Can I Stop My Children Meeting My Husbands' Partner?

Ask a Question
Can I Stop My Children Meeting My Husbands' Partner?
Mrs HC asks

My husband left me for another married woman with 2 children under the age 3. We have two childen together, aged 6 and 8. It has only been 4 months and the children are still reeling from it.

He now wants them to meet his new partner. I have said no because of the situation and I think it selfish and unfair to bring our children into this horrible affair.

Even though I have told him I don't want them meeting her, he will do it behind my back.

Have I any legal rights to say that my husband can only see the children if I am present?

I am assuming from your question that the children live with you and that legal divorce proceedings have not yet been started.

As the children’s father, your husband almost certainly has Parental Responsibility for the children in legal terms. This means that he has a right to have a say about the children’s upbringing and welfare. Your husband is entitled to see the children and it is not really up to you to say how those meetings should be conducted.

By stipulating that he can only see the children while you are present, you are obviously affecting the relationship he can have with the children. If he does not agree with your demand, you cannot force him to comply. If you prevent him from having access to the children at all, he will have to go to court and apply for an order which forces you to give him access. Alternatively, you could go to court and apply for an order that sets conditions on the access your husband has to the children.

To prevent your children meeting your husband’s new partner, you could apply for a Prohibited Steps Order under the Children Act 1989. You would have to convince the court that it is in your children’s best interest not to meet your husband’s new partner because she would have an adverse influence on them. Your question does not mention any specifics in this respect other than your natural unhappiness about the circumstances. Going to court is not a decision to be entered into lightly and will almost certainly add to your children’s distress.

It does seem that your husband is not being very responsible and is rushing things by wanting the children to meet a new partner so soon after the end of your relationship. How does he know that this new relationship will last? Is it fair on the children to introduce a new person into their lives while they are still trying to come to terms with the huge upheaval they have experienced?

Although I am sure that it is hard for you to talk to your husband calmly, perhaps you could encourage him to read some guidance on introducing new partners to children. If you can persuade him that you are only thinking of the children’s best interests – and not stopping them from meeting the new partner out of spite – he might be prepared to listen.

If you cannot reach an agreement with your husband, you will almost certainly have to consult a solicitor to discuss the legal options open to you.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

About 2 years ago myself and my daughters father split up, due to cheating. He is now in a relationship with the girl he cheated on me with and it stung but he’s my daughters dad and if he’s happy, Ella is happy. Then They decided to uproot all they’ve ever known in a seaside town and move down the road from me, specifically a 2 minute drive. I know the girlfriend doesn’t have much experience with children which is fine, but my daughter is coming back from their house with all sorts of new phrases (that a 3 year old should now be repeating) she has asked me to have her lips done like daddy’s girlfriend, (no, not lipgloss, I asked… FILLERS! She is 3! She also requested to wear a bra ‘like ellies’ I grew up riddled with anxiety and low self esteem so I have worked so hard as a single
Young mum to make sure my baby always feels happy beautiful and confident, her saying this broke my heart. The dads girlfriend and her friends are anonymously texting me abuse and the girlfriend herself doesn’t even bother to block her number.. she just sends abuse and then blocks me, whilst my daughter is in her card. It’s been 2 years of complete and utter disrespect from this over grown child woman and I’m stressed as my daughter is in her company every other week.
I need help. I need help deciding what is best for my daughter, and I need to know what the boundaries are on 1-2-1 contact as I don’t want her around my child. Do I have any jurisdiction?

So my ex mental abused me. Went on for 5 years. I had to move 50 miles away. So we have a son he's now 10. Dad has got into another relationship. His partner gets drunk while my son is over their house. The partner of my ex kicked my son out at 2am in the morning along with my ex due to her being drunk. My son has social emotional behaviour disorder. This up set my son. He always tells me dad & her argue 9/10 when he is around. My son refuses to see dad now if he has to be around his dads current girlfriend. Can i stop my son from being around her. But still have contact with his dad. Obviously I've spoken to dad about this. Which causes conflict. And he then stopped child maintenance from 40 pound a week to 7. Aweek. He's self employed so yes he gets away with it. But can i stop via legal aid my son being around his dads girlfriend. Many thanks stressed out mum uk.

My husband was having and affair with a mate of mine, she has done this before to another mate and split there marriage and now is doing the same to me. She used to slag her sort children’s mum of to them, she used to make them think there mum was bad to them, she is know to sleep with different men and women and this is why I never let her be on her own my children at anytime or have them at her house because of the different men she was known to be with.
She has laughed in my face, tried to intimidate one of my sons, she is now putting things on social media before my children were told by there dad he is with her. Her and my husband were all over each other outside my house with my eldest son there and my youngest son watching from his window. They both did not care what this was doing tk my children. I have a five year old daughter who I do not want to be around her, because she is young enough for my husbands girlfriend to mentally control and abuse, to also do what she done with her ex children and get on her head. My husband knows all this about her but now he is sleeping with her he doesn’t seem to care and wants her around them. I’m now under mental health, anxiety and depression and become very ill due to the calls I got from her and messages I had received from her, the being around my property so I can see her, just pure mental torture. My two eldest boys want nothing to do with her because they know what she is like and have seen and heard stuff for them selves and they also don’t want there sister around there dads girlfriend. I’ve now filed for a divorce and this is the only think I have asked for and that is for her to never have contact with my children.
If he has my children around her before we end up in court can I stop visitation untill court?

My sons mother has been in an on-off relationship for some time now. This relationship has resulted in 2 other children.

It has been my suspicion my child has been verbally, mentally and at time physically abused by this man but without Evidence it was my word against theirs. Today these suspicions have been confirmed and I want to do everything in my power to keep this man away from my child.

I need to know exactly what Route to take to make this happen legally and indefinitely, because with my son being abused I feel if I try to handle this myself I will end up in trouble. What do I do know to safeguard my son and stop this man being around him, considering the complication of my sons step-siblings and his right as their farther to be around them.

I want to stress my ex has informed me she has every intention to support me with this, and I feel I need to move fast before he gaslights her into thinking this was all her fault as he has in the past.

Me and my daughters father broke up a month ago, I ended things due to not being happy anymore as he caused me a great amount of stress which may I add, I am currently pregnant with his second child so I didn’t want myself to be going through such toxic stress whilst carrying my baby also I didn’t want my daughter having to be around the arguments. So within the 24 hours of us splitting up he was back with his ex from 4 years ago who he also shares a child with.
His ex who is now his partner is nothing but a compulsive liar, she is toxic, she is an unfit mother as I have seen situations with my own 2 eyes for example when we use to pick his son up his son was basically neglected, his nails were always thick with dirt, he has nits every single time, I’d get rid of them and the following weekend he would have them again (he wasn’t in nursery at this time). His clothes were never clean and she’d turn her phone off when it came to the day of getting him back also on one occasion his bottom was that sore it was bleeding and cut. My ex sat and told me absolutely loads of things about his ex but now that he is back with her he is saying that my daughter will have to be around her also she is saying the same thing. I don’t ever want anyone like that around my children also I don’t want strangers around them either. I will go to the end of the earth for my children. Each and every time I am trying to get somewhere with this and explain to him that she won’t be present in my children’s life he jumps the gun and threatens me. I feel like I am constantly going around in circles. It’s frustrating and draining for me.

My ex of about 4 years has been seeing someone for about 3/4 months. Recently I found out from my 7 year old daughter he was basically living with them and my ex was leaving my daughter alone with him regularly. I raised some concerns with my ex about this as i dont know him or anything about him but she refuses to give me any info other than a first name, no surname or anything else (on his insistence I believe). Is there anything I can do to find out anything about him as she is refusing to tell me anything?

my ex was cheating for a year behind my back and brought home an STD. She even brought our child to the man's house to cheat on me. Social services are involved becauseshe was beating him. This guy is a bad guy from all the stories I've heard, his underaged daughter was also raped while he was downstairs watching football, basically he let a man she met on thd Internet upstairs with her. When she confessed what happened he went berserk and blamed her and refused to let her go to the police. He went to work and she tried to kill herself. Anyway social services were informed but see no reason he can't be around my kid. I've had my solicitor apply for this, fingers crossed.

My ex asked for videochatting with our son. I was like okay and asked if he wants to chat now. We got on videochat and was about to bring our child over when he decided to bring his girlfriend on screen so I hung up because he didn't inform me first that there would be someone else. I felt disrespected. He said i don't need my approval when he is the one asking to speak with our son. I think he should give me a heads up..

This message forwarded to Bella,
I read your comment, never send your little one with the stranger, it is your right to know who is she, and what is she before sending your baby with her. I'm happy for you, keep up the good work, sure you will be a very good and special mother to your baby. Take care of your self and your daughter Bella.
Regards
Khadi

my ex partner of 8 months has a new girlfriend they’ve been together for a year as it was happening behind my back. I’ve safe guarding issues with her being around my child she’s a psychopath and seen and heard a lot of bad things about her. Would I be able to stop her from being around my son on the one day per week my son spends time with his father or do I have no choice?

Been split with my ex-partner for about 3yrs, over the last coming yrs alone she has introduced my children to three different men ,who she thinks is exceptable to stay at the home, two of which in the last month, my concern is that my children are learning that relationships easy come easy go, am I wrong in thinking this, is there anything I should do about it

My situation is different but my ex wife and her partner have had a nightmare with my older child aged 13 a girl not accepting him . Physical fights and tv smashed to the floor by him . It’s now been resolved as she is aware any more trouble as the police have visited 5 times she would be arrested . This has now turned into the model step daughter over night . Is it the police threat or just she has turned a corner ? I think the police threat is more like it .

My husbands ex has told my husband that their son isn't allowed to see me any more after I called her out on a string of neglectful behaviour and said were considering applying for custody if it doesn't improve.

She is a well known alcoholic and drug addict. She's been told that one more drink will kill her. So we were hoping she'd sort herself out. But every time we see his son he's dirty, smelly and this last time he was infested with MONTHS worth of nits. Which he transferred to all of us, including our 4 month old baby! She knew full well he had nits but didn't tell us. She also knew full well that my baby was born with a thick head of hair.

She has been involved with social services for worrying behaviour reported by the school, her own father and countless anonymous reports. So I know if we wanted full custody it wouldn't be a problem. But we don't want to go down that rout unless absolutely necessary.

I wanted to know how visitation rights worked. Obviously she has no right to stop him seeing me as I pose no threat or detrement to him. But wanted to know, if we went through the court, would we have to do it each time we wanted to see him or is it a one time thing? Also, how is it upheld? Can she refuse after a court has made a decision? Its all really messy and I just want to know what our options are. Also, is it expensive?

I split up with my ex before I knew I was pregnant and he had since moved on and got a new partner. I was 26 weeks when I found out I was expecting and he had only been with his partner for a few months. By the time my little one was born they had been together 5 months. My baby was very poorly initially and had to spend time in NICU. All of this was very traumatic and hard to cope with. The same day she was born he wanted his partner whom I had never met to come into the hospital I said no. He kept asking and I kept saying no. I didn't need a stranger in my life at that time. I sent her a message to ask if we could meet once we was home and settled. She was very hostile with me, which obviously was very distressing for me. My little one is now a yr old and we still haven't met the partner. I am not happy for my little one to go off with someone i don't know. I have asked to meet her but she won't meet me but expects to just have my baby. He now wants to take me to mediation because I won't agree to just letting my baby go off with him and his girlfriend. Am I wrong in wanting to meet the partner before my baby is in her care? I feel I am being a responsible parent by wanting to know who is looking after my 1yr old.

Split from ex recently, knew he was getting close to my female friend who is also the mother of my 7 year olds best friend. During my 7 year olds sleep over, he has returned to say that he was in the room next door (his bedroom at dads) while his dad and female friend were in his bed, childs best friend in another room that has been made theirs. Both kids are already suffering, mine already has issues incl emotional dysregulation, i am concerned for him and do not want him sleeping there or having any contact with new girlfriend. i find what they have done selfish to the kids. Am i being unreasonable and do i have a say on access rights if I dont think it is in my childs interest? understand he should see dad

I had an affair for a year then left my husband to be with this man, because it was my fault I left him with the house and my 2 children then 13 and 15 decided to stay with there dad, I see them every day and they stay over 2 nights a week, they didn’t know about me seeing someone else. I have now been with this man for a year and we have been living together for 5 months, my kids still come and stay 2 nights a week but they won’t come down stairs when my partner is home, this is now having an effect on my relationship because he feels like our home isn’t his, he shuts himself away so the kids don’t feel uncomfortable but it’s making him uncomfortable, he’s now saying when the children come to stay he will go stay at his mums, I can’t have that because I feel that would not do are relationship any good. Both my daughter now 16 and my son nearly 15 won’t speak to him, see him, and even like I said before won’t be around him.

Im at my wits end. My husband had an affair which I have known of for almost 6 yrs. From that he has an 8yr old boy who he occasionally sees. We live under the same roof and still try and be the best parents we can to our 11yr old daughter. I have never been interested in what he gets up to in his private life as long as it doesn't encroach on me or my daughter. However recently things have obviously taken a bitter turn between the boys mother and him ( dont know details) but she has bipolar disorder and for whatever reason she has turned her anger on me. I can cope with the comments to me...I just ignore them, but today she sent a card with a very disturbing printed message to my daughter. Fortunately I had a funny feeling and opened it myself. My daughter doesn't know about her son I made that dicision a long time ago when i found out about this women's family. Her and at least her older daughter are or at least have been into drugs. Its just not the kind of family I would let my daughter get mixed up with. The card tells my daughter she has a brother. And that her dad has a girlfriend theres also quite a lot in there thats just not true. Its writen in a very abrasive tone and would have devestated my daughter. To my mind she has absolutely no right to disclose this information to my daughter. How would she feel if I wrote something similar to her boy...telling him how he was conceived after a couple of conversations and a glass or two of wine!! Not that I would dream of that, hes a child who in there right mind would. But where do I stand legally? Please help ...I have a feeling she wont stop.

