicted to prescription meds and an alcoholic I’m worried he’s going to do something bad to her one day. Please help !

I'm 14 and i'm a black kid from Baltimore. I can't stand my mom she is always abusing me i'm failing science and she is talking it too serious. I want to live with my dad because he has been in prison since i was 1 we share a perfect relationship together than me and my mom and he really gets me. He isn't serious about everything but he is just like "those dads". Please help me decide. I wanted to tell my mom that i wanted to live with him since i started 8th grade and she started abusing me. One time she gave me a black eye, another time she broke my legs and with a metal stick and i couldn't walk for 5 months straight. She gave me canker sores 23 times and i'm sick of it. I think it's best to live with my dad.

My ex partner and I share residency of my 11 year old daughter. she is with me from Friday after school to Monday when I currently take her to school. this was decided initially as her father only works weekends and I work Monday to Friday. her father has recently married and now has decided to move her, his new wife and her 5 children 1 & 1/2 hours away without any consultation. this will make it impossible for the court ordered arrangement to continue. I left the relationship because of his controlling and emotionally abusive behaviour and he is now exhibiting the same pattern of behaviour in his new relationship. (they have been together for approximately 10 months, married for 5)
he is adamant that my daughter is happy with the move but she is telling me she wants to stay with me. I have been advised to apply for a prohibited steps order but have to attend mediation first and he is refusing, although he is happy to meet personally to discuss the matter, no doubt he thinks he will be able to intimidate me. they are apparently moving at Christmas so time is running out.

My son is 5 nearly 6. His mum has always had majority custody of him. He has been saying that he wants to live with me since he was 3. Over the past year he has started developing speech issues due to nerves around his mum. This is most noticeable in the form of stuttering and double emphasising the end of his words. He recently told his mum he hates her and doesn't like her. Today following their conversation she's cut our agreement of half school holidays down to seeing each other to four days. He told me it's because she fibs, she doesn't care about how he feels, she's really mean when she drinks and when he made a bad choice at school he couldn't stop crying when he got home but was trying to be really quite because he was scared that mummy would hear and go crazy. He understands what a lie is and can explain how he feels and the reasons why he feels the way he dose. Given these circumstances would the court listen to him or would the court say he's too young and force him to live with her until he becomes a teenager?

My ex has cut all access to my children I'm trying mediation but I haven't seen my kids for nearly 2 months.
There is no court order on place but I don't want to do anything that can land me in trouble any advice would be appreciated

Hi can anyone help me please. I am currently going for custody of my 2 daughters, and 1 had expressed her interest in to stay with me but case still concluding and she has told her dad she don't want to go back to his home ever!! I told her I'm not forcing her to go back to her dad's. If I force her to go back she will hate me and I don't want her to have a grudge against me. She's 8 and her sisters 7. Will it affect my case and while they with me.... HELP

My two youngest children are currently staying with their father on a residency order but my just turning this month 12year old daughter wants to be across the road living with me full time. She needs her mother and craves this so much. Although father has residency order he has both children in no set routine his parental skills are awful he punishes her by taking her from his house to his mother's and sees that punishment I think he does not address situation well at all. They are separated all times one at his and one be at his mum's. She wants home to me what should we do to enable this. Advice appreciated. Thanks.

My 12 year old son desperately wants to live with me and hates his mum. There is no court order at all but his Mum doesn’t want him to go. What can we do? He has even just mentioned suicide and we feel helpless

Hi, My daughter moved in with me recently who is now 12 due to several years of difficulty living with her mum. She clearly doesn’t want to move back but still sees her mother every weekend. She has even spoken to social services recently on her own and expressed she is much happier with me. I’m not stopping contact at all and she is welcome to see her anytime but her mother never makes that effort and does not speak to her daughter at all during the week. In fact it was myself that had to encourage my daughter to see her mum at all so I’m responsible taking her to and from her mothers house. The lady from social services said due to her age she was able “to talk with her feet” but I’m curious if there is anything I should look into legally?

Any advice would be greatly appreciated

Speak to the father first of all if you can. He may be willing to discuss this with your son and you might be able to come to an arrangement. If not, you could try mediation, after that (if it's unsuccessful) you might consider going to court for a child arrangements order.

Hi my children are living with there dad, through me going through a break down 7 years ago. It was decided through social services that they stay w there dad until I sorted myself out. He hasn't got a residency order it never went through courts. I did try for share care but never went anywhere as the children's dad said they were happy where they are. I see my children every weekend and Monday, I have them one night one weekend then next weekend I have them two nights. My 9yr old is asking to live with me now. What are my rights in this. I'm a little scared of stirring things up which isn't my intention, I just don't like seeing my 9 year old upset. I have asked my 14 year old what would he like and he says he is happy as things are.

Hi there, can you please advise, I’m going through divorce, our house is in dispute with court, husband won’t accept me getting 75/25 in my favour as we have a 12 year old child, we also have 3 adult sons... I’m now in refuge with the 12 year old son, his dad & brothers are always persuading him to go live with them, 12 year old is getting upset saying he wants to live with them... it’s clearly his game as not to sell house, if the young son does live with them, where do I stand?, I have left an abusive home from husband & sons, now they’re being so nice to the younger son, and younger son now wants to live with them. 3 bedroom house , 1 minor child, what’s going to happen if young child does go live with them?, sorry for long note, I’m stressed and upset , I can’t believe they drove me out of the house, & trying to get young son back just so I won’t get my divorce settlement, thanks in advance

My sons went to live with there dad in 2015 as they haven't seen him for a long time and still living him but now my eldest son have seen his true colors drinking all the time haveing to take his younger brother to school who is 8and he is 11 we live 2hours apart and now my eldest son wants to come back with me this have never gone to court just a friendly agreement between myself and my ex partner so if my son is saying he wants to come home with me by law do I have rights

7 years ago my nieces and nephew were removed from the care of my sister and are now living with their dad my niece is nearly 14 and things haven't been going good at home and she asked to come and live with me her auntie I don't have contact with her father I have tryed on the past but it's a touchy subject my niece is currently staying with her nanny short term burn long term she said Shen can't have her what can I do ??

If you can't agree to this with the mother you may have to consider mediation - then court for a child arrangements/residency order. The courts make their decisons on the best interests of the child, not the financial impact on the mother.

My 12 year old son who has Aspergers lives with his mother (there is no court order in place) my son has told his mum he wants to live with me and her reply was 'I can't afford for you to live with him' she would no longer receive maintenance and disability living allowance.
He is not happy at the school she has sent him to, he knows the schools where I live are of a much higher standard especially for children with autism/aspergers. He is a very sensitive boy and all the upsets are not helping him.

I have a contact court order as primary carer for my daughter who is 14 . She sees her dad once a fortnight from Friday night until Sunday return 7pm . This has been in place since 2008.
My daughter and I had an argument where she has left the house and gone to live with her dad and is refusing to communicate with me.
My ex husband has contacted a solicitor and sent me several messages that she does not wish to live with me any more.
She has been gone for 6 weeks but texted my partner to say she misses me and has sent me a mother’s day card.
I have asked her father to go back to court to amend the contact court order if she wishes to reside with him.
Please can you advise of my rights

Have you tried to contact the father? Assuming you have parental responsibility and there is no safety reason why contact has stopped, then as the father is away and the children want to go home we don't think you're breaking any laws in going to collect them. It's probably worth a chat with the police or a legal professional first.

Hi my children went to live with there dad as my eldest was getting bullied at school. And we said if they did not settle they were to come back home but they have not settled and father refusing to allow them back home. No court order. Boys are 11 and 13. He has stopped all my contacts for no reason. My 11 year old managed to contact me last night and say there dad has gone away with the navy at sea and have left them with his girlfriend who have no parental rights and they a want to come home. Can I go get them and bring them home without police ect

I need advise my 12 year old daughter is unhappy where she is there is a residency order in place she wants to come me live with me but the parents are saying it's not happening she is acused of stuff that isn't her daily spoken down to things taken away from her she won't speak to no one they have taken her out of school and apparently home schooling her left in the house by her self and belittled front of groups of other family members she continuesly runs away and misbehaved now the other thing is she lives in England I live in Scotland and the is some slight differences in family law a lawyer here says she can make her mind up at age 12 some saying 16 others are saying the residency order is until 18 so she has to stay till then it's seriously damaging her it's destroying her inside she ain't the perky smiling young lady she once was just an empty shell please anyadvise welcomed

But her mum is putting pressure on her to stay with her by offering her gifts and faults promises.also my other son as said he wants to live with me and she is doing the same to him yesterday she offers him a new iPhone if he stays with her the kids are always at mine the cum from school to mine the sleep at least 3 /4 nights a week am on benifts and so is she but my son get pip which she uses to go away every 6 weeks while I ave the kids

If you can't agree arrangements with the mother, you may have to apply to the courts for a residency order, or a 50/50 shared residency arrangement etc. The courts will expect you attend mediation before you can apply for a court order though.

Me and my ex split up a year ago, we have two children and she’s stopping me seeing them because I’ve got with another woman.
I’ve tried my best to be reasonable but my ex is not cooperating. She’s got her family members to beat me up, she’s hit me in front of the children on many accounts and never picks them up on time! My daughter is 5 and said she wants to live with me, she was hiding behind the door when her mother came to pick her up.. what Can I do so I can have my two kids living with me?