I've been married 4 years. Weve had our issues which has caused my wife to have trust issues (no infidelity), she has moved back to her hometown as we agreed to find us a place to live while I sort out things here so we can begin a new life etc. Well she has this friend that's obviously gotten in her head about the trust issues because now my wife has decided to end the marriage without even talking to me about it. The 'friend' has no children has never been married and doesn't know the extent of the issues regarding the trust issues she just sees it for face value and has convinced my vulnerable confused stressed out wife it's in her best interests to end the relationship before we've had a chance in the new city we planned on moving to..... Obviously this woman has been around my son and I'm not convinced that she is the type of person I want around my son at all. Her actions have made my wife's attitude towards my relationship with my son become non important so I've now been struggling to get contact with him. Do I have the right to say that I don't want this woman around my son

Me and my ex spilt 3 weeks ago we have 3 children aged 8,5 and 5 months old he had a affair whilst I was heavily pregnant and continued to after i had our baby, after I’ve found out about the affair he’s gone to move in with the other woman, and has mentioned a lot about bringing our children to meet this woman, which in my eyes now is not the right time he’s been having a affair since October but only been living with her for now even 3 weeks is there anything I can do to stop my children meeting her this soon ?

Hello,
Looking for some advice,
Little background- my ex emotionally abused me many years ago, I finally had the courage and strength to leave. Four years we have been split we have a 7 and 5 year old. He got into a new relationship was with her almost three years, however their relationship was very very toxic, they were toxic to each other, violence, verbal abuse, financial abuse, emotional abuse which had a detrimental affect on my children’s emotional and mental well being as you could imagine.
She left him with his child best thing she ever did my children started to become more happy n relaxed n chilled out etc. then he decided to work his way back to me I told him no. I fear he has gone back to her which is fine but I can not have my children around them two ever again.
And advice on this would greatly appreciated.

Today I have been physically attacked by my ex husband girlfriend on picking up my children. She did this in front of my 2 children and there is also video evidence. I would like to know where I stand in preventing her from having any contact with my children as I fear for their safety if she can do that to me in front of them. What would my first steps be etc.

My wife left me in October 2018, I have custody of our children. She has recently started to date someone she says she knows from years ago, I'm not sure if this is the case, and to be honest I'm not really bothered if she is seeing someone. My problem is, she took the kids for the day, and he was at her flat, this was the first time they were meeting him, and while she prepared their tea, she allowed him to take my children to the local park, I am unhappy that she has done this, and was wondering if I have any grounds to not allow them to be solely in his care, I get that if she is with him, they will see him from time to time, but their time with her is supposed to be with her, and not packing them off with a complete stranger, which he is, regardless of whether she has known him a long time or not. Please advise me, thanks.

Hello there, I would love your advice please, I'm engaged to my partner of 7yrs and we have a Son of 3yrs together, I have an older Son of 13yrs from previous relationship, and my fiance has a Son of 12yrs from a previous relationship they were never married! and have been finished for 11yrs, she has never let me meet my partners older son, but now it's causing problems with my 3 year old he's asking questions, they did go to Court about 3yrs ago, but they settled out of court because she brought the child to a child psychologist making him say that he didn't want to meet me, so they agreed that it was up to the child if he wanted to meet me or not, but she will not allow him and he is afraid to go against him mother, he talks to me all the time on video call so I know the poor child has no problem with me, my partner also has guardianship of his son gives €100 a week maintenance and pays for anything extra he is a very good Father and very involved, but it's getting very hard for us now, my partner lives with me in my house for 7yrs, but has to go and stay in his house when he has his older Son and he takes our younger son so they can see each other, they have never been able to go to any of each other's birthdays or Christmas's or any sun holidays together because she won't allow it but says it's the child but we know it's not, please help we don't know what to do at this stage, and we don't want to go back to court as this would not be fair on the child! ??

I split with my ex 3 months ago and I’m worried that she is already talking/seeing someone else! Do I have a right to know who it is for the safety and well-being of my kids, I’d never stop my ex or try to sabotage any relationship she has but I’d like to know who it is to make a judgement call???

So I’m looking for some advice here, I am currently 31 weeks pregnant and my partner left me for his ex partner. I have told him I will never stop him seeing his daughter but I do not want the other woman involved in my daughters life in the slightest. Due to her being a horrible manipulative person. She has got men after men in her own kids life. She isn’t interested in my baby’s dad yet she will use him till she’s had enough. I don’t want a woman coming in and out of my child’s life. Someone had told me that I could get a lawyer to right a letter to him for him to agree to it is this true ?
Kak 25/03/2019 at 8:32 pm
I had to flee from domestic violence. After 15years 3children . 3months after we split he introduced his new partner to my eldest son who's still lives with him . The other two are with me . There are child arrangement going through court also my eldest has a child protection order . The other two don't .
5months later I find out that this new woman has been in contact with my eldest s school.
Should school be speaking with her ? Can I stop this happening as I still do have parental responsibility for my child?
Can I stop them moving in with her?
I dnt know who she is .
This is surely going to effect my son and other children .
What can I do ?

My ex and I split up 2 years ago and have a 3 year old daughter. We remained great friends up until he got a new girlfriend, moved in with her and her child after 1 month and he changed dramatically. Cut down his own hours with his daughter, showed up late, wanted to bring her home early. Very minimum effort.
Hes been with her 4 months and wont stop pestering me to introduce his daughter to his new girlfriend, I have said to wait until 6 months but hes making arrangements that I dont agree to and feel like I'm being backed into a corner. Is there any legal advice I could get? I'm not saying never, just not now.

I've been separated for 3 years now, the ex walked out on me and the kids.they are happy healthy and doing very well at school. I just found out that my ex's partner molested a young girl 12yo to be exact. How do I go about stopping him from being or coming near my kids. I don't have any problems with ex seeing them(I've even paid for her airfares to come see them) but I don't want him anywhere near my kids. I always new he was a creep. Thanks in advance. (no court orders in place yet)

Hi I was wondering where I stand when it comes to my ex husband taking my children to his new partners house. My only issue with this is that I know she has bad mouthed my children and has never had a good word to say about them. I don’t like the idea of them being around her. My children have also said that they have been told they have to change their behaviours when they are there to fit in with her.
Milamber25 04/02/2019 at 11:01 am
I am a father of two under 5s (4 and 2) registered the birth with their mother and have had a shared custodial arrangement for the kids where they live with me three nights and the mother the rest. Although I am usually present at my ex's most days of her custody of them to aid with childcare, bed and overnight. I have started dating again and the mother is being very restrictive on them seeing her despite the fact I have been dating her for several months now and recently booked a night away for Valentine's with her. Admittedly it is a night I would normally have the kids at mine but I have arranged for their Nan to have them overnight and she has the children most Saturdays while I work. My ex is refusing to let them spend the night with the nan, arguing over me staying away the night but refuses to have them herself for the night. Just wondering what my rights are regarding what control she has over what the kids can do while under my care or am I being unreasonable?

I know this may sound strange so let me start by saying my husband and I are completely on our daughter in laws side and want what best for our 6 year old grandson! My son has repeatedly cheated on my daughter in law, most recent he left her & immediately moved in with the other woman, but told her he was living with a male friend. Not knowing that he was living with the other woman 11 days after they split up, he had their child for the weekend visit (no court order), when my grandson came home he told his mother and us that he stayed at his Daddy's girlfriend's house, that he had to sleep with the girlfriends female friend the first night & on the couch the second night, in which he woke up in the middle of the night and couldn't find his Daddy, then found his daddy in a bed with this other woman that was only wearing a tank top and panties! Him and his girlfriend are both abusing alcohol daily & through another mutual party have been using cocaine! Last month my son had a major car wreck and was arrested for DUI, thank the Lord he's still alive! He is 25 his girlfriend is 46! She has a history of Assault/Family & Domestic Violence arrests! My question is can my daughter in law get some legal help to keep the child from being exposed to his Daddy's girlfriend's & to stop visitation until a court order is in effect?

My wife’s brother has two criminal convictions and spent time in prison. He is an aggressive bully and now has threatened me twice. Once by text and most recently a very disgusting tirade of abuse at Boxing Day. I want to stop my wife taking my 3 year old son near this man. My son had to witness the most recent verbal threats and was visibly frightened. Unfortunately my wife has no regard for the impact of this and wants to take him to a family wedding where this man will be present. I am scared he will inimitade my son or try and get at me by hurting my son. This man has physically abused his sister (my wife) and attacked other family members at a previous family event. I have not reported this to the police to avoid unnecessary drama. I am happy to just avoid this unstable individual but my wife will not agree to keeping my son away. What can I do about this ? And if need be I will report this to the police and I will also take necessary legal action in respect of our rather fractured relationship.

My husband of 9 years moved out three months ago as I found him messaging several women. He has since told me he has now started a realonship with another women. I’m not happy about this women’s circumstances. History of using drugs and is in the process of going to court with an abusive ex partner who also takes drugs. He has recently been arrested for storking her. They have two small children together . What I would like to know is where do I stand with my two girls. I really am very concerned about them being involved with this lady. I have said to my husband I would not stop him from seeing them but I do not want them seeing this women. They are both struggling already with their daddy not being at home

I have recently left an abusive relationship after 10 years. My partner was abusive physically, mentally & emotionally; we have three kids together. During the course of our relationship; his ex caused a lot of problems by first restricting access to their son and then returning him, after the birth of our first daughter, with some pretty damaging accusations. This obviously caused more issues and we split 6 weeks ago. I don’t want their child around mine ever for those accusations! My children are very young and I think our bond with each other is the priority, not a dangerous teenager who we hardly know and a woman who sleeps with married men. I have daughters and it’s immoral to be honest. I’d be ashamed if my daughters ever conducted themselves in that manor.

Me and my partner dad to my 12 month old child...have been living apart for a few months now ...because of a fight we had he was having a break down at that time an I was suffering with depression after the baby ..it’s not been a easy relationship because of his ex partner who he as a son with..because I had pressed charges against my baby’s dad when we had the fight out of anger...I tryed dropping them but the court took other...so in the end I didn’t turn up to court on the day ...now me and my partner want to live together and start a new ...but his ex doesn’t want me around their son ..just because she doesn’t like me in the first place...we’ve never got on me and his ex and I only believe this is her reasons Why just out of sheer spite...mine and my partners fight had no affect and nothing to do with her ...so can she legally stop me being around their son ?

If you have good reason to believe your son is at risk, you can apply to the course for a specific issue order...giving details. The courts will decide whether or not to agree.

I split with my wife about 5months ago, she has started seeing someone who has done time for being caught with a large amount of cocaine. It was a long time ago fair enough, but i dont believe someone like that, with a history of cheating and trying it on with attached women as well is a good influence to have around my son. I have asked her not to have him around him but she revises and even takes him to visit his house too. Is there any steps I can take to keep him away from my son?

You can't easily prevent your children from access with a partner of their father unless she is a risk to them. If social services are now assessing her, it should be reasonable to assume that passing the assessment successfully will mean she doesn't present a threat to your children.

I have been in a emotional abusive relationship for 12 years where my 3 children have witnessed there dad been uncontrollably drunk and aggressive. He has been having an affair and is now in a relationship with his new partner. Unfortunately I he got me arrested as we had an altercation and have a pendi g charge for DV. Due to this my children are now with a child protection plan and he has applied to family court CAFCASS for access. My children are not wanting to stay with him overnight because they are scared to leave me cause of his drinking. I have also found out that Social Services are now assessing his new partner as she wants a relationship with my children. This is something I want to stop but have been told I can’t object. Please let me know my rights. As this will cause huge upset for my children.

My daughter's partner left her and their two children nearly two years ago after he had had an affair with a women who had been in a position of trust in the education of their children. He has continued the affair to date.

On a very brief return to "try and patch things up" with my daughter, he told my daughter that his mistress had mental problems.

He has gone back to his mistress and has now started involving her in the children's lives. We are very concerned about the influence this women will have on the children.

Do we have enough grounds to be successful in gaining a "Prohibited step order" to stop her ex allowing their children from associating with this women?

My daughter's dad used to have regular contact with her but since he got into a relationship with his now girlfriend he hasn't made any effort to see her and hasnt seen her for 4 months now ( she is 7 months old). He is now saying he wants her on his own 2 days a week and to meet his girlfriend. I don't want her going to him on her own just yet as she doesn't know him and gets distressed when with strangers. I dont want mg daughter meeting his girlfriend either as they split up and argue pretty much every week.

Hello, I have been in court for 3yrs now with custody battle. Now I am remarried and my ex partner claimed to the court that my wife is mean to her (the mother) and should not be around our children and the court granted her this until we all have a psych evaluation. Although this is an allegation, I have provided the court with 7 violations on the mothers part and they ignored them all except the educational neglect. Now my wife has to leave our house on my weekend with the kids, or I bring them and stay at my parents house. My lawyer has done nothing to argue this. What steps can I take to show this is not mentally safe for my child and their relationship with their stepmother and now unborn sibling.

My daughter has recently had a baby. She and her partner moved back into the family home before the baby was born. Unfortunately her and her partner have been split up for almost 3 months (the baby is now 5 months). My daughter has attempted on several occasions for her ex partner to see the baby, but there is always some excuse. They are both 20.
In the last two weeks they have both started new relationships. His new girlfriend has had some personal issues and involved with a suicide of her partner last year. As a family we know my daughters boyfriend as he is a family friend. He has been wonderful with the baby and made my daughter a very happy person.
My daughter has asked that her ex partner gets to know the baby before introducing him to his new partner. He know believes that we are preventing him seeing the baby. This is not the case as the last time he saw the baby, the baby was very distressed as he did not know his father as he has kept away for 3 months. he doesn't accept the fact that we are trying to ensure the baby doesn't get distressed and he enjoys his time with his father.
The baby spends time with his fathers parents (grandparents) on a weekly basis as we want to ensure the baby grows up with all his family members.
We have thought about self referring to a contact centre for supported contact.
TIA

Hello, a court order was put in place for child arrangements. My son lives with me full time and his dad has visits every other weekend and every Wednesday overnight. He’s started however, leaving our son with his partner, I haven’t met her and she is quite young only 23 I think, is this allowed? It really upsets me to think that he gets so excited to see his dad but is left with his partner, he’s only 2.5 years old and I fear this is confusing for him. Is there anything I can do to make sure his dad actually sees him? I don’t see why he should go away from his home to spend time with his girlfriend!?

Hi, my ex wife is refusing to allow me to collect my 2 year old son tho weekend and bring him to my house saying he's got chicken pox. It's a 2 hour drive but he sleeps most of the way and I said I'll keep him creamed up. We have solicitors letters confirming the 2 weekly access but nothing with regards to if he's ill. I've said show me a doctors note saying he can't travel and I won't collect him but otherwise I'm going to.
Any advice?
Thanks in advance

If you think your children are at risk, you may be able to apply for a specific issue order so that your children can only visit their father when she's not around.

My ex partner had an affair and a baby was the result we tried to work it out but when a DNA confirmed it was his baby we split, to later find out I was expecting we are no longer in a relationship and hes with the woman he had an affair with. Shes been violent toward all her partners , shes sent me threatening messages and reported me to social services , her children are under social services on the at risk register is there any way I can stop her having contact with my children ?
Stevie King 12/06/2018 at 10:34 pm
One of my partners relatives is seriously mentally Ill, sectioned and prone to violent outbursts. In addition, he was seriously disfigured in a suicide attempt.

My husband wants to take our two young children to see the relative, but I think this would traumatise them and have said 'no'. Both out children are autistic and thus are of a delicate composition. Seeing someone they knew who now has a serious disfigurement and who is likely to 'blow their top' will, I think, cause them undue anguish and pain that they needn't suffer.

However, my husband has done things to/with the children in the past when I have said 'no', so I suspect he'll go ahead behind my back anyway.

Is there any legal way I can prevent my children from being taken to see this person without my permission?
LawAndParents Editor 08/06/2018 at 11:14 am
We can't really advise on this. Until it goes to court, you just have to continue and choose what you think will be in the best interests of your child. Him seeing his father and maintaining a bond is important, so you will balance that against the effect of the father's relationship status on your child for the time being.

My husband and I are in the middle of a divorce. He has started dating again, which doesn't bother me, unless it affects our 4 year old son. He is currently on woman number 3, which he met a week ago. She is practically living there already and is around my son constantly when he is at his dad's. She will be moving in offically any day now. I've tried to talk to my husband about this. I expressed that it is too soon to have our son around her that much. What if he gets attached and it doesn't work out? It doesn't help matters that our son still talks about his dad, him, and I being together as a family again. My husband says I should leave him alone and let him live his life like he wants because it will not affect our son. I plan on bringing this all up in court because this definitely will have an affect on our son. Meanwhile, how do I handle this situation? It's hard to deal with but I'm trying. Any suggestions?
LawAndParents Editor 04/06/2018 at 10:19 am
Ask your ex partner if she will attend mediation with you so you can make a formal agreement for child arrangements/contact. If she refuses to attend, or mediation does not provide a satisfactory resolution, you could consider apply for a court order. A court order for child arrangements would mean a judge would decide what contact or residency arrangements should be in place and both parties would have to adhere to it.

My husband and I have been physically separated for a little over a year. He met a woman at work and they began to have an affair so he moved out when he got caught. The woman found out he is married, but continued to see him due to his lies of saying he was divorcing me. At the time we only had a daughter who was in 2nd grade when he moved out. While he has been out of the house we welcomed a son and he promised to come back home and end his affair. That didn't happen and the woman is demanding to be a part of our children's lives. I don't feel that she should be apart of their lives until he divorces me because introducing her to my children could cause some psychological damage & confusion especially if the divorce never happens. This woman has 3 kids of her own. Two are grown and one is in highschool and a juvenile delinquent who attends an alternative school & despises my husband. If her child knew he is married, I'm sure there would be more problems. I'm wanting to file for legal separation, but I fear that my husband will use it as a way to take our kids around his gf and her son. I fear for my children who are 9 and 3 months old because I don't know what she will do out of spite for me and what her son will do out of spite for my husband. Is there anything I can do to make sure my babies are protected?

I want him to see the kids but I don’t want them associated with that family. We’re going to mediation Can I put it in paper ? If he signs them

My partners are moving in together, despite my partner asking to see their children on lots of occasions she has dismissed visitation saying they have plans. His ex has sent him an email with specifics before she allows him to have the childrenin the future.
1. Wants the address
2. List of people who will be in the house(living arrangements) while his children visit. Including my ex’s name as he drops my children off occasionally!
3 she doesn’t want them left alone in a room with my children, strangers (people she doesn’t know clearly) my partner should be present at all times.
4 that she wants to be kept up to date during visitation of their well-being
Allowed to talk to children as and when she wants and likewise they can contact her.
What is your advice?

I split with my kids dad 4 years ago as he was mentally abusing me etc, we don't speak his family pick up and drop off the kids as he has then every 2nd weekend, I have been with my new partner for 1 and a half years, but my current partner is in jail for something he did before we even got together. If you feel your child is at risk when your ex's new partner is around, you could try applying for a specific issue order via the courts. The courts will investigate the level of risk and make an order based on your son's best interests.

My mothers boyfriend Peter recently died. My mother and I lived with him for 5 years but they were not married. after my mother died i continued to live with Peter.

My mum is divorced from my dad, I have a good relationship but I considered Peter to be more of a father to me than my dad ever was.

Peter had no will.  He had no children and had never married.  His parents are dead and he was an only child, it also appears that both of his parents were only children.

His estate is worth roughly £500,000. Am I entitled to anything?! help

You cannot have a say over a new partner. While your child is with the other parent with parental responsibility they can choose what to do while the child is in their care. You can only object if you feel the child is genuinely at risk. As for the child suppotr, if you are not being paid regularly, try contacting CM Options for more advice.

A prohibited steps order can remain in place until a court overturns it.

My husband and I recently split and he was in a new relationship about a month after. He's informed me he's going to introduce our 2 daughters to his girlfriend of 2 weeks. Our children are 1 1/2 yrs and 5. I told him he should really decide against that but he's being extremely selfish. His girlfriend is a drunk and an addict and has lost custody of her own 2 children. I'm worried about what my kids may be forced to witness or be put through with her lengthy record. We have a temp order in place at the moment but what can be done to ensure my children are safe? My children's best interest is my main concern and him thinking adding more confusion into their lives is okay is very upsetting to not just myself but my oldest as well.
LawAndParents Editor 31/01/2018 at 2:35 pm
It's not your ex's decision what you do while your children are in your care and your new partner can't be "made" to communicate with your ex if she doesn't want to. If your ex tries to stop contact, you always have the legal system as a last resort option to fall back on.
Chris 30/01/2018 at 8:48 pm
I divorced years ago and I recently have since remarried to my partner whom I've been with for the past several years. My ex has always found a way to condescend my abilities as a father and is never willing to work with me unless it's to her benefit, and my current partner has grown quite a hatred towards them because of it. My partner doesn't want to have any interaction with my children's mother and now it's at a point where my current partner doesn't want to attend my children's birthday party because she feels forced to be there. I suggested separate parties (because I can't stand my ex either), but as expected, my ex said no. She always complains about how she never sees or talks to my current partner and states that she has a right as their mother to know who's raising them (keeping in mind that they have met in the past a handful of times, but I've tried to mediate the amount of interaction the two have). My question is... Can my ex prevent me from seeing my kids or take away custody if she has no interaction with their stepmother? My current partner cares for them as if they were her own and always has. I personally think that part of my ex's disgruntlement comes from jealousy of my happiness and successful life since we divorced. Obviously I would do anything for my children and their happiness, but I feel it's not beneficial if placing the parents (and step parents) in one setting makes for a miserable atmosphere. I also know that as soon as I tell my ex that my current partner will not be attending, it's going to turn into a huge blow up and I'm concerned if there are any repercussions that could come out of it in regards to the time I see my kids.

I’m currently pregnant and my partner isn’t able to see his current child with his ex. However, I’m unaware of what circumstances happened in order for him to not see his child. As I’m carrying his child I feel like I’m entitled to know what happened incase it can effect my child in anyway. Every time I’ve tried asking him, he changes the story of what happened. He currently has supervised visits with his child (first born) until the end of the court where he’ll see what rights he is entitled to by law. I’ve even tried talking to serveral of his family members and I’ve been told only he and one other member of his family know what really happened which makes me feel uneased with the whole situation. I’ve also tried talking to some of his friends and all have said they don’t know what happened. This is just causing my suspicions to rise and as it’s getting closer to my due date I’m beginning to stress more about it all. Luckily, we aren’t living together, which makes me feel a bit safer as the baby will be living with me. Legally, is there any way I can find out what happened through Caffcass or the courts? Or do I have no rights to know at all? Is there a specific way to go about finding out for the well-being of myself and my unborn child? Also if he does happen to be a potential threat to me or the baby, what can I do to restrict him from seeing us, or most importantly the baby?

Thank you x

I have a question and hope you can help. My ex husbands partner keeps saying that my daughter is either too fat or too thin every time she sees her. Every time she comes home in tears and is now hating going to see them. I want to know can I get a no contact order for her as this is mental abuse on a small child (13). They don't live together as he's not allowed til her youngest goes to uni in 5 yrs time. My daughter is also made to feel like the step daughter to her own father when she's there because of his partner. Hope this makes sense. Many thanks

What reason do you have to want to stop your ex from Introducing his new partner to his/your children?. Has this person done something wrong specifically to the children or (not to be rude) are you just being awkward. From someone going through this who just wants a happy life and Include his children Into this (with my own) it's not easy. Blending a family is a struggle in itself and me for one only want see that everyone is happy and have their needs tended to without steping on a parents toes and this is a hard job which takes time and trust. In my eyes as long as the children are happy and get to have both parents In their lives and them both be on the same page without being at each other's throats is what's in their best interest. My mum stopped me seeing my dad as a child and I now feel a part of me is missing and this was only because he moved on. Show your children that you can get on for their sake and they can love both of you. One day they will make their own choices and you want them to know that they were loved by both parents and any future partners. Until there is a real problem don't cause one as much as it may hurt. They may like and get along with his new partner but they will always be your babies and will in the future respect the fact you never got it the way of their relationship with there father. Love is most important and jealousy and hatred will only eat you up. Move forward and be happy that they have a dad that wants them in his life....many don't get that opportunity the fact he is there for them should be more than enough
LawAndParents Editor 08/12/2017 at 11:19 am
She can try, if she stops him seeing the children, he may have to get a child arrangements order drawn up by a judge. The judge will not see your presence in their father's life as a reason to prevent contact, unless there is a proven risk to the children.
Dsilva 07/12/2017 at 2:44 am
Thank you for your response.

So just to clarify if he wants to remarry she can't use the children i.e. Say that she won't let him see them if he does??

Thanks
LawAndParents Editor 27/11/2017 at 10:39 am
Unfortunately there are many parents who behave in this manner. It might be worth them drawing up a formal agreement for child arrangements - perhaps using a mediation service at first. This can be made legally enforceable by the courts at a later date if necessary. When the children are in their father's care, he is responsible for them and the other parent cannot dictate what they can/can't do (as long as they're safe etc). If an order is in place, it should make it more difficult for the mother to prevent contact or holidays etc.

Hi, I'm hoping I'll get some advice here.

I have been seeing someone for almost two years who is divorced however every time he tries to talk to his ex about moving on with his life she threatens him with her not letting him see the kids or taking them abroad.

I know he has access rights and has them every other weekend. I have told him to speak to his solicitor but have been told he already has and they say there is nothing he can do.

As I am not aware of the law is there anything to stop her? Or am I being played like a mug? Surely an ex cannot influence what you do in your personal life and certainly not use the children in such a disgraceful way?

I really hope you can help me

Regards
silva

I am seeking some advice as my ex husband has gone against a child arrangement order. He has been telling lies about me and to our daughter, she is 4yrs old and he tell her that I am a bad mammy, naughty and the police will take me away. After reporting me to the police on numerous occasions to all of which have been refuted as they are lies. Social services and the school have no issues with nor has cafcass. I was due to have her Monday Tuesday and Wednesday nights but he's not allowed it. I am taking him back to court due to a decline in his health as he has a spinal disease and needs to have 3discs removed from his neck. He has said that if he doesn't have this operation he could be paralysed within 6mths! He is totally obsessed with me and the fact we have broken up. He is dictating when and how I contact her but she's saying she misses me and loves me. He is using my past against me to control me as this is all he can do against me.

You can consider applying for a Prohibited Steps Order as detailed in the above article. Sarah's law allows you to get a background check done which should enable you to make a decision on whether to apply for a PSO. Talk to your ex first, she may be willing to restrict her time with the new partner to those times when her daughter is with you (elsewhere etc)

My ex has a new partner with a long history of domestic violence and disorderly conduct. Is there anyway I can stop my child from being introduced to this man without have to change our custody agreement? I don't want to take any time away from my daughter with my ex. I had been told about this mans history and decided to look him up on public record and the history is true.

My current partner has been separated (not divorced ) from
her husband for about a year and a half.
And have separate homes. I have been friends with her for several years prior and they have 2 kids together.

He has moved on and has a girlfriend who she herself has two children. All of which spend time together with her kids and theirs.

He has recently found out that me and his ex (mother of he children ) are dating, he has banned me from being allowed anywhere near their children or having any contact with them at all, he has been able to give no reason for this other then he just doesn’t want me to, me and the kids get on and never had any issues other then when he has told them they will be in trouble for even being at the same event, park or anything to do with me so they get scared to be around me.