You should be able to agree this, it's a perfectly normal/common solution and the mother should not be able to prevent it unless she considers you a risk to your son. If it were to proceed to the courts (for the courts to make a child arrangements order) you, your son and the mother would all be able to present a view.

Hi, I am currently in a complicated case with my estranged husband over contact with my 2 children. One of my children made allegations against the father of physical abuse which was investigated by the police. After being constantly portrayed as implacably hostilemail I won the case with a judge awarding a non contact order for one of my children after speaking to said child. I am now having to defend myself in appeal against the father and social services whon have stated that I am emotionally abusing the children for upholding their wishes and the father has now been granted a contact order for both children and I have basically been threatened either having the children removed from me. My children are still refusing contact, surely they have rights too but noone is listening in the appeal court and I have been told to tell the children that they are going to get me into trouble. Can you advise me where I stand. Thanks

Can your try mediation? It might be sensible to draw up an agreement so that your daughter spends specific times with you, rather just when she feels like it/wants to. Please don't let this split your family, it is after all in the interests of your daughter to be surrounded by people who will love and support her. If you find yourself unable to see your daughter, then you may have to resort to the courts.

My daughter currently resides with my mother and step father she will be 9 next week. Her and I lived at my parents house from when she was born and she remained there when I joined the Army. My parents have had my daughter in their care ever since but there have been talks about my daughter coming to live with me now I am settled in my career. However, my parents said that my nearly 9year old daughter has the choice but she has been going back and forth on which she wants to do. My parents have become extremely nasty towards me when my daughter said she wanted to come with me and since I’ve returned to my work my daughter has changed her mind again to stay with them. (Coincidence). There is no legalities in place and I contribute financially for everything my daughter requires. I see her as regularly as I can but find it increasingly hard to go home because of my parents. I’m just looking for advice because I cannot see this being dealt with in an adult manner when it is surrounding my parents, and I am at my wits end on what to do next. T.I.A

Hi my daughter lives with her dad and is very unhappy her dad took me court and the kids wanted to stay with him but the judge said if my kids wanted to come to me then we would have to sort it and he is not having none of it she is 15 and is on about running away from home which worries me need some advise as I no she would contact ne if she did but what do I do should I ring the police and tell them if she does or what I want what's best for my daughter

Hello I need advice please my ex partner & father to my 5 children all live with him .we separated 10 years ago now & he took me threw the family court got all the orders he put in to the family court . Now our 14 year old daughter and our 10 year old daughter have both asked to come to live with me . They are not happy living with their dad but he has gone mad and told them they have got to live with him until they reach 16 years old. Please any advice would be great .

Hi. My partner has 2 children from a previous relationship. They are 5 and 7. We have had shared care for the past 4 years. For the past few months they have kept saying to us that they don't want to live with mummy anymore they just want to see her one day a week. They hate going home to her and it's a upsetting situation every time they have to go home. We've been telling them that when they are bigger they can decide who they want to live with but I'm just wondering if a 5 and a 7 year old can make the decision themselves? They really really hate having to go home. It's not a matter of they have more fun here because we a both working full time and follow a routine with not much time for playtime during the week. Any advise?

It's up to you as parents to decide what you feel is best. If this were to proceed to court for a child arrangements order, the courts would be very likely to consider your son's opinion in the matter.

My ex partner and I separated 6 months ago. We have 3 children and I am a special guardian to one other child also.
Myself and the children left our family home, of 16 years, as the house was solely in my ex’s name. We made private contact and maintenance arrangements.
The children have all a different view of the time spent with my ex. One refuses to see him, understandably but I endeavour to encourage contact. One would like more time but has been refused it by my ex. One was indifferent, has maintained contact up until recently when he has been pushed away in various ways and one (eldest, 16) who has, for reasons I have opinions on but won’t verbalise, seemingly become the favourite and is staying there increasingly often, much of the time, alone for several days.
Before we left the family home, my ex partner seemed to spend much more time than ever before, with our eldest. During this time I became aware that my eldest child was distancing himself from me, was displaying hostility towards me and increasingly to his siblings.
I did not react to the distance but obviously have not tolerated any disrespect from him and have continued to parent all four children in the same manner I always have.
The situation with my eldest is deteriorating rapidly, to the point where he became mildly physically violent towards me a few days ago. For the whole family’s benefit I insisted he leave the house and go to stay with his father.
I informed my ex about the behaviour.
It fell on deaf earls and it seems that he has condoned it, made excuse for my son instead and gives the boy reason to feel justified in his actions.

My ex now informs me that My son wishes to live with him, will claim any money he’s entitled to and will reduce his maintain payment.
Although at this time I do think his staying there is for the best, we as parents, haven’t discussed the incident or our Son being there on a permanent basis. I have not agreed to it as the only parent with PR and nor do o consider it to be in my child’s long term best interest.
My question is, at 16, can my son chose this fir himself? If he is alone much of the time etc?

She should speak with a family support worker. It would probably be necessary to apply to the court for a change to the residency order that's in place at the moment. The Family Lives Helpline might be useful.

Hi this is about my friend and her son. He lives with grandparent under a residency order but is really unhappy being there and is out of control all the time he is with grandparent but when he is with mum he is calm settled and a different child . What rights does mum have and what can she do to get him back if she thinks it affects his health and wellbeing please x

In order to receive benefits in respect of the child, you would need to be her official carer. You may need to consider a special guardianship order. Social services may be able to advise.

I have a problem my brothers partner has 4 kids 2 of which are my brothers. My brother is with her and helps with all 4 kids however as my niece doesn't have a sen or isn't the only boy or the baby she is being neglected. I've brought all her clothes, she is normally dirty and I have to wash her and she has nits all the time. She has asked to come live with me on several occasions. I want to take her on but my place is tiny, if they agreed for her to live with me could I then get benefits for her so I can then get a bigger place for her and a bed and all that stuff? She's 7 she's been asking me since she was 4 to live with me and saying she wished I was her mum. It's breaking my heart and her behaviour at school is getting worse.

Can you not discuss this amicably with your ex? If your son is desperate to live with you and the older sibling is no longer a child, he may be in agreement. If you both agree, it doesn't matter that the court order was for alternative arrangements.

He is unemployed, doesn't properly care for the kids (ie no bedtimes or mealtimes etc) and he is a recluse. My son says when he is 14 he is going to just come and live with me and my husband and his dad can take me to court if he wants (which he will). What should I do about this as I can't talk him out of it? I promised my ex that I wouldn't take him to court as I spent 7 years fighting for custody but I need to put my son first.

I have a 50/50 residence court order with my children's father. My son is 13 and has aspergers and adhd. My daughter is 12 and desperately wants to come and live with me full time. She's been very emotional over the past year asking if she can stay with me. She finds it difficult listening to her stepmother bad mouth me and also finds herself way of discipline alien to what she's used to. She was even told if she lives with me they would loose their house and she wouldn't be able to see her half sister anymore. She has been told many things by her stepmother which I find disturbing and has got that bad I know it's affected her mentally to the point where she's self harming. I've spoken to social services who said they can't do anything because she's not at risk of harm. My daughter is afraid of speaking up about it in case her dad and step mum find out. I feel stuck, frustrated and broken hearted for her as she's looking to me to get her out of this situation but I feel that unless I have the money to change the court order there is nothing I can do. Please, do you have any advice that might help? I'm desperate.

Hello, i was wondering if you could give me some advice... my son is 15 this year and has been living with his dad since he was 3 due to me being ill when he was little, i have him every other weekend and holidays, i went to court to give his dad PR as we wernt married but it had to be an order as i had no photo ID to do the agreement, my son is now saying he wants to come back home as hes getting threatned by his dads wife that if my son dont change his attitude it will make his dad and wife spilt up... my son has packed a bag incase she starts with again and hes told me he will walk out and come to my house, where he will be made welcome... can he chose where he wants to be due to his age? Why not discuss it with the dad? Perhaps a shared arrangement could be made? If there was no court order and the children were not actually take out of your mum's care for safety reasons, there's no reason why they can't come to some arrangement amicably.

If he has to go into foster care, social services will generally decide which one, so unless you're willing to have him at home as an alternative it's unlikely you will be able to do anything.

Hi I need advice my 2 younger children have been staying with their dad during the week as over year ago I had an emotional breakdown so I asked him if he could take them for a few days whilst I pulled myself together. However he had no intention of letting them come home he uses the excuse that I work at night 2 days a week. He uses my mental health against me. There is no court order to say that they should not be with me. He is a mental abuser. The children are desperate to come home permanently but he will not allow them. I have them every weekend whilst he goes away. They are both suffering mentally and physically I don't know how to fix this he blackmails me all the time constantly trying to undermine me as their mum. I am at a loss what to do he has the money and the power to do what he wants.