My partner and mother of them has tried to reassure them that they are not together and he has no reason to say what he does , that I am not a threat and they are not doing anything wrong in wanting to play a game or say hello or be at the same place as me.

I have never tried to get in the way of their parenting and have always kept in my place within that.

I hate that the kids are being used against me and that they are the ones getting hurt I’m this, especially when my partner has been ok with him and his new partner and the other kids all spending time together and has no idea who the woman is.

Where does she stand on this, what can be done, I know it’s not fair that he has involved other kids and a new partner and does what he likes but I who have been a friend and known by the kids for a few years and they know I am safe is getting banned and being spoken about so badly that they kids don’t know what to do.

What is right and wrong in this ?

If the children's father does take this to court, the judge will consider all the circumstances and what is best/safe for the children.

LawAndParents Editor 14/11/2017 at 12:25 pm
It might be worth trying mediation - a child can become very mixed up when each parent openly criticises the other and the father needs to realise this. It would not usually be sufficient for a prohibited steps order though.
Shevvy 12/11/2017 at 7:42 pm
Me and my partner broke up due to the fact he was sleeping with my best friend at the time.
Now he continues to bring my daughter round her, who she once knew as her auntie. My daughter often comes home saying they have told her ‘I’m a liar and a bad person’.
I’ve tried talking to him and her about not having her around her but they keep going against my wishes.
What would be the next step?
LawAndParents Editor 08/11/2017 at 11:50 am
There is no law that says a child cannot meet or be in contact with his/her parents' new partner. If it goes to court, the judge will look at all the circumstances and make a decision based on those (with the child's best interests always at the fore).
LawAndParents Editor 07/11/2017 at 9:55 am
If it's affecting the child and your sister adversely, it might be worth considering applying for an injunction. Many solicitors offer a first consultation for free.
DoesntMatter 07/11/2017 at 9:48 am
So does this also work the other way. Can a male stop his partners ‘new male friend’ seeing the kids?

My sister has a 3year old son. Her exes new girlfriend contacts her daily telling my sister to stay away from the father of her child, commenting on her parenting, mentioning that my nephew is "her" (the new girlfriends) child, as well as stalking social media sites and befriending my people to find "dirt" on my sister.

Is there a legal way to keep her from seeing my nephew? My sister has tried everything, but cannot seem to find a legal way to do so.
LawAndParents Editor 25/10/2017 at 3:47 pm
What child arrangements are in place at the moment? Try and discuss it with your ex (your daughter's mother) first. If you cannot resolve it, you might want to consider mediation to draw up an agreement that you daughter stays with your for set period of time, or that you alter the existing arrangements so your daughter spends the majority of her time with you etc. If that fails, you may need to consider a court order.

Hi I’m a Dad of 1 she is 14 now and I have parental responsibility. She isn’t getting on with her stepdad he is speaking to my daughter in an obscene manner and recently told her to get out of her own home.
Now that she has been with me for a few days she says she doesn’t want to go home and I don’t blame her.

Is there anything I can do?
Do I have to send her home or can she stay with me for time being until everyone calms down?

On Saturday approx. 1 hour before my son was collected for his fortnightly overnight visit with his dad I received a message from my ex stating he now has a cat at home and I might like to forewarn our 5 yr old son who is frightened of most animals. He was very upset but was persuaded to go ahead with the visit. Upon his return it transpired the cat belongs to his dad's girlfriend who has also moved in. I now know my son met her once prior to this at the last fortnightly visit. I am obviously very upset that neither myself or child were forewarned of this person moving in. When I asked my ex why he had done this I received a barrage of abuse and was told to get lost but less politely. All i know from my 5 yr old is that she is from his dad's work. I do not know her name or anything about whether this person is safe to be around children. Do I have any rights to disclosure of who this person is?
LawAndParents Editor 04/10/2017 at 11:20 am
Hopefully the above article is self explanatory when you read through. You may have to seek a PSO from the courts. Let us know if we can add anything to the article.
LawAndParents Editor 03/10/2017 at 3:13 pm
You could try applying to the courts for a prohibitive steps order. The courts, will instigate some investigations and make a decision based on the best interests of the children.

My 3 year old hasn't had a relationship with his dad since he was 8 months. I am now going to a contact centre for visits then he will get him out with centre. The problem I'm having is his girlfriend doesn't have access to her children to 2 separate dads, the dads have full custody of the children for reasons unknown to me. I don't want my child around someone who hasn't got access to her own kids.

My ex and I split up about 6 months ago,I have recently found out she has a new boyfriend who has severe mental health issues and has been sectioned before,he has even voluntarily sectioned himself on a few occasions,I have spoken to my ex stating I'm not happy in having him around my 3 children as none of us are aware of what his problems really are,she is stating that she will allow him to be around my children and I'm not happy and concerned about the safety of my children, can I do anything legally to stop this
LawAndParents Editor 20/09/2017 at 2:32 pm
If there are no grounds for PSO the courts will not grant one to your ex.
LawAndParents Editor 14/09/2017 at 2:03 pm
Not easily no. Parental alienation, while it's starting to be recognised by the courts in the UK has no legislation that currently addresses it. If a court feels a child is adversely affected by parental alienation they will take action....going as far as removing the child from both parents and placing a child in care in extreme cases. The first suggestion would be for both parents to attend mediation, to make the other parent aware of the effect on the child etc.
Bingo84 13/09/2017 at 8:25 am
My partner has two kids. It's a complicated situation because the real father has nothing to do with the kids and her ex-husband has taken on the father figure role. He is always talking ill of her in front of the kids. He has alienated her friends and it appears her friend and him talk ill of her in front of the kids too.

Is there anything she can do to stop the kids spending time round former mutual friends when he has them. She is worried they are having a negative impact on the kids. It is apparent in their change in behavior towards her.
Sammy 06/09/2017 at 9:58 am
My husband (seperated) believes that I was seeing my new partner before we separated as has a lot of anger and hatred towards him. He is refusing to let my partner meet our daughter or let us spend time together as a family. Our daughter lives with me and so far I have lived by My husband's rules but I don't feel he should be able to restrict and rule My life because of his anger towards My new partner.
My partner has children of his own and is a loving father, there are no reasons why he should not be around our daughter.
My husband says he will get a prohibited steps order to stop him if needed but I don't see he has any grounds.
LawAndParents Editor 21/08/2017 at 10:18 am
If you feel the children in genuine risk you can apply for a Prohibited Steps Order. Speak to your ex first to see if you can come to some sort of compromise.

My children's mum has recently split with me... and I'm certain she is seeing her ex again... he is controlling and manipulating but she can't see it... he has previously been aggressive and violent towards me when they were in a relationship while I was trying to pick my children up for contact which I was arrested for, for supposedly attacking him (I wouldn't do that because my children are my priority and I just wanted my children to have a nice weekend with their dad)... my ex has also told me that he has smacked his own children and even threatened to smack his own nephew, who was only 18/24 months old at the time...my stepson has also previously said that he hit him.. her ex is also part of the reason why we split due to making threats of taking their daughter off her and making her life a living hell (hence why he is manipulating and controlling).. my ex is also certain it was him that set fire to our old property resulting in her and the children being put in a refuge... he has also manipulated her into making false accusations against me in the past resulting in me being arrested for another crime I didn't commit... my family and her family all know he is no good to be around the children or her.... we just can't seem to manage to get her to see it... he has also manipulated me into thinking she had cheated on me and that my daughter wasn't actually mine... she is and now The more I think about the way he has been the easier it is to see through the front he puts on... he has also got an a problem with alcohol and he has also previously used drugs... is there anything I can do to make sure he isn't anywhere near my children???
LawAndParents Editor 22/05/2017 at 11:55 am
We really can't say what a court would decide in this instance. Generally they look at any risks posed to the children and at what they think will be in the best interests of their children.

My husband has recently left me, despite me being pregnant with our second child, for a woman he was having an affair with.
He admitted to taking our child (between the ages of 2 and 3) with him regularly to this woman's house when he was visiting her to conduct their affair. He has also admitted that this woman uses cocaine recreationally although he doesn't believe this is a problem but I do find it a problem.
I do not want this woman to have further contact with my child or my unborn child once I have delivered later this year. Her cocaine use concerns me greatly and I do not want my child(ren) confused (My husband has said several times he would rather be single than with her or anyone so I don't believe this relationship would last anyway).
Are these reasonable grounds to apply for a prohibited steps order to prevent this woman being around my children? Thank you.
LawAndParents Editor 17/05/2017 at 9:56 am
If you feel uncomfortable about this or feel your child is at risk in any way, you can apply for a Prohibited Steps Order to prevent it.
Hudson 14/05/2017 at 9:26 am
My separated wife leaves our children in charge with her new partner which I don't agree with as I know he has he's own daughter of 17 and has only seen her in a handful of occasions in that time and has not seen her in the last 5 years, if he cannot look after his own daughter I do not feel comfortable one bit having him look after mine in his own
Do I have any legal right to stop this happening?
LawAndParents Editor 03/05/2017 at 12:29 pm
You would have to apply to the courts for an injunction. It would be up to the courts to decide whether this man's presence in your children's lives would put them at risk.

How do I stop wife's partner see my children.
In 2014 my wife embarked on an affair.
Within days she had brought the man in the house. He was very jealous of my kids mum having a relationship with me , they had a very volatile relationship and would split up every couple of weeks.
On one occasion he stalked her to a friends house , and burst into the house to find me .he then followed her home and insisted searching the house where my kids were to look for me, ( my kids weren't home at the time) after searching once, he then tried to kick the door in , and was subsequently charged for criminal damage. Another time he attacked me at the front door of where my kids live and I got arrested for attacking him, 3 months on remand and found not guilty ( I don't have a criminal record).
After the court case he tried to attack me in , whilst in my car with my 7 year old son.this was reported to the police.
Another occasion, he wasn't in a relationship with my kids mum, but one evening I picked my daughter up at one in the morning from a concert and took her home, just after we walked into the house my wine started receiving abuseive and threatening texts, we called the police to report this and they spoke to him in and told him that if he was seen near the house he would be arrested.
10 months later my ex wife had got back with him. Can I stop this man being anywhere near my children
Me 21/04/2017 at 7:56 pm
My son has a daughter with his first partner which he is now not with, he has been to the family courts and is allowed to see her every Sunday and and have her over night for the first Saturday in the month, the problem is sometimes he has to work for 4 hours of her stay so he leaves her with his partner that has 2 beautiful children and is a very good mother. My granddaughter is more than happy to spend time with the two children and thier mother but his ex partner will not let this happen what rights does she have to tell him who he can leave his daughter with while he works.
LawAndParents Editor 16/03/2017 at 2:36 pm
If you think your child is at risk being around her, you may need to consider a prohibited steps order via the courts. Try and resolve this with your ex first. If it's not successful, you might be able to get a free half hour initial consultation with a family law solicitor for advice.

My ex partner met someone new just over a year ago. He introduced her to our daughter very quickly (after I told him to wait), and immediately moved her and her kids into his house. Our daughter stopped getting alone time with her dad, and found it distressing. She then came home talking about whether she could smoke, as one of her kids smoke (my daughter is 4), and other unpleasant things. My ex then comes to pick our daughter up drunk, and tells me that his girlfriend is a bad person, she hates her own kids, and they'd be better off with their dad. I sent him home, and stopped her having contact with my daughter. They've now decided everything's rosie, and want to forget everything thar happened. How do I stop this woman from being around my child?

Hi,
I separated from my partner coming up 4 yrs I have since moved on and my ex partner is making things hard she had always dictated I can only have my son 1 night a week but that took well over a year to get that allowed I have 6 months took a job that I have to work away on a weekly basis I still have my child once a week lately he started wanting to go home to his mam cause he says he misses her...we both agreed when we moved on we wouldn't introduce our child to a new partner untill we had been in a steady relationship for 6 months I have now been dating my partner for over 6 months now she saying he can't meet her or her family because he started wanting to go home to her the nights he was ment to be stopping....tried reasoning with her and after a long back and forth process I get a message that she makesaid all decision in his life I don't get to choose when my new partner meet my son because he lives with her she will tell me when it's can happen....what can I do about this
LawAndParents Editor 16/02/2017 at 10:17 am
If you genuinely fear for your son's safety, it may be worth looking into. The courts may order further investigations or psychological reports etc before making a decision.

My partner and I have recently split up but are still living in the same house. We have a 2 1/2 son. I discovered he has been cheating on me with the woman he was in a relationship with before we got together. They had already separated before I met him. He was with her for a number of years and during that time she used to hit him on quite a regular basis. When speaking to me about it on one occasion he compared himself to a battered housewife who tried to leave a number of times but kept going back to her like she had some sort of hold over him. His mother knew about this and she absolutely hates her for it. Apparently she has never hit anyone else but I've told my ex she will not be allowed anywhere near my son. I can't risk her being violent towards him and I can't be 100% sure my ex would be able to protect him from her when she has previously had such a hold over him. Would I be able to apply for a Prohibited Steps Order to stop her being allowed near my son? I don't have proof that she hit my ex, just what he and his mother have told me, would this be enough?
LawAndParents Editor 09/02/2017 at 10:58 am
Even if you apply for full residency (which you have anyway as the girls don't see their father and the divorce papers details that they live with you) - their father still has parental responsibility and needs to give his consent. If you feel he is being unreasonable, you may have to take it to mediation, failing that a court order (specific issue order).

Hello. My ex husband and I have two children together. we got divorced in 2011. The kids are now 9 and 11 years of age.
We moved from Germany ( after the divorce) to Scotland, with the fathers permission and in the divorce papers it is said that they live with me.
My ex ( because of work) moved to England 4 years ago. For 3 years he hadn't seen his daughters. He now has a new family ( as said on social media it is great to be a first time dad).
21/2 years ago my new partner and me were thinking about for him to adopt the girls. Sadly did we have a few difficulties and now live separated but work hard on our relationship. The kids see him as their daddy and not really want to talk or see their birth father. HE was rather nasty to them also saying he'd rather go on holiday then seeing them.
He also left it to his German sister to tell my oldest daughter ( in front of a shopping centre) that she had a half brother now.
To make a long story short.