My sister's is going through divorce and to cut a long story short her husband is a master manipulater and mental abuser .she brought them up single handed for 11 years in that time he only saw them for an hour each day or weekends if my sister needed to go ie to funeral or wedding .they are twins and one is slightly autistic but won't leave his brother who is a controlling child like his father .He adores his dad who favours him over the other child also the other child has been verbally and mentally abused by his dad and brother. My sister has had the children removed from her care as the father has got his fav son to tell lied about his mum going to commit suicide.The social services have dealt with this in an appalling way and although she got an apology from the family court and the judge has told the father and social services to rectify it they are still acting as if she has abused them and even telling lies at school. She doesn't know who to turn to as everything she does or says is twisted and she has even been accused of trying to abduct them The family gp has even went to core meeting to tell them that she knows she was an excellent mum and that the things said are untrue ie she's an alcoholic and mentally disturbed.May I also add that this doctor also knows this man for what he is and he now is saying that the dr is upsetting the child with autism by attending the core meetings as he is a stranger (which is a lie ) it's a tragic story but my sister needs this sorted as she is now homeless and childless and social worker is on husbands side who has a new partner who had her children removed from her care because she abused them which is worrying my sister as social worker's are just letting this happen .when she writes to them they say they have to give letters to dad to read first then they burn them .he has so much power it's scary .PLEASE HELP If possible we are devastated as their older half brothers and all our family are not allowed contact and he is very biggotted against the Irish which is now coming out in the boys

If there is no court order in place at the moment, you can simply agree between you. If an order is in place already, then it should be fairly simple to get it removed if you're both in agreement on the circumstances.

Hi I'm 15 years old and I'm really unhappy at home, I don't get abused or anything but just constantly arguing with my mum all the time and she is mentally abusing me if you want to put it that way. I feel too scared to ask her too move to my dads because she would just shout at me and make my life even more stressful than it is and make me feel bad but I would love to live with my dad so much me and my dad are so close we have a good relationship and get along well, shall I ask my mum too move in with him it's easy access too my school and it far from my home I'm living in now. If your mother disagrees with you living with your father, he will need to apply to the courts for a residency order. Bear in mind that the courts may expect your parents to try mediation on order to reach an agreement before court action. As you are 13, the courts will take your opinion into consideration along with other factors.

My ex wife has residency of our 14 year old daughter. My daughter is in constant conflict with her mother and wishes to live with me. She is very intelligent and well able to speak for herself giving clear reasons why she wishes to live with me. She is soon to spend her allocated holiday time with me and has said she will refuse to return to her mother. I am fully prepared to support and help her. In urgency and anticipation of her remaining with me am I able to get an urgent court order for a change of residency? If she refuses to physically go back what can be done? Yes, your next step is the courts if you've already tried mediation. The courts will decide based on the best interests of the children. If they can, they will take the views of the children into account.

His daughter has a right to contact with her father if she wants it. If the mother is not allowing this and will not agree to reinstating contact, then your partner will have to apply for a court order for contact. The courts may insist that the parents attend mediation first to try and come to some sort of agreement without the court's involvement. Any agreement made at mediation can in fact be made legally enforeceable by the courts as well. If mediation is unsuccessful a court order will be necessary.

First you should try and persuade your ex to attend formal mediation (the courts would usually require you to do this before a court order). If not, then you will need to apply for a court order for full residence (form C100). The courts will decide what is in the best interests of yor son, whose opinion may or may not be taken into consideration (it's usually age 11 upwards before a child'd view is asked for).

My 9 year old son wants to come and live with me and my new partner and we are more than happy with this, his mum leaves him at home in his own alot and with his sister on some evenings so she can have a social life. He roams the local area where he lives and if not with his friend is on his xbox all day, at what age can he say he wants to come and live with me and be heard?. We have a house good jobs and my new partner is looking at fostering children in the near future so would be at home to give my son real parental care, he does get on really well with my new partner. Hi there. My son is almost 9 and recently told me that he would like to come and live with us. My ex wife and I split up when my son was 1 year old because she had a drink problem. She was caught drink driving with him in the car just 2 months after we separated. I fought for full custody, but was not successful because social services told the judge that my son would be safe if my ex followed the care plan. She secured a residency order and I have access.

In June 2015 my ex was caught for a second time drink driving with my son in the car. She was banned for 40 months this time. Social services were again involved but they have now closed the case again as she has been dry for almost 12 months.

Now that my son has asked this I wonder if I should apply for residency again? Would the court take account of the ongoing risk to him by her drinking again and would my Son's views be taken into account. He would be moving to another town, new school, etc, but he seems very sure that he wants this.

What advice do you suggest.

You need to talk to both of your parents about this. Your dad may be stressed out by the position as much as you are, which is making him behave the way he does. If you decide you simply can't carry on seeing as much of your father as you have been doing, your mum might have to consider applying for a court order to change the arrangements (if your dad won't agree). Because you are 12 years old, the courts may be willing to take your opinion into consideration.

I am 12 years old and live with my mum, step dad and two step sisters I am meant to live with my dad every weekend fort nightly and two weeks in the summer. I hate going to my dads, we don't go out and do anything. He has a terrible temper and I can't talk to him at all. I asked my mum to talk to him for me and he called me up and started shouting at me then he just hung up on me. He detests my step dad but he is more of a dad to me. I want to change my surname and I want to stay with my mum more because I am almost a teenager. I want to be with my family here and my friends. What do I do?

6 weeks ago my daughters dad smashed my car window resulting in her receiving a smal cut to the head. we are going back to court so I can hopefully get the child arrangement order changed, him to enforce the original order as she hasn't seen him since then. She has stated on more than one occasion that she doesn't want to see him at all and although I explained that the judge may decide she has to she told me she would hide when her dad turns up to collect her. You could try pursuing this through the courts. They will consider the views of a 15 year old but will also take all other factors into consideration and make a decision based on his best interests. It might be worth chatting with your son's form tutor or year leader at school. They may be able to chat with him about the importance of early nights, punctuality at exam time etc. Teenagers often take far more notice of teaching staff than we credit them for (and usually far more than they'd take notice of parents!)

My son is 16 and studying for exams. I am strict with him ie has to be in for a certain time, hands his phone over to me at 10.15pm as I think this is late enough on a school night and make sure he revises. He decided 4 weeks ago to go live with his dad as we are stressing each other out - his words. He stopped at his dad's once a week previous to this. His dad lives in a 1 bedroom flat and my son sleeps on the sofa and my x husband leaves for work at 4am so not around to get my son out of bed - I've had to physically drive down to get him out of bed at least once a week. I want my son home period but until that happens at least the night before an exam and my x I'd telling me it won't happen - don't see why as he would stop at his each week. I'm at my wits end at this moment in time. Can my son decide where to live as i don't feel like I have a say at this moment in time - can I take this further like the courts etc!! Help.

If their mother is in agreement they can simply make an arrangement that the children (or the eldest one who wants to) either spends more time or lives with dad. If the mother doesn't agree, the courts might take the opinion of the 12 year old into account. It's unlikely that the views of the younger children would be considered by the courts.

Hi all, my 11 year old biological son would like to reside with me and about to go to final hearing regarding switching resident parent status although have no legal representation and keen to know what the likely outcome will be.
My marriage of 7 years had broken down in March 2012 and wife left taken 2 children with her, these being my biological son & my wife at the time stepdaughter, aged 12. There was no physical violence although wife claimed emotionally abuse and controlling behaviour, all of which was unfounded and supported by no evidence. In fact, had 2 years worth of text message history that contradicted all these claims. My ex went to great lengths to keep my son out of my life and refused any contact and had t wait 4 months for the enxt hearing before even speaking with my son. Then after that, only 2 hour supervised contact in a local ymca, this now being 210 miles away from my home address, as my ex moved away purely to make things difficult for me and for that matter, her daughters biological father, who also lived near me.
It took 18 months for the courts to grant me every 3rd weekend and half all holidays with a resident order and I’ve had to do all the travelling to make this work, this being 16 hours, 840 miles, £160 petrol from picking my son up from school on Friday to dropping him back to ymca drop off point on the Sunday.
The courts have asked for C7 report to assess my sons wishes & feelings, in which he has stated many times ‘that he really wants to live with his dad’ but also mentioned once, ‘that it wouldn’t be the end of the world if he wan’t allowed’ . He has since put in text message that he ‘hates the secondary school he’s been selected for and cannot wait to move down’. My son is above average in his class and is mentally mature/developed for his age, so surely at his age the court must listen and act? Also, if not, when and why? What about the travel not being split or telephone conversations not permitted, even on birthdays & Christmas? What can I ask for and what is the next step if I get refused by the courts, despite my son’s wishes?

Hi I split up with my ex beginning of last year who I have 3 kids to 2 boys and a girl age 7, 5 and 3 I do get regular contact with them as I have them every weekend which I love but if my ex gets a strop on it can change at a drop of an hat as she says it's her terms or nothing and I'm think of going for full custody as I believe they will be better off with me as my ex has a new partner since April or May last year who is a known drug dealer and user. Over Xmas I ended up with my kids for the full duration of the school holidays except Xmas eve till midday Xmas day which was brill and on one other day when she had my eldest overnight but not the youngest 2 even going as far as tell 5 year old daughter who was want to spend time with her mum to her face 'your staying with your dad I don't f***ing want you' where do you think I stand in getting my kids full time and best and quickest way of doing it cheers

Hi my son of 11 years old told teachers that his mom calls him names and even hit him on his arm, i was called in at school and had confirmed about mom's abusive behaviour towards our son and even towards me, i had told them that mom says that she could have automatic rights over the child even if im on the birth certificate, she has emotionally, mentally and physically upset both of us i have not reported this to authorities as i have lost faith in the system as they only listen to the ladies she also had threatened me last year that she will break my legs or even more, even the wife says she will make a big false file against me and police will take action i have noted dates of all her remarks from her. The early help worker got in touch due to referral from school the wife cried and made me look like the abuser and not the victim of this marriage now she saying she got a house and will take the child away which the child clearly states he doesn't want to live with mom due to her violent behaviour. I hope someone out there can help asap.