I needed to apply for a passport for the girls as theirs were obsolete. My ex is making things as awkward as possible as I need his signature as well on the forms. We only want to visit my and his family ( my daughters grandparents) and to be able to leave the borders we need the passports.

Would it be possible to receive sole custody or something similar which makes it possible for me to make these decisions on my own?

IT is pure spite that he is not granting me this. He enjoys as he says that I still have to ask his permission to go on holiday.

Hi there my new partner and we have been together 7 known each other 11 months I was introduced to her son in July when we decided to get be in a relationship.
We're are both part of a parenting group called sps were other single parents and there children was there and yes I am a single parent to my now 2 yr old son who I won full custody of in July were a section 37 was completed and all went in my favour.
I have a daughter from a previous to my son's mum she is 10 and mother has stopped contact because we can't agree on the amount of time I should spend with her so it's in court but at present I see her every Sunday for 4 hours.

Now my partners ex is saying I am a danger to his children one lives with him who has very complex needs and the other with my partner I have never meet the child with special needs or her ex partner.
The other son was introduced to me through a single parents group we did it this way to make sure our kids get on and with each parents we hit of straight away and the kids did to we did a few more meets before we meet alone together with the kids the bond has grown to were my partners son is saying this is how a family should be.
Now my partner is in court with him saying I am control abusing his son and controlling his ex ? So he is asking for a prohibited steps order to stop me seeing the children Is this possible plus me and my partner and son are moving into mine and we are engaged to be married in 2018 July plus he has reported his concerns to social services in my area and my partners in my partners are they did an assessment over 2 months to where they came back and stated they have closed it with no concerns in my are I received a letter from lado SS stating they are melicous lies and no action to be taking he has had Clair's law done on me and Sarah's law both came back clean I am gd single farther and supported my partner through this she has doctors and councillor letters stating she received mental abuse from him and I have a crime number for harrassement against her ex this about breaking us both up and having control of my partner could someone advise if we should break up for children and should not be together we are so happy and so are the children but this man is putting everyone on edge please please advise

I seperated from my fiancee 4 years ago after being in a relationship with him for 14 years. He cheated on me with numerous girls. We have a 9 year old girl from the relationship. Ever since the break up he has been dating different women. This 2017 he came to collect our daughter for their father/daughter time. When she came home she was very quiet and I could see the sadness in her eyes. I asked her about it and she said nothing is wrong. The next day she was her normal self again. 3 days after he picked her up again for their bonding time. When he brought her back she was all quiet and headed straight for the couch where she fell asleep. I am worried coz I think he most probably introduced her to his latest girlfriend.

Hi
I have been separated from my ex partner for over three years he had an affair with a woman almost twenty years younger with a son a similar age to our son we had together. I am in no way bitter about the affair or our relationship ending.
My concern is purely for the welfare of how my child is being treated when he is at their house, he has come home over the last three years with injuries, the worst being a smashed tooth, a full bruise to the whole of his cheek and side of his face and recently a cut and bruised eye. The injuries are from his dad's partners son hitting him.
My ex sometimes lies or dismisses the injuries as accidents but my gut feeling tells me he is being picked on and his dad and partner call him names when he is there, my son is loving and caring and he is a little withdrawn or angry when he comes home from being at their house. But I do know on the rare occasions he's had any time alone with his Dad or his Dad's mum he comes home happy.
I haven't done anything about it as I know the law is I have no say and my ex can take him where he wants to when my son is in his care but I am so afraid that my son and her son are not being supervised or my son is just being allowed to be hurt.
I don't want to stop my son seeing his Dad but the thought of him getting hurt more seriously and me not having a say or being there to protect him is making me ill.
I have asked my ex to just have Dad and son time together (he only sees him twice a week for a few hours by choice) and keep him away from his partners house and her son, he says I can't stop that and it's none of my business, I am so concerned for my sons safety
Is there any advice you can give me please, my son is just six years old.
Thank you

Hi there me and my partner have split after 20 years together and have 3 children aged 11,15 and 17. I have had to move out of the house as it was solely in her name which I haven't got a problem with my problem is that within a week of moving out she has moved her new boyfriend in who has a history of violence and drug use. He has only been out of prison for 2 months for attacking someone with a baseball bat and nearly killing them. That was the second time in prison and he has also got a long history of drug abuse and from what I have been told by close friends of his he has abused every girl he has been with. I have spoken to my ex and asked her not to let him look after the kids while she is at work or leave him in the house unattended with them which she is refusing and it is causing real friction between me and the kids as she is telling them that I am causing all the problems when all I am doing is looking out for their safety and we'll being I just don't think it's right that someone with his history should be allowed to move in and look after our children when she has only known him for a few weeks and hasn't even been completely honest with her is there any suggestions on what I can do about this.
Thanks

Hi, I am going through divorce and have been separated from my ex wife for nearly a year now. I have three children which I see and pay maintenance for. I have a new partner and we have been together for about 5 months now. I would like my children to meet her, my ex is saying no to this and will not come to any agreement at all, not even a phone call. Has she any rites regarding this situation? Can she tell me who my children can and can't see when I have them?
LawAndParents Editor 22/12/2016 at 11:27 am
We really can't advise on what you can do to make you feel best but try and think of what you son will feel and what will be in his best interests. Would it harm your son to meet her? To receive presents from her?
JD 21/12/2016 at 12:56 am
I have a concern. Should I allow my son to receive any presents (or even met the woman one day) from my x husband gf who aided and abetted the destruction of my family? Honestly I don't want her to even think of my son and even dare to stay close to him. Me and my x are just recently divorce now. He's in the Netherlands while me and my son are back here in the UK. I have moved on now and feel a lot happier with my son, however my 13 yrs of marriage ended up when my x fall on this woman and she become his motives to gave up our marriage, not even given a try for a counselling. The woman knows he's married and that we have an autistic son yet she's happy to motivates him to give up on us. This xmas my son will fly to holland with his granny to see his dad. I don't want to send him over but for the sake of his routine to have the best xmas he can enjoy, swallowing my pride and give my ex a favour but I'm kinda unease or maybe I'm just being paranoid (I hope) that his gf will gave my son some presents.. Do you think I should speak to my x regarding this? I know it's not easy and it might spark into an argument between us since we didn't end amicably. I have move on now and I don't wanna go back to that negativity feeling around me as it drains my energy. ??

Hi

I've been with my partner for nearly two years now and I'm currently expecting a new baby that will be here in April. My partner has two children from his previous relationship and the woman despises me. She has never met me but has made mine and my partners life hell for the past two years with continued lies and horrendous hate campaign. She has never allowed me to meet the children and has ensured that my partner only has his children every other weekend at his mothers house. Things got so bad with her behaviour that he picks the kids up from her mums in south London. He drives from Portsmouth (where we live) to South London to collect them from her mums and then on to Kent to his mums to have them for the weekend. He then drives back from Kent to London and then on to Portsmouth back home on a Sunday. We would love for the kids to spend the weekends with us as an extended family, for them to know my daughter and for them to be involved In the pregenancy and to be a part of their new brother or sisters lives. It's heart breaking because she has told the kids that daddy has chosen me and a new family over being at home with them, when it was actually her that had an affair and made my partner move out. She has also got her mum, who mediates between my partner and herself to say that's it's unrealistic to think that his children will ever be a part of our family or play a role in their siblings lives. The kids are 7 & 11 but as far as I'm aware he is not on the birth certificate as she wanted to claim benefits as a single person when the kids were born to financially benefit herself. I feel like I'm at a complete loss, the kids should be able to enjoy the prospect of a new sibling, not be prevented from spending family time with it when it arrives. As a family we should be able to spend our weekends together without the segregation. I feel like we have seperate lives all because this woman had an irrational hate for me. I do everything thing I can to support my partners relationship with his kids, from arranging trips away for them, driving him to events so he can see them, organising their birthday, Easter, and Christmas gifts, helping him financially with the costs of supporting his children but I'm still shut out, so is my daughter and now so is the baby I'm carrying. My partner is scared to stand up to her because he is petrified she will stop access or use lies and blackmail as a way of preventing contact.?its been going on for so long now I just don't know what to do? Any advice would be greatly recieved, Natalie

I was with my partner for nearly 2 years before our daughter was born, she is now 5 months old. My partner walked out when she was 7 weeks old after I found out he had been cheating on me since I was 6 months pregnant. He rarely sees our daughter even though I push for him to see her. He says he doesn't want me to be there when he has her but I have to be as I am breastfeeding, I have been very amicable even in the circumstances for our daughter. They broke up when I found out but got back together 2 weeks ago, now he is saying he will be taking our daughter to this girl who broke up our family as soon as he can. Is there anything I can do to stop this?

There's not a great deal you can do to prevent the children from meeting your (soon to be ex) wife's partner unless you file for a Prohibitive Steps Order. The courts will only grant one of these if they think your children will be at risk, or adversely affected by it.

My wife has left me for her latest affair (Started after Xmas 2015) and had full intentions of take full custody of other 2 boys (3&7). It all came out when I checked the download folder of the house PC where there was photos, videos and a full instant messaging script spanning back to Feb (02/16 to 08/16). In this they talk of replacing me as the father figure and leaving me with nothing. There was a secret meeting with the 3yrs old and getting he us to the new father figure. Also pictures and videos (in various clothed states) of my children have been sent to the new man also a tormenting video and texts towards him sent to the man, and not to me the father. A plan also became clear that the affair would continue in secret until morally suitable.

There has been a plan to introduce them to the new partner for months and has now staled as and I quote 'Know to much'. I have said no because of the situation and I think it not in a best interests of the children in this horrible affair.

Even though I have told her I don't want them meeting him, she will do it behind my back as she already has.

Is there anything I can do?

I am already filing for adutery.

While working together, a manager and I began seeing each other while he was still married and I was at the end of the separation period for my divorce. Shortly after we began seeing each other, his wife found out she was pregnant so, due to her many health and behavioral issues, he decided he would not move out like he had intended to before we started dating. It had been in the works for approximately 5 months before the pregnancy. After it had been established and considered healthy and viable for full-term, he moved out in December 2015. She began having complications in April a few weeks before his due date, so he returned to her home, to a separate area of the house but in the same home nonetheless, to help out with things while she was on bed-rest. He was let go from his job at the place where he was working and stayed home to care for the baby and her after her C-Section. After she returned to work 12 weeks later, he began looking for employment, but also was the babies sole caregiver daily. She would feed him a couple of times while home (she worked part-time) and rarely would she get up during the night for feedings or fussing claiming she was tired and needed to rest for work. Finally, in August, he permanently moved out and moved in with me and my 3 children. My divorce had since been final for about 9 months. His son is now almost 6 months old and she refuses to allow him visitation because of me, "his tramp b****" and tells him she will never allow me around him and never wants him to have custody as well. He began work about a month ago and has finally been able to afford the lawyer he has found to help out. She filed the divorce papers last week, but there isn't any custody agreement/terms yet. She has let him have the child over a whole weekend a couple weeks back because she had a "date weekend", but has since been dumped by the suitor. Last week, she was staying with her mother and was allowing him to see him for about 30-45 minutes after work before bed time there a couple days. Now she is back to not allowing him to see him at all costs. My boyfriend has an appointment with his lawyer next week, but we are unsure what can be done for him to have immediate visitation with him and not have to be at his parents' home. His father is currently living in a half-way home due to drug addiction and his mother wants to play no part in "getting in the middle". He does not want to be around her or her family, but that was his only options for this entire period. Can she legally keep their son away from him and me at all times just because she wants to? (It is only because she blames me for the break up of her marriage which was already established about 6 months before we met. I am a great mother and care for my children responsibly and have a great friendship with my ex-husband who has vouched for me in that aspect.) Does he have any rights to seeing his son while the divorce proceedings are on-going? Is there anything he can do to p

Hi I was wondering if you could help. My and my x have separated. he had an affair with a girl 12yrs younger than him. He keeps trying to introduce his new gf to our son (2) even though its only been 6 weeks. Our son isn't really aware of what's going on, but doesn't really have much of a bond with his dad as he has always worked away, doesn't ask for him or get excited if he picks him up. My issue is that I have been informed that his gf has a bit of a 'like for alcohol' and regularly drinks during the day, and drink drives. I have never seen this for myself, so have never been able to report it, but I am concerned for my sons safety if my x decides to introduce them without me knowing, or worse let her drive my son, whether he knows she has been drinking or not. Can I stop her having access to my son? I want him to see his dad but worry about him being at risk with the gf, and do not have any evidence to prove her possible alcoholism.

I recently found out that my ex has been cheating on me for 2 for of the 3 years we've been together. He also has brought the female around our daughter who he is now living with. When she was first born, we had an agreement (in case things did not work out) to not bring other people around her until one of us met the other person. Since he has broken our agreement can I legally keep the other girl away from my daughter?
LawAndParents Editor 25/08/2016 at 2:22 pm
There are no laws that specify a time when/if a new partner should be introduced but you can apply for a court order to stop this if you feel the children would be at risk or adversely affected.
LawAndParents Editor 25/08/2016 at 11:22 am
There are no laws about new partners meeting children but if your husband is concerned he can apply for a court order to prevent this until the relationship has been established for longer. It's at the discretion of the court as to whether an order is granted.