My mother and father split 10 years ago. My father moved abroad and so had to relinquish all his parental rights. My mother and step father raised my younger brother -11 years old-. The rest of my family, me included feel they are not caring for him properly. His clothes are hand me downs of my step fathers. My mam is constantly lying about going to work although she is unemployed - just to keep her husband happy- its christmas eve and we had to give her money to bit him presents as she didn't have any however she still buys herself and her partner alcohol every weekend. Any money my dad sends mysteriously disappears. We are sick of my brother being second best. My grandparent want to take custody of him, they only live along the street so there wouldn't have to be a change of schools or any major upheavel. Do they have any rights? And want can they - if anything- do?

I split with my daughter dad in 2014, he decided that even though at the time she was almost 11yrs old,, she was to live with him, plus he took my other child who he is not the father of, who was almost 17 yrs old to offer her a room too as he needed a child minder for our own daughter,, for over 7 months he refused me access to my 10 yr old daughter, every excuse in the book,, cut a long story short, we got back together to make a go of our relationship,, it hasn't worked,he's still got so much influence on my own son, that I texted him to say leave the only child I have left in my life alone,, to get a text message from him saying never to contact him again, he's up north with our now 12yr old daughter,, he has her own passport, birth certificate, he kicked off last August accussed me of refusing her passport,, i had no idea he'd even applied for a passport for her at the time,, what are my rights to my daughter, given that he's her birth certificate and now a passport, i only work part time, he's got money and family with lots more, so I very much doubt I can fight him through the courts,,, i just want to have my daughter with me if she wants to,, if she's not too scared of him and his controlled manner

Hi, my nieces paternal grand parents have a residence order due to my sister having served a custodial sentence, on my sisters release she has tried to maintain contact but has been unable to due to the grandparents not allowing, can they legally do this with just a residence order? I am offering to supervise the contact with my niece and my sister as I have regular contact anyway with my niece, but they will not allow it.

It would be best to try and continue the existing arrangements until the court hearing. Obviously if she is really distressed, you as her mother will know when to stop forcing the issue. The courts may take her views into account at the age of 11.

Hi my daughter is 11 and my son is 8 - I have been separated 2.5 years. Our divorce is pending. When we separated we drew up our own minute of agreement of a 50/50 custody arrangement currently 5 days and 2 days rotating between us. My ex lives with a woman with 4 boys 3 of whom are under 10 - my daughter is increasingly unhappy with the arrangement and often refuses to go to her dads - I have tried my best to support her having time with her dad as he insists she is fine when she is there - it culminated yesterday in her reusing to go and him physically dragging her from my car kicking and screaming - I cannot see this is right - can I keep her with me pending applying to the court to give her more time with me? As what occurred yesterday was extremely disturbing and cannot be in her best interests. She consistently tells everyone she hates it there and is a very mature articulate girl - will the court take her opinion into account.

When my daughter was 4 she went to live with her biological father due to me having bad post natal depression and managing to cope with my newborn. I felt I couldn't cope and felt this was best for her at the time. A resident order was put in place and I was advised to see her at the end of every month for her to settle in at her dads. Since then she has been coming a lot more frequent and also calling 2-3 times a week. Recently I had an agrument with ex new wife and she was very abusive to me on the phone saying she had all the rights and could stop me seeing my daughter. I then had no contact with her for 3 weeks. I called my ex and asked if it was going back to the original court order which he replied no. Just recently he has called and now said dates we had agreed for Christmas are no more and has changed them, this means my daughter not spending time with me or her other siblings to celebrate my birthday. He has also said I am no longer allowed to call her? Despite having regular phone access with her for the last few years. My daughter has said to me that she would like to live back with me, and cal me on the phone but there saying otherwise. I have tried to mediate with him but I'm getting no where. Please help me with where I stand??

Try mediation, they can draw up a legally enforceable agreement for the times your daughter spends with both you and her father. If you cannot agree, you can apply to the court for a child arrangements order; they will listen to both sides and also depending on her age at the moment, may consider the wishes of your child. The court decision will be based on what they consider to be the best interests of your daughter and they may ask for a CAFCASS report to help with this.

In 2009 my ex partner got a full residence order for our daughter as I had a problem with addiction and depression. Anyway I kicked it all a year later & he was happy to let our daughter stay with me whenever she wanted to. A year or so later I brought up some issues I had with his parenting & since then has been making it harder & harder for me to see her. For the past year he has been mentally abusing her & she's been self harming because of it. She has been wanting to live back with me for so long. But I was told by a solicitor that she could decide for herself when she's 13. She's had enough & it kills me to drop her back off at her dad's & see her so miserable. I've tried talking to him about the way he is, but he won't listen & has put our contact back to the original residence order, which is impacting on my daughter massively. What can I do?

hi, im after some advice as my 9 year old daughter wants to live with me and my partner and has been asking for quite some time (although even to her mums own admission shes been wanting to live with me for years, telling her mum and crying every time i took her back to her mums). Her mum asked me to talk to our daughter as she said she needs to make her mind up and wouldn't stop it however shes changed her mind and wants to keep her. my daughters very unhappy at her mums, hates going back, tells everyone she hates it, doesn't feel loved, gets pushed around and hit by her brothers all the time and her mum doesn't do anything about it etc. i have my daughter every weekend fri till sun night and buy everything from school pens, uniform home clothes etc where her mum gets her second hand clothes from her friends but buys new tvs tables etc and goes out a lot drinking, no care or consideration for my daughter. her mum also has mental health issues and neglects the kids (in the sense no time for them, passes them off and as a result her son has developed mental issues and is very violent at home and at school) put them in danger with violent partners ( police called out numerous times, restraining orders put in place). So im looking at going for full custody but trying to get all the details as i can before hand to make it less stressful and worrying as possible for my daughter.
any advice or information would be very helpful and appreciated, thanks

I am divorced from my husband and have two children aged 12 and 13. The 13 year old boy now wishes to go and live with his father. I am their primary carer and he sees them for a few hours at the weekend. We have social work involvement with the family. my son is very disruptive and is not doing well in school and recently diagonesed with ADHD. His father is always giving him the easy option and I am being seen as the bad guy in this because i am trying to instill structure into his life. Can he get custody of my son.

No, he can only apply for residency via a court order (they may demand an attempt at drawing up an agreement via mediation first). The courts will look at all the circumstances and make their decision based on the best interests of the children.

It's usually a little older than 8 years old before a court will listen to the opinion of a child in the courtroom. If you have a supporter/social worker etc who can give a report, they might take it into consideration. The courts may also be inclined to order a CAFCASS report into your situation. If your illness is no longer an issue, could you ask your GP for a reference to back this up? There is a variety of options but they will all involve going back to the courts. Could you ask for more visits/contact with your children in the interim?

Hi my ex husband got custody of our 2 little girls and has full custody/ residency order issued (well v long story - but briefly I was unwell for a short time)My girls are now 6 & 8 years old and never wanted to live with him (4 years ago now this all happened) and still to this day say every other weekend they want to live with me. My oldest daughter is very adamant and has this weekend said is she old enough yet? I can't find information anywhere. I was told when we were at court though that children at the age of 8/9 were allowed in the court room and could have there say. My 8 year old has been telling her teacher at school that she wants to live with me but says that her teacher has told her she can't because her Dad says "I'm ill all the time". The constant saying I'm ill is taking a toll on my girls as I have now been married for 3 years and we have a 19 month old child together. So as you can imagine the girls are now getting older and wiser and thinking how I could look after my other child. What exactly could I do to help my little girl? I would obviously love my children to come live back with me and was devastated when my ex got custody as it was not what I wanted. I don't want to put her through unecessary stress so feel the need to say both girls are scared stiff of their Dad and do not know if they would be too scared to say what they wanted if he was there. Also I do not want to be seen as pressuring them either I love my girls with all my heart and truely want them to be happy and have what they want in life (they are not happy there - long story). Do they not have people they can speak to alone where neither parent is there so they are free to say what they want? What can I do? Every year my oldest has her birthday she has said around the time - am I old enough to tell someone where I want to live yet? Which the whole teacher situation really upset her that she thought the teacher would help her (unfortunately this teacher is a friend of the girls stepmother and lives we believe in step grandparents rental property and also is a friend on Face book with stepmother) which we have obviously not told my little girl. Please can you offer any info or advice no matter how small or simple or if not just to say there is nothing we can do etc so we all know where we are. I feel so helpless. It is hard too now there is no help for these kind of things - financially. My ex stopped me seeing them last year for 6 months (just because he wanted to pretty much). I had to pay out around £3000 just to see my girls again and I did nothing wrong and ex was not even penalised for doing this. I am still paying my family back for this - £1100 left to pay back. She can try to insist but if the father is sure that he wants the son to live with him, he can apply for a court order for residency. The courts will make a decision based on the son's best interests and will also consider the son's views. They will not consider the maintenance issue as a factor in this.

It sounds as though you've done the right things so far. If you and your daughter's mother are in agreement and the courts did not implement any specific conditions last time, then there should be no harm in her moving in with you, even if it's for a trial period. Wait for the results of your meeting with the school and children's services before making a decision.

Me and my partner broke up when our dauhgter ws 2 , it was not an easy break up and we ended up in court . in the end we agreed that my ex would have residency of our daughter as she lived with her half sister also and i had no desire to split them up. i see my daughter regulalrly for long weekends every 4 weeks, this was the most i was able to get through tthe family courts at the time. since then 3 years on we have now moved to weekends every 4 weeks , alternating school holidays and christmas's and birthdays etc. i have not seen my ex for over 2 years now and we communicate by email only { her choice} there have been a number of issues over the years which i wont go into as it will fill your webpage up .. however in recent months my ex has declared that our daughters behaviour is deteriroating when she is at home, she lassshes out at her half sister and refuses to eat , she apparently hates living their and has asked on numerous occassions to stay with me when she comes to stay with me and my partner and my partners 3 daughters. this week it has escalated and my ex has sent me emails stating she cant cope with our daughters behaviour anymore and she is exhausted by the mood swings and tantrums, she states that our daughter hates my ex and her half sister and wants to live with daddy , they have apparently tried to reason with her and she refuses to listen. the emails this week state that they have had to put her in her room when her tantrums start and that she has smashed her room up and banged her head deliberayly againts the door leaving brusiing to her face. each time in the past 3 years i have addressed iussues with childrens services and the family courts i have always come off worse than before and the only person that suffers is our daughter. my ex still refuses to meet me even when i have suggested mediation and meeting in public, i have stated i am willingto help in anyway , either by having our daughter stay with my ex or her coming to live with me and my partner and her children. ive offered full financial support to cover travel costs for visitation and would not need any form of maintenacne to be paid to me by my ex as me and my partner both have very comfortable jobs which have next to no impact on our daily routine with the children. Our daughter is 5 years old so i knwo the courts wont listen to here thoughts of who she wants to live with, but it is clear she is not happy. i am driving up to see her early as my ex has stated she needs help so i am taking addtioinal time away which is not an issue, i haev contacted our daughters school to ask for a meeting to see if they have noticed any difference in her behaviour and i have requested childrens services meet me with my daughter to discuss the recent emails sent to me by my ex.. is there anything else i can do? the way this all works is still so one sided it seems unfair on our daughter not to be listend to especially when she is clearly not happy at home for whatever reason.

It's difficult to force someone to care for children if they do not want to. You could try mediation (an legally enforceable agreement would be drawn up) or seek a child arrangements order via the courts with details of who has the children and when.

This would be fine if the child's mother were in agreement, but as she is not, the best option would be to draw up a child arrangements agreement using a mediation service. If that is unsuccessful then your son should apply to the courts (form C100). The courts will consider all angles and make a decision based on what they feel is in the best interests of the child.

My son spilt up with his partner some 12 months ago and she took the 3 boys with her. My son was made homeless and couldn't take the boys with him so didn't stop her taking the boys. He has kept in contact with the children and he got a flat soon after, so the boys stay with him every other weekend and sometimes after school during the week. His ex partner has moved a boyfriend in, and it has caused problems with the boys, causing the eldest boy, who is 12, to move in with his dad. His ex partner didn't stop it. The middle boy of 10 is very unhappy at his mothers and has also expressed a wish to move in with his dad but his ex partner is now threatening my son and has stopped the children from seeing their dad. Can my 10 year old grandson move in with his dad any way? They were never married and no court order or residency order has ever been granted.We don't want to see him forced to have to stay with her against his wishes but my son is unsure if he can just let him move in with him legally buy the way they stay in Scotland . Help please if you can clear this up ?

The mother's housing benefit may remain the same, but the your step daughter is living with you full time, then you should contact the child benefits office and inform them.

My husbands 17yr old daughter from a previous marriage has recently moved in with us full-time. There is a joint custody agreement in place but up until now my husband received weekend visits and school holidays.

She has registered for school over here and I wondered if there is anybody we legally need to notify as his daughter is now with us full-time?

FYI - We have stopped paying the weekly ,maintenance since she moved in with us but her mother was in receipt of housing and child benefits and is still claiming. Are we legally obliged to alert them to the change of his daughters residency?

My nephew lives with me he's nine I've had him nearly 3 years as social services brought him as mum was in a domestic violence relationship also drinking all the time I have a residency order now she says she wants him back now her life is back on track she as gone to have a baby she as other children that live with other family members but she's not interested in them only the child I have its so frustrating as she's still with the partner that the domestic violence was with and I here things are still happening the child does go when he wants to I let him choose I don't know wa to do as she's as mentioned it to the child but he comes back saying I don't want go live back there what can I do I'm at a loss just waiting for a solicitors letter I don't want him to go back we have come so far he had calling behaviour issues which have improved he's being accessed for ADHD she just put him down to being a naughty child I feel I done all this hard work now she thinks she can come and she she's taking me court and wants him back any advice is welcome

My partner has three children with his ex. His eldest son who is 17 lives with us and has done so since April this year. The younger two girls (15 and 10) are living with their mother. There have never been any formal arrangements made with respect to custody, but his ex refuses to allow him to see his daughters and it has now been almost two years. She will not answer letters, phone calls, text messages and if he goes to the house she calls the police. My partner is not a violent person and never has been. We have tried to go through mediation to resolve the issue, as going through court is not really a viable option for us at the moment financially, but his ex refused to participate (no reason given - there has never been an issue with domestic violence, although I'm pretty sure she would lie and say there has). My partner went to his youngest daughter's school out of frustration in the hope that he could see her there but he was told that as far as the school were aware he could not see her because he has an alcohol problem. He does not have an alcohol problem. My worry is that she is brainwashing his children and telling them things about him which aren't true without him being in a position to defend himself or put things right. It seems that there is no authority that will protect fathers who are being treated like this by exes who are using their children as weapons to hurt them. My other massive worry is the damage that is being done to the children who are being deprived of a very good, loving father. I have scoured the internet looking for advice and a bit of a lifeline or a glimmer of hope that there is help out there but so far have drawn a blank. Any advice would be extremely welcome - please...

@desperateK. As he will have parental responsibility, the mother should ideallly gain his consent before moving away from the area. In practice many parents just "up sticks" and go without informing the other parent. If your ex wants to ensure that he maintains a relationship with the children, he may want to consider applying for shared residency order from the courts. This would allow him to move out and for the children to stay part of the time with him. He could also apply for a prohibited steps order to prevent the mother from moving away with the children.

My partner has a five year old daughter and 18month old son. He isn't in a relationship with their mother anymore however they all live together. He does this to protect his children.
She threatens to take both children back to Ireland where she is from, which is why he stays as he is petrified he'll never see his children. He believes Irish law will take hold and he'll have no rights. He's being held to ransom in a house he pays for and an ex partner and children he pays everything for. She has never worked, paid taxes and has a history of alcohol abuse and theft. I want to help him understand his rights and options. Can anyone help?

@Flowers. At 15 you still have a say. Is a court order in place at the moment? The arrangements cannot then be changed without your consent. If your son wants to go and live with his father and you do not agree, the father can apply to the courts for a residency order. The courts will of course listen to your son's opinion at this age, but will also consider your ex's anger management issues etc. Once your child is 16 he can choose to do whatever he like.

It came to my attention that my son who is 15 had been texting/talking to his dad about living with him. He currently sees his dad 2 days out of 14 (every other weekend). His dad has history of attending anger management courses, depression and consuming large amounts of alcohol (hence my reason for leaving with all 3 children). When I asked him he said read the texts. I said I had read enough and could we talk. He said 'I want to live with my dad'. I was shocked, upset and angry. I said to him if you want to go that much then go now. He did. He text and asked me to pack his stuff. I refused and said that if you are old enough to decide where you live you can come back here and pack your own stuff. He refused. I am not strict but a firm mum, attending all school, sporting and social activities that relate to him. He has everything he needs, his own room, bike, mobile and goes short of nothing. I work for the NHS and do bootsales to make ends meet. I get £135 per month CSA for 2 children and go without myself so the children get what they deserve. My question is - can my son decide to live with his dad or do I have the right to tell him he can't?. Thank you.

@Doc. If you feel that the children are unhappy (and bear in mind many children do get upset at leaving one parent, yet it doesn't mean they don't want to live with the other), then you could apply again to the courts. They should decide what's in the best interests of the children, not the mother. They may order a CAFCASS report which means someone will look at your relationships and the children's behaviour around each parent etc.

However my daughter is unhappy and she told me she wants to live with me and not her mum. Even my son does not want to go back to his mum. when I drop him off he grabs a hold of me, cries and shouts no dad.....not mum.. dads home.... its breaking my heart..seeing as neither if the kids want to stay with their mother yet she cries a few crocodile tears and the courts believe her... shes aways out....going to beauty parlours, parties etc..and my kids are neglected.

am I able to go back to court, especially as my daughter does not want to live with her mother?

Hey im not sure what to do, I feel like im being neglected by my mom as she is always around her boyfreinds house or at work, I ask if she can buy me some non-torn cloths and she always tells me she has no money even when she is at a resturausnt, btw im 15 and I live in the uk. @linsgirl. If your son's father wants to change the existing arrangements he would need to do so by court order. The courts will occasionally take the views of a ten year old into account, but more often it's 12 and over before their wishes have any bearing.

@Homer. It's more likely that the court will order its own investigations via a CAFCASS family report. The CAFCASS officer may take your daughter's view (and possibly your recorded evidence) into consideration.

@leo. If you and your partner are concerned about this, you might want to consider formalising the existing arrangements via a court order. If you feel the boy would be better living with you full time then that's something to bear in mind when applying to the courts too.