I am in a very similar situation, my wife of 15 years and partner of 18 years has had an affair. We separated a month ago, she now wants to introduce her new partner to our 2x children, my son is 5 1/2 and my daughter is almost 3 1/2. She has worked with her new partner for 3 years I think and is adamant she knows him very well etc. He is 48 and she is 35, he's never had children but apparently looks after a step grandson every weekend, I'm not sure of his age. I really don't feel the time is right for them to be introduced, she wants to do it in stages and introduce him as a friend at 1st but then as a partner. We are still living in the family home and sharing child care, with both of us staying at different houses, her his house and me at my sisters about 2/3 times per week. He's in a rental property with a view to them living together in 5 months time. I obviously think this is far too soon. I was just wondering what if any was a suitable timescale prior to the children being used to a gap with regards to me and my wife living apart to a new person moving in with them? I really feel 5 months is way to short.

I believed we were in a very good happy marriage and recently just bought a new house together. She says I just didn't make her happy anymore.

Many thanks, advice is more than welcome.

Me and my husband split and I moved out. I have since been seeing someone and we believe this relationship is serious and have been in it 4/5 months and I think it's time he met the children.

I am sure that my husband will not want this and will try and stop this happenening. I would like to be able to do this with his blessing and hope that he will accept I have a new relationship.

Can my husband stop me from introducing my new partner? Is there any legal stipulations? My new partner is no risk to the children and it would be a gradual introduction. As I am still married I didn't know if it could be stopped?

Me and my husband have been very diplomatic in the split with sharing the children 3/4 days each one a two week rolling basis. The children are happy and understand this.

I am in a similar situation I am close to a girl and want to have a relationship but my son and daughter don't want anything to do with her and my ex has said she will take my kids away if I stay friends or go into a relationship with her. My friend has kids too and I have seen her kids and they want to see mine but my ex she is stopping access for it. I am not going to change my relationship with this girl and am not getting dictated by my ex or kids to who I see in my life she makes me happy and I love her and want to be with her but my kids or ex is not stopping me to be happy what is your advice or to do?

My husband divorced 10 yrs ago has access to his boys every other 2 weeks I have new the children 5 yrs and they have stayed at my house and now I'm married to their dad the ex wife has created many problems because she controlled husband all their life and after divorce continued to using the children as pawns in her game of late she has tried to cause chaos with life here and now not content saying he not allowed to see his children if I'm with him and obviously they won't be able to have weekend stay over cos I live in our house too and she doesn't like the way I spoke to her with regards of me wanting to speak to her over why she was trying to make trouble . She saying she will see him in court and he on low wage so carnt really afford solicitor to help him is there anything he can do about this ? She won't talk to us just won't listen and wants to call the shots of what's going on her way or no way .

If your wife agreed, you could apply for a (binding) residency order for the children quite easily. If she did not give her consent, you'd have to give details about all your circumstances to a judge who would make a decision based on the best interests of the children.

My wife and I have drifted apart to the point where she started (unintentionally) an online relationship with someone 12 years her junior. She is currently torn between trying to fix our relationship or divorcing and trying to start anew with him, and to be honest I've been so distraught over the past few months I'll be happy either way, as long as there's a resolution to this mess. My main concern is that he is a self-confessed alcoholic, manic depressive and has anger management and suicidal episodes as recently as a few weeks ago (which he conveniently used as a bargaining chip/blackmail when she told him she wanted to work things out here). If she does choose to try with him, I'm very reluctant to let my children anywhere near him for those reasons (they're 7 and 5). So far my wife has agreed that this would be the case if we did split, but I'd feel more comfortable with something more formal in place in case things become less amicable between us. Would his issues be sufficient grounds for setting up a formal order from the courts preventing him access to them?

If one of your sons does not want to meet their dad's new partner, you need to discuss this with their father. If they have both managed to be sober for 6 months that is a fantastic achievement. Maybe this new partner is good for him and is what your ex needs to help with his recovery. If meeting her is just for a few hours, will it really hurt? Maybe you can suggest, they meet up but don't go to her house? We can't really give you any advice as we don't really know you, your ex or his new partner. What we can suggest is that you do try and communicate with each other about this and try and work out together what is best for all 3 boys.

I had a strange conversation with my ex. We are still married, but I am not bothered about getting a divorce as things are on good terms and I am not planning on getting remarried. He wants to go ahead with divorce (fine, I told him he has to arrange it and I will sign). However, he is saying that in the event that him and his new girlfriend have a child, if something happens to them, i.e. they are both killed in a car crash, then I would have the right to take the child - this is why he wants to get a divorce so that I cannot do this (or vice versa). I'm just curious as this really doesn't sound right to me and I have no idea where he is getting this information from? Any advice? Can you shed any light??

I have a problem with my ex girlfriend and her partner. We wasn't married but we have a son wich live with them. Im only see him 4 days in the month. From some time she not respondibg for my messages. Every time when Im trying to contact her regarding my son Im getting answer from her new boyfriend. He is so rude to me. Is he have any legal rights to my son if they live together with my ex and my son? Or he don't have any rights?

If he decides to apply for shared residence a court will want to know what the sleeping arrangements are etc - and will make their decision based on the best interests of the children.

If she is refusing mediation, then court is the next step. The courts will look at all the circumstances and should listen to both sides before making decision based on the best interests of the children. Unless the children are at some kind risk from contact while you and your children are there, then it's unlikely that they will agree with the mother.

Hi looking for some advice. Myself and my partner have been living together for 5 months, he has 2 children from a previous relationship. I also have 3 children who live with us. His ex does let him have his children however she is stipulating that he has to stay at his sisters house whenever he has them and is saying that they are to have no contact with me at all. I have met the children on 2 previous occasions, to which his ex was none to pleased about, this is after she said we could do a slow introduction, but then went back on this. Whenever he can't have them on the day/night she requests, due to work, she starts saying that he has abandoned his children for me and mine and he is never seeing them again. She does end up relenting though. The reason she is giving for not allowing them around me is that (stupidly) my partner introduced his children to someone else before we got together and they had an argument in front of the children, and they hadn't been together long, this was unreasonable on my partners side. She is using this to prevent contact with me and the children. We are getting married next year, and neither my partner nor myself want him to continue to have to stay at his sisters, where there isn't enough room, for much longer. She said she is applying for a court order to stop him bringing his children here and seeing me in any capacity, I was wondering what the likely hood of her obtaining that court order? His ex also has MS and apparently has a letter from her nurse saying that if the children to come or stay at our home will make her condition worse. She has also refused to go to mediation, as my partner told her this was going to be the next step.

I was married for 15 years and absolutely no sign of troubles in our happy marriage whatsoever until 1 day out the blue to my absolute shock i discovered that my husband was having an affair with our neighbour/very close friend. This was a family we spent a lot of time and holidays with and kids were very close. Anyway long story short my children never want to see her again and hate her (including me) for what she has done. (Her husband divorced her)Problem is they both think its perfectly acceptable to bribg our kids into there life which i am not allowing due to the fact my girls find it very distressing to see there dad with this woman who caused so much upheaval in there life's. I have met someone who my kids adore and my ex cannot accept this yet hes not being allowed to share our kids with her. He also talks way out of line re money,me etc.should i still stand my ground for my girls sakes. he still has as much access as he wants (only when it suits him) just not with her in tow! .

The courts will consider the family environments of both parents, so may ask questions about this but it's unlikely you'd be expected to appear in court.
LawAndParents Editor 15/12/2015 at 11:12 am
the court is the best place to raise your doubts over this but if you feel the children are at risk in the meantime then ask their father to have the children only when he knows he will be present all the time.

Someone I know has a court order for her two children under the age of five to see there dad every other weekend for two nights. When this order was made the kids father lived with his parents but shortly after moved in with his new girlfriend and he young child. However after a couple of months she has found out the new girlfriend has been admitted previously to a psychiatric ward for mental health issues I.e tried killing her self and had no polar. She asked the kids father for a doctor's note to help ease her mind (as the new girlfriend is left in the care of the children aloneb and he refused after that he started a debate and started being abusive to her on the phone. She then worried that his refusual meant something was not right and decided to keep the kids until she could know. However the father of the kids has said he has requested for court again and uses his court order calls to the kids to point out that the kids will be seeing him soon and disclosing the situation with the kids during these calls as opposed to talking to them about stuff he should be. Does she have any rights over stopping the kids seeing him until she knows the kids are not at risk or in any danger whilest being left in the new girlfriends house and care. (Even though the new girlfriend has a kid she rarely has her child as she spends most time at aunties and grandmothers house so her child is not in her care much so has avoided any social services etc)

hoping for some advice - I had 2 children with my ex , my new girlfriend whom we hope to live life together she is restricting me from seeing my children. it sound unfairly to me because she also had a child with another man but authorised her ex to see her child in the house while I'm restricted to see mine.

should I keep the relationship like this?

My ex wife just broke up with her 8 time felon of a boyfriend(2nd baby daddy) Within a week a friend noticed she was seeing another guy. My 8 yr old daughter only stays with ex on the weekends, but she pointed out that mom had a new "friend" that they had been hanging out with a lot, like every weekend for the last 3 weeks. She also said that they like each other because he calls her babe. I message my ex to let her know I don't think it is appropriate bringing in a new BF to meet our kid yet, she said she understood, and she was trying to take it slow and be safe. A few weeks later, my friend notes a FB status change. She is dating someone, but its a different person then the last guy a few weeks ago, and there are photos of him with my kid already. He also said in the photo, hanging out with my girls. Dude, you just meet my daughter, how are you making a claim for her being your girl already? This is the 3 guy in 3 months... My daughter has called 3 other men dad since I have been back from the Marine Corps (4 years) This poor kids is going to have no concept of what a relationship is supposed to be like...

He can ask the courts for an order to prevent the child having contact with you, but it's likely the courts would only grant this if there was substantial evidence to prove that her safety was being compromised.

I have a question and would like some help. I was living with my partner and her 4 year old daughter.. The father of the child has never liked me and has always seemed to have it in for me. Recently myself and my partner had a huge argument and unfortunately the child witnessed a small amount. The child has told her father and he is saying he will apply for a court order to prevent me from seeing the child as its not safe for me to be around her. I have always treated this child as my own and brought her up alongside my partner to the point she has started calling me daddy. I did everything a father would do to look after her whilst her mother was working. Does the father have any right to prevent my contact with the child even though me and the mother have reconciled although living temporarily apart and the mother is completely in support of me maintaining a relationship with the child and has told the father that a court order is unreasonable. He is adamant that i will never see his daughter again for her safety. I understand he is concerned about his daughter but will not listen to my partner and that fact I have never done a thing to threaten or endanger the child. This feels more like a personal attack on me rather than looking after his child's safety as if he was to end me seeing the child it would bring the end of a relationship that he has never liked and always been against.

Please help me. My partner had a child with an ex girlfriend and she refuses to let him see his daughter. She has moved house and changed her number as she simply doesn't want him in the picture. He pays monthly for his daughter and has only ever seen his daughter when his ex wasn't around and her parents invited him over. Surely my partner had a right to know where his daughter is as he will now never see her?

Thanks.
LawAndParents Editor 06/10/2015 at 10:24 am
The first step is to discuss this with her ex and ask that all contact is held outside of his home or when the girlfriend is not present. If he refuses she may have to take it mediation - if that does not work then she can apply to the court for a Prohibited Steps Order (form C100).

Daughter and boyfriend broke up after 7 years. They have a 3 year old daughter.Dad has moved in with his new girlfriend already and does not contribute in any way to his child's upbringing.Daughter is now primary caregiver. My daughter does not want the baby around the girlfriend in any way as this is very confusing time for a toddler.Does she have any legal recourse for putting her foot down and saying no to any contact with the new girlfriend and/or her family?
LawAndParents Editor 21/09/2015 at 10:02 am
The courts will probably demand that you attend mediation and draw up a legally binding document with details of the contact arrangements. If this fails, then a court order is of course your only option. Note that the mother of the children will probably not get financial assistance with this, so your about the costs may not be valid. Legal aid is generally only available on a means tested basis for cases such as domestic violence and abuse etc.

My partner and I have been together for 3 and a half years. A year after he split from his wife. At the time of separation they were unaware she was pregnant. They also had a 4 year old son. Since we have been together, I have regularly looked after both of the boys during access visits (every other weekend and half of school holidays). This is due to my partner working nights. He spends all day with his sons, I look after them in the evenings and put them to bed. He arrives home around 2 am and is up with them in the morning. The children are happy and settled with us - the youngest not remembering a time I wasn't in his life (he was a few months old when his father and I got together). His ex has all of a sudden decided to stop access as she 'doesn't know me' so doesn't trust me around her children. After 3 years of knowing I look after them! I have grown up children of my own and am more than able. My partner is heartbroken. She refuses mediation and says he keeps changing the pattern of access. This is untrue - we alter it when she requires us to because she is going away, or feeling poorly. Then when we move back to our regular weekends, she claims WE have changed the cycle. It is in our diary from the beginning of each year so we know which family occasions they will be able to attend. Our only option is court - but we struggle financially (he pays above what he needs in maintenance). She doesn't work and will get financial assistance - knowing this will bleed us dry. More importantly, the children adore their Daddy and the 7 year old is extremely sensitive. I'm concerned about the emotional impact this is having on him. His ex has blocked his number and won't take calls, so we don't know what she has told the children. He is still married as divorce is not finalised. What is the best advice you can give please?
LawAndParents Editor 21/08/2015 at 2:44 pm
You could try a mediation service before the court option, if that doesn't create a satisfactory outcome, the courts would be your only option. They will consider all the circumtances and if necessary contact expert witnesses for an opinion on what is in the best interests of the child.

Hi, I'm hoping for some advice. My ex husband and I have an 8 year old son together. I have always been incredibly fair about him seeing our son and even went to great lengths to rearrange my working time and my parents schedules in order to make sure my ex had exactly the times and days that fit in with him. He has now decided to move 50 miles away to live with his new girlfriend and her children. He still wants to have our son overnight on a school night. He proposes to drive from his new home to drop my son in school breakfast club by 7.45am. The journey according to route planner takes 1 hour 5 mins, however the journey is from Leeds to Wigan over the M62 which is notoriously busy in the morning and there are lots of accidents which leaves me concerned that my son will not get into school on time and also he will face a very long journey particularly in winter. My ex refuses to accept that it's not in my sons best interests and when I try and ask for discussions to sort it out he threatens me with court and says I'm making a fuss over nothing and that if he doesn't get his way he will go to the courts to get full custody of my son. Please could you advise who I can contact to discuss this further as I'm very concerned of the effect this will have on my sons schooling and also his health having to get out of bed and leave the house ridiculously early without breakfast. Grateful for any help. Thank you.

My husband doesn't like my sister since her son split on his mother on few occasions (first it happened when he was 3years old, then 4 and 5). Since these incidents happens my husband tries to stop our children (now 5 and 7years old)to contact my sister and her children ( she has two children-now 5 and 8years old) even the second didn't do anything wrong) even talking via Skype. Is he allowed to do it? My opinion is: the children shouldn't be involved in adults disputes. He also tells my children how bad is my nephew and what he done wrong and they shouldn't talk and see them. And he knows how stressful this is for me - he even doesn't allow to mention my nephew's name. All the arguments between me and my husband (since 6years now) are about my sister and her family. It distroying our marriage and family life. My husband can't forgive small boy !!!!! That's really scary. He also threatens me to divorce if I will allow my children to contact my sister, or he will take away children from me. Is this what he does is illegal?what shall I do?

I have 7 children 3 my husband adopted & 4 are his, was with him 14yrs, married 13yrs but still legally married. This is abou 4 youngest who he as rights to see 14yr, 13yr, 9yr & 8yr who as adhd,
My husband was very controlling with me & gradually took over all the money, all the shopping & all the cooking, but would only come home when he felt like it to do dinner then back out again, one thing he would never do, which was my job was the children.
Well he left me end of dec & had got a private rent & moved his young girlfriend & her 18mth child in by jan, feb.
While doing this he saw his children a few sats saying 10 til 2 but making excuses about running late and turning up 11
he then got all furniture for his house but nothing for his children so I said inless he put them first & got beds for them he wasn't having them (social workers that are involved with us because I went on a dating website once (which didn't work out) after he got with his girlfriend, so social workers decided to pay for bunk beds for him , even though he works, has is own taxi business, new drivers, taxis he boasts about but doesn't pay anything financially for his kids.
But I gave it a go & he had the children a few wk ends every other weekend, but he would leave his girlfriend looking after the children, while he went in & out taxiing, on phones, laptop ect, when there he was giving more attention to his girlfriend & her child (not his) more than his own children (they would come back & tell me this & on one occasion as I suffer with depression this did upset me especially as my daughter had took a video which showed my 9 yr old son playing up while his dad was out, the girlfriend ignoring him & my 13yr daughter having to hold him & try her best to control him, the girlfriend saying he could not go there again & my husband when back saying he agreed & calling my son a spag & spastic.
I showed social workers & they said they would sort it, the next time the children went there way of sorting it, knowing full well I try my best to give my children pocket money but cant afford much because of being alone with 7 children, was to let him do a supposedly sticker chart where in 2 days my son that had played up had apparently earnt enough stickers for a £5 note So obviously he was good this weekend but came back saying he needed more pocket money.
I have now stopped contact because I think I have every right & said if my husband as them for a while on his own so they get all the attention with out bribes then that's fine but if not contacts not taking place. Apparently because my husband as said no to this im being selfish with my children because his new girlfriend is family (social workers words)

Just require some advice please. My sister was in a relestionship with her ex and they had a baby. They had been together for about ten years on and off as in that time he had been finishing things with her and he has cheated on her nurmous times. 6 months after giving birth her ex was having a affair and they split but in that time he tries to control and keep going abck and fourth playing both girls off. My sister did say to her ex that she does think its right that there daughter does not see the new girlfriend so soon and if he cannot comply with this request her will not be having there daughter..its his choice. He did go behind her back with this so my sister stopped him from having his daughter on his own. Still he was playing mind games/going between them both. then it all came out and the ex and the new girlfriend called it a day.
Since may 2015 he has another girlfriend, but still texting my sister to which she has ignored. Then my sister has met someone which she sees when she does not have her daughter. One morning it came appparent to the ex that my sister was seeing someone and he grab my sister, head butted her and pushed her into a fence demanding to know what she is up to. I have had word with the ex telling him this is not acceptable and this is his one and only chance to sort him self out also that he needs to leave her only to get on with her own life. He apologised to my sister but still asking if she wants him to cook for her etc (playing minds games). Myself and my family are going away for two weeks and my sister and neice are coming with us. i stated to my sister to ask her ex to see if he wants to see there daughter more before they go away. He has now come back with that he is moving in with the new girlfriend he has been seeing for 3 months and that there daughter will be meeting the new girlfriend. My sister is not doing this out of spite she just thinks that because she knows what her ex is like in and out of reletionships and cheating she does not want her daughter getting to know all these different woman. What would she need to do to put something in place to stop this from happening so soon??? Hope you can help??
LawAndParents Editor 14/07/2015 at 11:57 am
@ptippou. As the parent with residency, you can refuse your consent to these requests. Your refusal in the main is not unreasonable in the view of your daughter's age and her desire not to go etc. Your ex would have to pursue this through the courts if he were really adamant that he wanted this. Best to try and negotiate some kind of alternative arrangements.

Hello. I am in a bit of a conundrum & would really appreciate some advice. I have a 6 year old daughter with my ex partner (non married). My ex is an American citizen currently residing in Germany. My daughter has never lived with him as we have never lived in the same country at one time. He has never been consistent with child support payments since her birth and for the past 4 years has paid the grand total of £15 towards her upkeep. My daughter lives with me and my new partner in the UK and is a UK citizen as I am too. About once a year, my ex comes to stay in our home for a week to spend some time with his daughter. An unusual situation for my current partner and myself but we try and make it as easy as possible to accommodate a relationship between my ex and our daughter. We have always welcomed him and his family into our home for the sake of my child and for them too, and have always been the ones pushing for them to try and actively maintain a constant relationship via Skype at the very least. In addition to not receiving any form of child support from my ex, my daughter never receives any birthday or christmas gifts or cards from him (and I know material things are not important, but it is the very least one can do for the sentiments of a young child) yet we still endeavour to keep their relationship going. I know that my ex loves his daughter but he is certainly not responsible in his actions at the best of times. Recently, my ex has started demanding more visitation rights in the form of either coming to pick our daughter up from England and taking her to stay with him for holidays in Germany. Or, have her fly out alone if there is childcare assistance on the airlines. I am EXTREMELY uncomfortable with this as I feel that she is too young to travel alone for one, and know for a fact that unless I am present she does not wish to go and stay with her father for holiday. In addition to that, my ex lives with a woman who has decided not to even introduce her self to me or allow me to at a very minimal level get to know her. I feel very uncomfortable as what I hope is a responsible parent way of thinking, in having my daughter reside even temporarily with a total stranger. In particular one that has the unrealistic expectation of having me in the shadows of her step-daughter's life. I also feel that for a parent who hasn't contributed towards his child'c upbringing, it is very unfair to make important decisions in her life such as taking her away from her main parent when she breaks off from school. Furthermore, as I have stated my daughter is unhappy to be without me in a foreign country and refuses to go unless I come with her.

Please could you give me some advise on this, and on what rights I and my ex have? I want to do what is best for my child without being unfairly treated and without having my daughter unhappy in the process. Thanks very much

I have a beautiful 6month old by a european who is abusing me on every level. Threats emotionally, mentally, and verbally. Im scared he will take my baby and I will never see her again. Hes on the Birth Cert as he was ok 6months ago! I have her passport - hidden. Is there a way I can get some sort of order without his knowledge so he cant take her? Is there a way I can put an alert on her passport just in case?
Pls help - im so desperate
LawAndParents Editor 01/07/2015 at 11:30 am
@Matt. There are no hard and fast rules over this kind of thing. If your ex wants to impose certain restrictions on your activities, she should apply to the court for a specific issue or prohibitive steps order. The court may request medical information etc.
Matt 28/06/2015 at 9:44 am
What are the laws for divorced parents looking after a child if they have epilepsy?
I have had 2 seizures in 4 years, both times when trying to cut down on medication through doctors advice.
My ex wife wants restraints on how and where I travel with my daughter. Only use buses not trains and not travel to big city.
Is she allowed to do this or am I free to look after my daughter as I wish ?
LawAndParents Editor 15/06/2015 at 12:50 pm
@Gabster. Yes if you are on the birth certificate you have the right to contact. If you need to, a court order will put something formal in place so that if your ex refuses contact, you can take action for breach of court order.
GABSTER 10/06/2015 at 2:36 am

I would really like some advise or comments thank you very much kindly for ready my situation.
LawAndParents Editor 14/05/2015 at 10:22 am
@Ianm. Make sure that the courts are aware of your feelings and those of your son. Hopefully the CAFCASS officer will also involve you and your son in his investigations and you will be able get your point across. The courts usually make the right decisions in these cases but if it doesn't in your view, then you may have to subsequently apply for a Specific Issue Order.

I am in a very funny situation, i have residence of my 9 yr old son as he made allegations to school that my ex partner new partner had hit him on several occasions, after a police and social services investigation he was arrested but no charges brought, my ex took an undertaking that her new partner would not be there when my son is, this has been in place for about a year, now were going back to court for an adjustment in contact (ie she wants more) and she is also requesting the undertaking be lifted, my son is terrified by this man and i cartainly dont want him near my son, cafcass have done a report and have requested a section 7 social service report, whats my best route to ensure this man goes no where near my son ???
LawAndParents Editor 23/04/2015 at 10:46 am
@jj. If you're sure that the father will not harm the children (assume the DV was against you rather than them), then why not let social services know that you've allowed this. Explain that you are not worried about the children coming to any harm but that you do not want contact yourself so have asked a relative to liaise. It sounds like an entirely sensible arrangement.
jj 20/04/2015 at 5:42 pm
Hi I'm all over the place. My ex partner who I had dv with wants to see my 2 daughters. My injunction ran out I'm March but only keeping him away from my house. His sister came and took my daughter to visit him over the weekend she came back happy but now I'm frightened of social workers making me look like iv put them at risk . they haven't had contact with him in two years. What do I do please help.
LawAndParents Editor 04/03/2015 at 10:30 am
@Pippa. If you have suspicions that the girls are being mentally abused. the police will at least investigate and try to establish whether they're safe or not. To get them back may require court action unfortunately. Consult a solicitor for advice in the first instance (the first consulation is often free of charge).