My partner and his ex split when their son was 2 yrs old and eventually divorced a couple of yrs later. their son is now nearly 10 yrs old. He has always lived 50 / 50 with each parent, at first it was swapping every couple of days and more recently it is week on week off. however, their son has become increasingly reluctant to go back to his mums over the past few years and the night before he swaps over he gets very sad and anxious. she is a very volatile woman and constantly shouts at him, we have witnesses to say she doesn't treat him very well, not in a neglectful way but emotionally. she emotionally blackmails him and constantly shouts at him and calls him names, as he has grown up he has started to open up more about what goes on there, he says he loves his mum but he doesn't want to live with her any more. she knows nothing of what he tells us, he is scared to confront her and we feel that if he was to confront her she would blame us, saying we had been putting ideas in his head. which of course is not true, she has been very volatile with us in the past and is constantly throwing the "I'm his mother I can stop him seeing you if I want" card at us. is there anything we can do? obviously as a mum myself i feel like he does still need to see his mum! but he is really unhappy. there is currently no residence order in place it is all through verbal agreement.

I have Just found out my husband is having an affair and has been for some time. Things have been strained for a long time as historically I have battled with alcoholism. I am currently attending AA meetings and have been sober for 6 months. I am meeting with a solicitor tomorrow for the first time. We have 2 children and I am so very scared that huge problems will occur regarding the custody of them should we go down the divorce route...which is the most likely probability . @parsnips. Once you're 16 you can decide where you live. Before that, your dad would have to either negotiate with your mum so that you can live with him, or apply for a court order if she refuses.

i am 15 years old and want to go live with my dad, my mum is a nasty person and hits me if ive done something wrong or threatens to hit me. Although I am a troubled child like I smoke and badly behaved. I want to go and live with my dad as I have a good relationship with him and his fiancé, louise, and my step brother and sister. I always feel like im going to get smacked every time I go into my house or feel like im gonna get shouted at. I've hated my mum for years and always say I will leave but im too afraid in case she stops me from seeing my dad and my nana and granddad who I have a strong relationship with them as they are like my second parents, they've always looked after me.

What should I do? Can I go live with my dad or do I need a court order saying I can?

@Sue. This is such frustrating position for you to be in - many grandparents are in the same unfortunate position. Unfortunately negotiation is best solution but you could try a court order for visitation rights as a last resort.

My girlfriend has two sons aged 12 and 9 years. She has been divorced from her ex husband for over 6 months now. The father has been trying to convince the boys to live with him and his partner. My girlfriend has no residency order, but an informal agreement through the solicitors that the boys live with her and see their dad every other weekend and one evening during the week. When my girlfriend sends the boys over to see their dad, quite often he goes out, leaving the boys with his partner, who has claimed to suffer with stress and isn't physically able to work. The father has now on several occasions turned up without consulting my girlfriend first and on one occasion when my girlfriend was out and had left the boys under the care of the grandmother, the father turned up after speaking to the youngest son on the phone and took him back to his house for the night without my girlfriend knowing anything about this until she got home. The father has been threatening legal action on numerous occasions saying that the youngest son wants to live with him. What can my girlfriend do about this and also to stop the father from showing up without notice?

I have full custody of her and she sees him every other weekend.
My husband has brought my daughter up from 9mnths and we have two other children together. Recently we have talked about emigrating to Australia, we both have family out there and feel we as a family would thrive there.
My ex is not aware of this but would not sign any consent form for us to do this. Am I right in thinking that once my daughter turns 16 we can go without his consent? She has made it very aware to us that she wants to go when she is 16, and we spoke about holidays back to see her dad and other family.

@KL. The child's father can apply for a court order to prevent you emigrating etc. The courts will take all circumstances into account and will most likely give some consideration to your daughter's feelings at the age of 10.

My 10 year old daughter has decided she doesn't want to see her dad anymore. We divorced 9 years ago & I've spent most of that time encouraging him to see his daughter. He hasn't been to anything at her school since she started & between his job, wife & 2 other children he just doesn't have time for our daughter. She's now told him she doesn't want to go there but it was hard as she's scared of him, he actually hung up on her! Does anyone know where I stand on this legally? If she doesn't want to go then I don't want to force her, I think she's old enough now to realise the little input he's had in her life so far. We're also planning on emigrating to Australia in a couple of years which my ex has previously supported. I would never have considered this if he'd been a positive force in her life. He's now threatening to try to stop us but am I right in thinking my daughter can decide on if she wants to come when she's 12? I'm so tired of trying to keep their relationship going, he won't admit that any of this is his fault & just blames me for leaving him 9 years ago!

@cals. Are you willing to perhaps entered a shared residency arrangement where you spend some of the time with each parent? Maybe you could persuade your parents to attend mediation where an impartial person helps to negotiate an agreement which is then written down. Following that, a court order is your father's only other recourse. The courts will take your views into consideration at the age of 15. Once you are 16 of course, you can choose who you live with anyway.

I'm 15 years old, Ive been trying for over 6 months to live with my dad but my mum won't let me, I'd be so much happier living with my dad but as I'm only 15 I don't know if I can choose myself who to live with. My dad knows but he won't take it to court as it will make my mum very angry and if she wins I won't be aloud to see my dad anymore. I don't know what to do as all I want to do is live with my dad and I don't think I could cope living with my mum for another year as her boyfriend is in prison and is so controlling over me. Many years ago ( 20) I split with my partner and after a few months he applied for my daughter to be allowed to live with him. She was the 11 , just starting secondary school and apart from all other day to day activities was well cared for with myself. On the other hand her dad worked long hours lived several miles from school ( relying on someone else to take her. And lived in a 1 st floor flat. Social Serv. Contacted me and came to inform me of his claim. They told me that regardless of the facts at 11 yr old she could choose for herself. As one knows the grass is always greener on the other side and my daughter said in a private meeting with SS that is what she wanted . My whole life was torn apart. I know it's all water under the bridge now , but reading your articles this should not have been the case. What makes it worse is that now my 11 yr old grandson is nt allowed to decide for himself to visit us.

Need advice here.......I have recently moved back to Canada from England. I have a 16 year old daughter who wants to come and see me with the possibility of moving to Canada and staying with me. @lawandparents I have been spending time with both sides and every time I come back to my dad it's horrible. I Can't take living here anymore..I'm not getting anywhere with him here. I've tried everything and nothing works. I know living with my aunt is what's best for me. I'm happy there, the school is so much better there..and list goes on. I have to get out though because the only thing that is happening to me now is I'm not doing good in school even though I do all my work and I'm depressed all the time. @timber. If your dad is unwilling to let you live with your aunt under an informal agreement/arrangement, then your aunt would have to apply to the courts. They would look at all sides and may instigate further investigations to see how each situation would work in your best interests. In the first instance why not discuss this with all concerned and try to see if you can make some kind of informal agreement, to ensure you do not alienate your father - maybe agree to spend some time each week with both sides of the family?

My 7 year old son has asked on a number of occasions if he can live with me (his father). My son has asked his mother to which she has said no. Myself and my Ex wife split around 6 years ago and divorced to which I agreed to give residency with the mother as I wasn't in a position to give my son the full support he needed. Circumstances have since changed an my son doesn't hide the fact he wants to live with me. My son is unhappy due to spending so much time at a pre-school group and after school group as his mother and partner work long hours and can't collect him from school. Hi, I have recently got legal advice regarding my son living with me even though his dad has a residence order, all is good and he can. Due to fact his residence order expires in 5 months my solicitor said there was no point taking it to court because by the time it gets through the system my son would be 16 and the order finished . My question is can I claim my sons child benefit for him because his dad is saying I can't as he still has a 'live' court order so he can still have it (my son refuses to see his dad so it's not like my son is benefiting from it) . @Gemma. If she is living with her dad, he is the parent with day to day care and therefore is the one to be informed. Also as a 16 year old, she can pretty much choose her own school etc.

Court order states we have joint custody. I have the primary custody of my son for 15 years and we reside in Sacramento, CA.. My son went to visit his father in TN and he is suppose be flying back in Sept 2 in Sacramento. I am grateful that they are spending time together. I just found out that he is not going to be coming back home and that my son stating that he want to stay in TN. I am missing him so much and I need him back to me. The father is fighting me with this and making my life miserable. I just found out that my son has written a letter to judge wishing to grant him his request to stay with his father. @chris brophy. Their is nothing to stop you applying for a residence order or for increased access. Speak to your ex first and see if there's some arrangement you can come to. If she is unwilling, seek initial advice from a solicitor who may advise mediation, if that fails, you will need to take this to the courts. The judge will give consideration to everything you have mentioned here.

The x lives on a flat above her shop on a main road and I have them weds after school til 8, then friday after school sunday night every week. But every time I have them both, they both beg me to move in. I live with my dad in a house 3 bed. They have everything they need there and it's very close to the school an friends and everythin else. Cul de sac. They get to play out an HAVE fun with me every time I have them. When WITH her, they have to stay in flat on pc, because she is in work down stairs. KIDS upstairs on own. 10, 8 yrs old. So can they both move in or one of them. OR none ?

@Joshua. Speak with your father and mother separately, explaining your wishes. It may be that you can come to an amicable arrangement and spend more time staying with your father. If not, your father can apply to the courts for a residency order for you and your brother to live with him. The courts often take the wishes of a child into consideration once they're into their teens.

Pretty- I know it would be difficult but I think you need to speak with her dad and discuss this. Maybe he just needs a quiet word to say she needs you to call and seem like you want her to be there etc. If that fails, then at court you need to lay out the honest facts for the judge - your daughter's feelings may be taken into account. Make sure it does not look like you are trying to manipulate the situation in your favour though as that would look bad in court.

Please Help!!! I have 5 children who reside with me my 15yr old son is from a previous marriage, I was given full residency of my son when i divorced his father 13yrs ago and I have always maintained a decent relationship with my ex husband and always facilitated contact between my son and his father. At xmas (2012) i found out that during a contact visit my son had taken canabis as hes allowed to basically hang around with a bad gang of kids at his fathers and he has no boudaries or rules hes allowed to do whatever he wishes, my ex husband also gives him alot if money lets him out till whatever time he wishes, smoke cigarettes, provides him with condoms and my son loves it there (what 15yr old wouldnt)
Anyway last week I had surgery and my son was due for a contact visit for the weekend at his fathers and was due to be returned on sunday as usual however, on saturday I received a solicitors letter stating that my son was not going to be brought home and that he was now going to live with his father...this was not discussed or agreed in anyway. I have been advised eventhough I have full residency the judge will only listen to my sons wishes and that it makes no odds whether or not his fathers house is the best place for him emotionally or anything else. I am so worried as all I can see is this ending in disaster as he is allowed to run riot and has no parental guidance. Hes already been in trouble with the police fir making threatening calls this week ... I am thinking of applying myself to the court for an emergency order to have my son returned and throwing myself at thr mercy of the judge but I am allowed to do this and also do I have any hope of getting anywhere if i do get in front if the judge... Some advice please -
I have 2 children by my 1st marriage which failed in 2004 - 14yrs and 10 yrs. I have custody/residence of both children and have had so since 2007.
I remarried in 2008 and everyting was fine. Over the past 3 years my current wife has been very difficult with my son who is now 14. It reached breaking point 18 months ago when I threatened to walk out of her life unless she behaved more reasonably with my son.
Things seemed to calm down but only for a week or 2. My son was obvioulsy not happy and I was really concerned for him. If I tried to raise the subject my wife would get all agressive and then we would end up arguing. She would accuse me of taking his side and not hers. My 10 year old daughter didn't get involved.
Now after taking this for 3 years I have decided enough is enough. My son is on the verge of a breakdown and I have decided to move out of the house taking the children (who are mine and who I have a court order for) and moving to a rented house. My son is really happy about this but my 10 year old wants to live with her step mum.
I have now moved out, my 14 year old son is with me yet my 10 year old daughter remains with her step mum. I am playing it cool as I do not want to be seen as the aggresive father who just turns up at the house and takes her away (god I feel like doing that though). This must sound ridiculous to many of you but I really don't know what to do.
What I really want to know is what are my rights as the biological father?
Can I demand that she comes with me?
Do I have to go back to court to have the order enforced?
Her biological mother is not happy with this arrangement either, and does not approve of her daughter living with her step mum.
Any advice or help would be appreciated.

My daughter is 10 years old and comes to stay with me every weekend, but over the past 6months she has been in tears every friday sayin she doesn't want to live with her mum anymor. Me and my daughter have tried sitting down with her mum and told her she wants to live me with me but her mums not havin it and has refused. My daughter is now even more upset because of this and I feel I have to do something about this asap as my daughter is purposely being naughty for her mum thinkin her mum will send her to me aand I'm afraid its going to affect her education. What are the chances of me goin to court and them allowing my daughter to stay with me throughout the week and at her mums on weekend??

Hi, my son who I has been prevented from seeing me for 2 years although I have been in contact with, called me out of the blue yesterday and asked me to meet him. He is 15 years old. When I did he told me that he had walked out of his house and didn't want to go back. He says his mother and stepfather have stopped him seeing me for the last 2 years even though he wanted to and constantly pick on him and make his life miserable. They pressure him and bully him and that if I made him go home he will just run away. I took him home to my house and informed his mother of his whereabouts and wishes. She threatened to call the police if I didn't take him home. I refused and the police were called but all they asked was if he wanted to be here and if I was ok with that.
Now we are being threatened with court.My son no longer wishes to speak to his mother. He is in a panic now though as he thinks someone is going to come and make him go back to his mother.
As I have said he is 15. can he be forced to return without his wishes and feeling FIRST being considered? Also can he legally change school without his mothers consent? I hold parental responsibility. Please help!!

im not getting on with my mum and its been like this for a while and its making us both really unhappy, its not only causing problems for me and my mum it is effecting her relationship with her partner aswell they argue constanly because of the way things are with me, i really want my mum to be happy but shes not with me living at home because she doesnt trust me and she thinks i lie constantly. i really think the best option is for me to leave and live with another family member. with my mums permission could i go and live with another family member?

i have a 14 year old son his dad and me have been divorced since 2007, his dad sees him about once a month and i dont recieve any money from him to help with my sons activities or clothes, i am getting married and my son wants to add my future husbands name onto his name so he will still have his dads name but also my future husbands and my name, my ex husband will object to this, do we need his permission to add a name to my sons even though my son will keep my ex husbands sir name as well.

i am goin to be 17 in less than a month. my dad has custody but my grandma has gardian ship. my dad lives in arizona and so does my mom. my dad sent me to live with my grandma in FLORIDA because things werent going well at his house and i ended up cutting myself. he expected me to just leave the state without ever seeing my mom again until im 18.. im very very unhappy in florida. i have no other relatives there besides my grandma. ive always wanted to live with my mom but couldnt do to drugs on her part. my mom has been clean and sober for over a year or two now. and she really would like me to come live with her. but the town she lives in, isnt the best of towns. ive gotten into some trouble myself in this town when i was much younger. thats why my dad doesnt want me to live with her plus because of my moms past. i cant get it through to my dad that shes doing good and so am i. ive set goals for myself i want to be a police officer or join the military, and no matter what or where i am my goals will not change. but until then i would like to be happy and spend as much time as i can with my mom before i set off to ful fil my goals.
i want to take my dad to court and have either my mom or grandma get costudy, ive looked into getting emancipated but im unable to because i cant support myself and i dont have a job. im also scared to lose to him. if i lose im not sure where i will end up. someone told me i could end up in foster care. is that true??
please help me im kinda stuck on this. should i stay till im 18 and be unhappy or should i take my dad to court and risk it??

i am 12 years old and i have the same problem. i have 4 brothers and 2 sisters which most of them have different mums and dads to me, which means my mum and dad have ex s which caused most of the problems. both sister have moved out and 2 brothers have moved out. one still lives with each parent. i am stuck in the middle, where i have to live 2 days with my mum then switch etc. and my mum always has arguements with her boyfriend and my brother. i cannot stand it but i am forced to keep switching houses. i want to live with my dad full time. is there any way i can help this?

My sister died last year leaving behind her finance and 2 children, aged 10 and 5. The children previously stayed with my mum and dad about 5 days a week but since my sister died the children have been living there full time. My parents have taken over full responsibility for the children as their Dad hasnt been able to cope. Their Dad has since met someone else who he is now living with and spends most of his time with while my parents look after his children. He swans in and out of their lives, he hasnt been there for the children while they have been grieving over the loss of their mother, he doesnt understand what he's doing is impacting on his kids lives, they have gone through enough. I need to know if there is anything my parents can do to gain some sort of custody over their grandchildren. They need stability and routine and my parents need to have some sort of legal rights over them, so he cant just walk in and out when he feels like it. I would like to say he does provide for his children he just doesnt know how to look after them, we do have the best interest at heart for those kids, my nieces whereas he doesnt! Please help

My wife and I divorced nearly six years ago. She took our three year old son back to Northumberland, where she is from. I live in London. I have been travelling to see him every second or third weekend in all of this time. Additionally, I have him for some for half of his school holidays. I idolise him.

My initial plan was to steady my finances, as this divorce cost me a six figure sum, and then move to be near him. In the last year, I have applied for a dozen jobs (I am a teacher) but not got a single interview. I am beginning to realise that relocation is possibly not an option.

Six months ago I become involved with a woman and it looks like becoming long term. My son and girlfriend are fond of each other and he has suggested that he would like to come and live with us now. His mother would not agree to this and I know that I don't have a chance as he is only nine. However, I am financially sound and I can provide a good home for him. When would it be feasible to apply for custody and what is the procedure? I hasten to add that I would only do this if my son was definitely sure that he wanted to move.

I've been in this situation for some years, my mum and dad were never married but they separated before i could even remember.
My father is very unstable and lives a lifestyle i really don't want to live:
He has a male partner (wich is a thing that doesnt make me very confortable), he's vegetarian and makes me eat vegetarian wich i really don't want to either, he doesn't have alot of food in the house so i'm almost hungry there, he keeps inviting people he doesn't know from anywhere to his house when i'm also sleeping there and that makes me feel unsafe. He's very strange and get mad at me if i don't laugh when he enters in my room dancing and jumping in the morning while im getting dressed for school. I have some very bad memories from when i lived with him and its just a very complicated situation for me.

My mother is sometimes unstable too, but she has a calm nice clean house (my father lives in a place that is very discusting and he's sick with AIDS), i have my room with my things ( i dont have anything of my own at my fathers) i have my pets there too (my father doesnt allow me and threaten to let my bunny loose on the streets, and i dont mistreat my pets so he has no reason to do that) i don't know it's just a completely different envyronment from my fathers and i just love being here, it makes me feel much more confortable as a teenager girl who needs her things, her space, and her privacy.

I don't want to stop seeing my father, i have lunch with him sometimes and so, i just can't live with him, it makes me crazy, do you think there is a way for me to do this?