I'm hoping someone can help me I was with my ex for 14 years he cheated on me many times he alway put his retaliation ships before our two girls and me then I stumped up the courage to tell him to leave after he was mentally abusing me for years. We got divorced and he re married within months then couple years later he got divorced again still not having a lot of contact with the girls he gets with the third wife to be she has two boys and my girls went to see them for a weekend and they never returned them and I haven't seen girls since November ive been totally cut off and I'm worried that he's also mentally abusing them and turning them against me my girls are 17 &14 please help what can I do to get contact all messages emails and me trying is being ignored but I don't have much money to go to court
LawAndParents Editor 04/03/2015 at 9:47 am
@Alison Preece. There's nothing in the law that covers this kind of situation. It's really for you to negotiate this with your ex. Find out how much time he's able to be with them at the weekends and maybe offer a weekday night in return for you have them during the day at the weekend. If you really don't want the new partner to spend time with them you could apply for a Specific Issue Order.
Alison Preece 28/02/2015 at 8:38 am
My ex husband left me for another woman he had an affair with. I never stopped him seeing the girls. I never stopped phonecalls and I have allowed them holidays etc over the three years. Recently however, I have found out that on the weekends he has them he is going to work leaving them with her. Last night the girlfriend turned up wihtout my consent to collect them as he was at work. I was at home and I have every weekend off. I refused the permission for her to take them. I was very angry and shouted a lot on the phone to ex. He told them on the phone to leave anyway, so without my permission, while I was upstairs she drove off with my kids. I threatened to ring the police but he said i was shouting so he told them i was being unreasonable. They are 16 and 11. When I'm home and able to have the kids and he is at work is it reasonable or fair in law for her to take them because it seems extremely wrong to me.
LawAndParents Editor 20/02/2015 at 2:48 pm
@Titch. No this sounds like a sensible course of action. You should discuss this with social services or the family courts who will arrange it for you.
Titch 18/02/2015 at 10:54 pm
I have a non molestation order against my ex partner because of dv this is only till July my daughter who is 4 this year keeps asking wheres daddy I tell her asleep at grans house ,because of dv if I was to agree to let her see him in a child contact centre only will social services take the children away from me ?
LawAndParents Editor 20/02/2015 at 2:28 pm
@bangheadbrickwall. This is a common scenario, where one partner allows new partners to be around their children, but refuses to accept that their ex can do the same. There is nothing legally to prevent you form introducing your partner to your children. Your ex would have to get a court order to prevent you doing so. As for the reaction and handling the situation, always stay calm and state your case reasonably. Perhaps other readers will have some good advice for you on this front too?
bangheadbrickwall 18/02/2015 at 9:41 pm
Hello, never really used anything like this before but was wondering if someone on her could give me some advice. Im 26, i was married for 1 year with a five year old daughter. My relationship ended with her having an affair and then bringing that fella into the family home days after i left there are 4 children in total (3 different fathers). She got re married a month after the divorce came through, turns out the new husband was charged with sexual assault and violence to the mother. Since theyve split she brought his friend into the home a week later and claims hes "just a friend" but stays there every night. (sorry for the waffling, trying to give you an idea of the background). Because of the way the relationship ended the social services where involved for the safety of the children and a family care worker was assigned. we have been seperated for 2 years now and in this time i have never introduced my daughter to anyone i have been seeing. I have my daughter every other weekend and a few days in the week for tea/bath etc. I have been seeing someone for about 4/5 months and things are going great and was contimplating introducing my daughter to her. I told my ex i was thinking about this and to say she kicked off was an understatement. I was wanting to know if anyone knew where i stand with the situation. i love my daughter to pieces and obviously would only get her involved with suitable people. I dont have a court order in place for contact. i went as far as mediation which she refused to attend and had no problem with contact so it was droped. Many thanks if someone could give some suitable advice
LawAndParents Editor 11/02/2015 at 10:00 am
@Bazz. This will be difficult to achieve particularly if the father wants to spend time with his daughter. While you understandably feel badly towards your ex, you also need to consider the needs of your daughter (as will the courts if you take it there). It's great that you've sorted out visitation without the need for a court order, keep going with this and see how you feel in several months time. If you really do not want your daughter to come into contact with your ex's partner and your ex will not concur, then the courts are your only recourse. The courts might consider a specific steps order/injunction - but again only if they consider it in best interests of the child.
Bazz 07/02/2015 at 12:24 pm
I had been married for a year when I found out my husband was having an affair, I was 32 weeks pregnant and told to leave my home! I discovered he started the affair only 3 days after I took the pregnancy test. Throughout my pregnancy he ignored me and didn't spend a penny for the baby. My wonderful daughter is now 5months old and we have attended mediation. Visits are being sorted but deep down I want sole custody and for him to be out of our lives. He never wanted this family and walked away before the baby was even born! Are there any grounds for me to seek sole custody? Also to prevent his new girlfriend from seeing my daughter. She's the reason my husband is not raising his daughter, why should I allow her to play happy families with my daughter?
LawAndParents Editor 09/02/2015 at 9:51 am
@Dee. Is there some reason you do not want the children to stay with their dad or is it that you do not want them to meet the new partner? You can use mediation to try and come to an agreement that suits you both rather than preventing the children from seeing their father.
Dee 03/02/2015 at 7:05 pm
My husband ended our 16 year marrage 19 weeks ago soon a after I found out that there was another woman he moved in with her 5 weeks ago, he is now planning on upsizing with the new woman and wants our children 1-4 and 12 years old to go and stay there overnight I think this is ridiculous. I am now being told by my social worker there is nothing at all I can do to stop this as there is no legal aid anymore and I can't afford Solisitors ect
LawAndParents Editor 27/01/2015 at 2:36 pm
@kris Your ex cannot easily do this within the law. DO you have acourt order for shared residency or access? If you find she is stopping you from seeing your daughter then you may have to revisit court to ensure the court order is enforced. If there is no order in place already, perhaps think about applying for one to be sure that you can continue seeing your daughter on a regular basis.
Kris 26/01/2015 at 9:17 am
My ex partner has basically threatened to stop my daughter seeing my fiancée and Her two children if she finds out we have all been together, my ex and my partner have never really seen eye to eye and of late have clashed, but my daughter has created a lovely strong bond with my partner and her two children over the last 12 months. My ex partner is now saying if she finds out that my daughter has been around my fiancée then she will not allow me access to see her again. Help! It's tearing me apart.
LawAndParents Editor 27/01/2015 at 2:00 pm
@Mia. This is something you'll have to handle sensitively. After this length of time it seems a bit unrealistic of your ex (and his ex partner) not to let you meet his children. There's nothing in terms of your rights/legislation that you can use though, so it's going to have to be a case of negotiation on your part. Have you tried writing a letter to your husband's ex explaining that you want to meet the children or do something together? Assuring her that you do not want to become their mother etc? Other than that, you could seek the help of a professional counsellor or mediator for some advice.
Mia 25/01/2015 at 7:28 pm
Please help. I have been with my partner for nearly 6 years and lived together for nearly 3. I have a 7 yr old who lives with us and my ex has three children. Two teenagers and one the same age as my daughter. His ex won't let me meet the children and my partner won't go behind Her back or go to court for not upsetting the teenagers who take their mums side. I can't cope with it anymore and feel he should say enough is enough and just do it but he won't. Any advise pleSe?
LawAndParents Editor 09/12/2014 at 10:09 am
@Tegan. If this is an issue for you then you will have to talk to your ex about this. The alternatives are to use a mediator or take this via the courts (possibly difficult to achieve in time for Christmas anyway). Don't keep the children away from their father because of this though.
Tegan 08/12/2014 at 12:07 pm
Hello,

I would like advise on stopping my children meeting their dads new partner at Christmas.

After a stressful year for the children, I do not agree that the children should be introduced to a new partner at Christmas. Both children are coming to terms with understanding their dads decision and this does not need to confused the children further.

I have no issues with the children meeting his new partner in January or February. Unfortunately he has not mentioned anything about his partner, I cannot look after the childrens safety, which is my priority.

I have tried to discuss this with my ex but he is very unwilling to talk about his new partner and has not even discussed her with the children.
LawAndParents Editor 18/11/2014 at 10:35 am
@belle. How do you know he will only be assessed for this amount? Have the calculations been done? You need to give them any information you have that suggests he can pay more. Other than that, there is no way of preventing this if that's how one party wants it arranged. Note that there is a fee for making the calculation and also if payments are to be collected or enforced by the CMS.
belle 17/11/2014 at 11:56 pm
My ex husband has been paying maintenance for our son at £200 a month for the last two years, he has now decided that he wants to be assessed by the cms to make things official.  A few months back we both signed a family based agreement that said he'd pay £200 a month which is being included in the paper work at court for divorce.  If I go to cms he'll only be assessed to pay £54 a month and I can't afford to lose what he pays. Is there anything I can do?

Thank you.
LawAndParents Editor 14/11/2014 at 2:25 pm
@gem. Your solicitor should be helping you with this. Ask him for the forms to submit a court order for residency or visitation/access rights at the very least. Any assault should be reported directly to the police.

I have been with my partner for 2.5 years - lived with him for 2 of those years. He has two children, 8 and 9 currently and the mother of his children (ex, never married) still prevents me from seeing the children either by visits to our home, trips out etc or holidays. I am a mature, responsible person, have grown up children of my own, hold no convictions whatsoever and simply can't understand this behaviour. My partner seems scared to confront her and does exactly what she says. She tells lies to people around her in the form of accusing my partner of abandoning her and the children, not calling them, not attempting to see them when in fact he does all he can to see them and give them a happy, fun life. She is a very rich lady and this seems to carry weight with her contacts as she tells these untruths. I am so frustrated with the situation, it does cause us arguments and the children are missing out on a normal, wider family and friend upbringing. She has no real friends and the younger of the children only socialises at school, is never in the company of other children of that age outside of school other than at extra curricula activities organised by school.

I just recently found out my husband has a girlfriend, we have a 1yr old daughter together and i am 3 months pregnant by him. He has always thought i was cheating on him, when it was him al along even tho he says its not true, He will dined that he had slept with this girl before him and i ended, but i don't believe it. Now that he is with her he says he is 110% sure this baby im carrying inst his!!! and he now wants to introduce my daughter to this girl he is with now. i don't think its healthy for none of his kids. He has 7 kids one on the way 5 different women. what do i do i feel like i will loose it some time.
Laura Buckley 20/06/2014 at 12:01 am
Me and my ex split up 6 months ago leaving me with a 1 year old and another baby on the way. He left me for another girl and during this time he left her to come back in which she threatened to kill both children. He is now back with her and since that situation she has threatened me several times. I have police reports for these and now I don't want her any where near my kids where do I stand legally from stopping her having access to them as I know she is a danger. She has a background of self harming when she gets angry.

My wife and I are still living in the marital home and in the process of going through divorce. My wife and daughters are not on speaking terms and my wife insists that they cannot come to the marital home to visit me. Am I entitled to see my daughter at home or not?

My ex and I have 50/50 shared residence of our 4 year old son, we seperated in November 2010. He introduced a new girlfriend to our son within six months or so, I can't be exactly sure as he never told me and made our son lie about it until it slipped out.He has still refused to introduce me to this woman who apparently spends every week with them and has a great deal of time and influence on my son. He refuses to even let me see her, won't talk about her or anything else and he actually denied the relationship for months after our son told me about her.Is there anything I can do to make him let me meet and get to know this woman?

Hi My husband left nearly 12 months ago moved abroad apart from 2 short visits 3 phone calls, has never contacted the children provided for them.
He is now planning on coming back to this country as he says he wants to be in his kids lives, he has 2 children from a previous marriage and a 5 & 2 year old with me.
As he has not kept up the relationship with them, i.e not asked them how school has gone and generally kept up with the life, I feel a limited access is necessary! and certainly not one with his partner who knew he had young kids when she went after him as a single person!
She her self has got grown up kids she abandoned her son at the age of 11 and never saw him again for years!

My question is, because of the lifestyle they lived when they were abroad drink drugs late nights am I in my right to allow access to the father but under supervision of another family member!
I have no confident the relationship will last, I have no confidence they can stay drug free and sober in the care of my kids!
So under no circumstances do I want my children who I have raised alone for the last 12 months be in contact with a woman I would not allow into our lives!!

My ex-wife left me nearly two years ago for another man, with whom she'd been having an relationship for now more than three years. Now, she wants my daughter to meet her "friend." My daughter knows that her mum's friend is more than a "friend," mind you. Since July 2011, I have had joint custody of both my kids, but I wonder what kind of message meeting my ex's friend would send to them? My ex is essentially non-communicative with our teenage kids. She calls and interacts with them sparingly, but this latest request seems absolutely bizarre. It's not as though she (the ex) went without a paramour during our divorce, and then started "dating." She's been "dating" her "friend" all along. My gut and my head tell me that her request is all wrong, sends a signal to my kids that it's okay to have an affair, and blurs the lines of what's right and wrong in marriage.

Hi, I walked out on my partner after many unhappy years with her. I'm not blaming her just the fact that I was not in love , we had 2 kids together which I love very much. I found a beautiful girl that I love so much we have been going out now for over a year and we are still madly in love.
My arrangement to see the kids are every weekend at my mothers house during this time my new partner cannot be present . I have spoken to my ex on many occasions to allow my partner to not feel left out when it comes to the kis. We will be moving in together soon and I'd like my ex to give her blessing before I introduce the. My little girl understands what's happening she has meet my partner once before we started dateing. She's a primary school teacher and loves kids ver much. To be apart of my life but not be able to meet my kids hurts , do I continue in hope that 1 day my ex will allow my partner to be part of there life's or let her destroy us , the effect of this is now causing heartache for us all even the kids. What do I do about this anyone plz

Hi there
My partner left his wife over 4an half yrs ago her boyfriend who she is still with moved in with her an the two kids. I met him after this an we have been together ever since, I met the kids an since we moved in together we spend every 2nd weekend together with them, they share parental responsibility! She applied for the divorce which he gladly agreed to! She is now being incredibly difficult about the kids an myself saying I may not b left alone with them for more than 2 hrs I may not text them an when I speak to them on the phone with their dad she tells them to get off the phone. She has expressed to him she wants me to have nothing to do with them, the kids and I get on beautifully, I am 42yrs old not a youngster so I don't understand the problem other than her insecurity about me trying to take her place which I have tried to reassure her many atimes won't happen. She has become very controlling any harrassing with phonecalls an texts even though we have expressed comunication only through emails via her lawyer. She is now saying she is going to stop the divorce as him an I are engaged have been for 3yrs but she doesn't want me to b their step mum! Now threating to take the eldests phone away if I contact her which we bought for communication so we have to go through her to speak to them. The kids are 8yrs and 4yrs. Please help me, I don't know what to do, I don't want to upset the kids by saying I can't see them as we get on so well an they r always telling me they love me an send me texts, how can I not answer for them then to think I don't care. Do I have any rights. Please help I can get legal aid and will whatever I can to all b happy again.
Please help.
Regards Simone

Hi, my ex and I had an arrangement for visitation where he got our son (who is 4) every second weekend. However, every time he came back home he was quiet and withdrawn.
Eventually he said that his dad was telling him to be naughty at home and not to tell me and my new partner (well, we've been together 3 years), and that my new partner didn't love him as much as he did and that he wasn't his real dad and would never love him as much as he did. My son told my mum this a few months ago, but we let it go and kept up the visits until 6 weeks ago when he came home and wouldn't speak to anyone and was very grumpy with his little brother.
Eventually he confided in my new partner that his dad had told him to be naughty again and 'keeps putting bad thoughts in his head that he can't get out' (my sons' exact words).
I stopped the visits after that and told my ex that he can visit at my house but that our son will not be staying at his house again.
He has said that he won't visit at my house and is now telling me that he's got a solicitor and is going to go to court over this.
How will this play out??
Will my son have to stand up in court and be interviewed?

I can't see what he hopes to gain from this as I haven't stopped him from seeing our son, I only want our son to be protected from having his head messed with by my ex.

A year after the very nasty split with my ex, I fell in love with a woman who I want to spend the rest of my life with, My 7 year old daughter knows about her and is always asking questions about her and has expressed an intrest in meeting her. My ex is prooving very awkward about this even though my new relationship has been going strong for nearly a year.
Am I right in asuming that I have every right to introduce my Daughter to my new partner regardless of my Ex's wishes?

My wife has left me for another man who is married with 1 child, he and his wife are seperated. My wife has custody of our 3 children who are, 13,10, and 8. Do I have a legal right to stop my wife's 'new man' from interacting with my children leading up to the divorce and after the divorce, even if they get married?

Hi have a question please.my partner is currently divorcing her husband who has admitted severe alcoholism and mental health problems which have led to abuse.my partner has an interim court order in place which limits access to the hometown only.since her husband has not drunk now for 3 mths,my partner allowed 10 days overnight access with her husband and his partner on the basis that she knew where the children were and could have telephone access.however, when partner tried to call the children, her husbands new partner detailed that she couldnt speak to my partners children, and would not allow my partner know where the children were.bearing in mind my husbands new partner does not have parental responsibility,is she legally entitled to do this?i think its quite a serious offence but my partners solicitor seems a bit weak on this issue.any advice please?thanks