I have 2 daughters who live with their mum in Cornwall. We seperated 3 years ago and divorced in July 2011. The finances and parenting stuff is only just going through now, we agreed on finances but my x wife will not let me have me have the girls half the time, because my oldest daughter says that she wants to be with me at weekends to start with and maybe more in the future. My youngest daughter is the opposite and wants to live with me now. She doesn't care if her older sister is living with us or not. I would prefer if both children were to live with me, though I understand it may take time for the other to come around, get used to it.
I live 340 miles away due to work and commute to them every 3 weeks or so. I want be moving to Cornwall until the New Year 2013. I want the children to live with me when i move to Cornwall. Is it advisable to wait until i move to Cornwall before applying for a residence order or is it worth persuing it now?
My daughters are 15,13 respective.

Lately she has been very moody at home and her dad has been telling her she can go live with him which i am gutted about as all I have ever done is be a good mother to her and my working hours are to suit her also. He has been interfering in her life at home too, asking if she is being looked after properly etc. I can't take much more. Now my daughter is telling me it is up to her who she stays with and if it goes to court her dad will win because she wants to stay there. Is this true ?

hi, ive recently turned 15 and have been struggling at home, my mother met my step dad when i was only 2 so hes been in my life for nearly 13 years. 6 years ago my mother and step dad gave birth to my little sister and now there is also another baby on the way. im struggling with the fact that my step dad is very sarcastic and i dont like him at all. he also compares himself to my father who i love very much and hate that he does this, i want to live with my dad on a permanent basis but my mum insists im not allowed where as my father is all for it. i feel left out as part of the family and feel much more comfortable with my father, am i legal to live with my dad on my own accord or do i have to go through court which im not looking for. please help, im hating this and i am very anxious to live with my father.

My younger half sister (13 years) who is currently living with her mum, is having a hard time at home due to her step father who seems to be mistreating her rather alot. Mostly Threats are made by him, if she has a bit of attitude towards her mother he threatens to 'smash her in the face' and soften puts his back hand and finger close to her face. he has once slapped her around the face but other than that it is just threats and bullying towards her.
she is in a very unstable way, Crying to her friends and to herself in her bedroom most nights. She has only just confronted me about what is happening at home and the way she is being treated.
And i want to take full constudy of her but im not sure were i stand with legal rights with only being her sister. And what age does a child have to be to decide where she wants to live.

Hi, my question even though similar to the aboves, is actually quite different. Let me explain.... Last year, my son met a girl whom then told himof all forms of abuse from their mother and noe ex partner. She was 17.5 years old and asked me for sanctuary which I gave. Almost one year later she is still here as no one could stop her from staying here and now she spends most of her time with my son [now her fiancee]. Now in january 2012 her younger sister then 15.5 years old phoned her sister to ask me to do the same, as i was a bit worried I asked Social services and they told me everything was perfect at home so at the end of the week I asked for police advice and they told me to pick her up and bring to my house where it was safe, this I did and they took aa statement and asked me to look after her. Well now at nearly 16 [june 2012] she was taken from her friends house, before i could pick her up, by the social services without a court order and then placed with a foster carer without a care order. On top of that the mother issued through someone from the police station a formal warning undr section 2 of the child abduction act 1984. Basically stopping me, my wife and my son, her sisters fiancee, with a formal warning under section 2 of the child abduction act 1984. Stopping any access from anyone and because he sister spends near on all her time with my son, her sister can not see her sister either and the younger sister has been told she will not ever see any of us including her and is to forget us and that they, even at the age of 16 will take her away miles and miles to keep her away from us so she will never see us again. The thing is, the youger sister wants us to adopt her and of which after a while and various discussions with her and everyone else in the family, we agreed. Now at no time or point was a judge been sort spoken to or allowed to make a decison on anything. There has been no court order for the child's removal, there has been no judge to decide on the care order and no judge decided and agreed on the formal warning that we were served. The child was taken to a house and family she did not know and were complete strangers. The area was an area she has never been to or knows. She is stopped from making any phone calls to anyone. She is stopped from going out. She is being stopped from contacting a solicitor or having a representative of her choice in any meetings and is escorted round her school like she is under guard. Basically any rights that a normal person has or even a prisoner in jail has, has been taken away from her. Her only crime was to feel save, happy, cared for and for want of the better word, to be loved and wanted. This is what we give to our children and gave to her older sister and what she wants as she sees us as her mum and dad as we treat her with respect and like a person. My son is 12 years old and has recently been hit a few times by his mother and thrown out of there house. He now wants to live with me which is what I've wanted for years but have had a constant battle with his mother because it seems the law is very much against fathers. Social services know of the incident that I have just mentioned and they haven't seemed to do anything about it. Now I have a have heard that if apply for parental responsibility that I still won't have the final say we're my son lives because his mother will still have the main descion. So what I'm asking is now that my son is 12 is he old enough to decide legally were he wants to live on his own or will I need to go to court again to waste yet more money on court orders that in the end mean nothing ????

@Blondie. Discuss it with both your parents and see if they can come to some arrangement. If it has to be decided in a court of law, you are deemed old enough to give your opinion to the judge but lots of other things will be taken into consideration too.

This is a long one.
I ama trying to find out at what age can a child choose to live with the other parent?
I am a step mum to two wonderful boys, although there isnt anything abusive or any neglect where they are now we truely think they will be better of with us.
We have them every weekend and every school holiday.
Although this sounds great we think that we have more to offer, due to where we live and the amount of time we can give them, even down to the fact that we do they homework, bath them every day, make them brush teeth, when with their mother they get bathed once is 5 days and dont brush their teeth and are always in clothes to small.
They both have said they would like to live here but we would not separate them.
Is there anything we can do? i know this sounds minor to some cases but we truely think this is the best option for them both and of course we would love them here.
Please help!!!!

My ex wife has manipulated me, my son and the CSA since he was three. He is now 15 and is now becoming acutely aware of what is going on. I have not prompted this in any way. The existing CSA ruling, which of course determines how much I pay her, forces her to let him sleep at my house for a prescribed time each week. I am highly involved in all his activities, especially his sports and because of that we spend a lot of time together, both during the week after school and at weekends. When he's finished playing Rugby or Football at the weekend, he's often very tired and just wants to stay with me and go to bed. She will not allow this and insists I wake him up and take him home to her (about three miles). He is now getting fed up with all of this and especially when he gets back home, as she punishes him (and me) by making him run errands for her boyfriend. He is asking to sleep at my house more often, but she won't allow it, primarily because it could affect how much money she gets from me through the CSA if I decided to insist on a re-assessment. As he is now 15 and well-adjusted, is it possible for him to make a decision in this regard. I do not want to push him into anything, but I know there will be hell from his mother for him AND me if he does this. I don't really care about the money to be honest, although I would have a re-assessment if she decided to get stupid about it.

Question - My son will be 12 this year. He has stated on a number of occasions that he would like to live with me his dad. Currently I see him at least every other weekend where he stops, week nights etc, as he doesn't live too far away and will often ride around on his bike. I enjoy a good relationship with his mum, I pay a regular amount in maintenance. Its as good as I can be without being a family living together. The courts were never involved it was all amicable, well as much as the law allows for fathers. The split wasn't initiated by myself, I have suffered twelve years of missing out. He has a bedroom etc somewhere to stay, a home from home as it were.My question is how old does a child have to be before they alone can decide where to live? He, my son would like our roles reversed where I, the dad would be the main parent and he would see his mum every other weekend. Can I just inform his mum that he will be mainly living with me going forward and if she doesn't accept it to take it to the courts? Can you advise what his and my options are?

I hope you can help me. I am an Icelandic national and have two children, aged 8 and 10 and I have shared responsibility together with their father, who is English. We lived in England after the birth of the children but separated when the youngest was just 2 years of age. From that age, and up until December 2010, they have always lived with me and their father had them every other weekend (any more than that did not convenience him).In late 2010 I became unemployed and was due to lose the rental property I was living in with the children. After being unable to find suitable employment, I decided that the best thing for me and the children would be to go to Iceland, whether that be temporarily or not. The father of the children was not happy but did not object as such. The children attended school from january 2011 and I quickly gained employment. The children, however, were not very happy with the move, as they were in an unfamiliar setting, without their friends etc, as well as not speaking the language very well and would like to go back to the UK: They went to see their father in school holidays and in June went to stay with their father for the summer. They went with the thought that they would naturally come back to Iceland before the school starts.Now the children´s father is refusing to send them back, stating they do not like living in Iceland, and thinks they should continue living with him.I am absolutely distraught of the thought of not living with my children and am wondering what right I have. Clearly I know that the children would rather be in England due to that being the environment they are used to but I know that with time, once they have made friends and are comfortable with the language etc. they will be happy and settled in Iceland. I believe that the children are at an age where they cannot see that. If it came to having to go to court, are they at an age where their opinion in the matter is a strong factor in the judge´s decision?Any information on the matter would be much appreciated. This doesn't actually say if the child would have the legal right to choose who to live with. It just says about agreements between parents or the father applying to the court for a residence order, neither of these are the choice of the child. Can anyone say if the child can choose, what age the child must be to choose and where this can be found written in UK law. I have seen a few comments on other sites saying that as of 2005 a child of 9 or over would have the right to choose but there was no legal reference other than, 'My friend said a judge said that.....etc.' Not something I could make a sound argument with so any information would be much appreciated.
