What are My Rights as a Father?
You have rights as the father of your child if:
- If the child was born on or after December 1st 2003 and you are named on the Birth Certificate as the child’s birth father
- If a Parental Responsibility Agreement is signed
- If the birth certificate for the child held no father’s name but was later renewed to show yours
- If a Magistrate or Justice of the Peace (JP) at the Family Court has granted you parental responsibility or an Order Of Residency

If you want to have a say in your child’s upbringing, then yes, it is a good idea. It is unfortunate that sometimes relations between both parents become so strained that the children will become the unfortunate tools that parents use to hurt each other.
If both parents can enter into such a PR agreement, it should ensure that both parties have a say in how their child are brought up. This does not necessarily cover the day-to-day living arrangements but it certainly includes larger concerns, such as what school their child should go to, the medical treatment they receive, what religion they should be taught, etc.
In some cases, the parents’ split is an amicable one and there will be no need for such an agreement. But often it is a necessity if a relationship has turned sour and neither party can agree without the intervention of the courts.

Financial Responsibilities
You have a financial obligation to help provide for your child’s upkeep. If a relationship breaks down, you have to expect that you will be required by law to pay something towards caring for your child and providing them with what they need.
This can be done by mutual consent between both parents – and if this is agreed upon it is important to have something written down so that all parties know exactly where they stand. If no agreement is made, or if you simply prefer it, Child Maintenance can be handled through the Child Support Agency.
The Child Support Agency requires that you pay 15% of your net income towards your child’s care and this increases to 20% cent for two children, 25% for three children and so on.
Visiting My Child
If you are named on the birth certificate as the father of the child, you have a legal right to see your children. This is sometimes tested to the limit if parents split under less than agreeable circumstances, and it can ultimately mean the involvement of the courts and family services to help mediate towards agreeable visiting rights for the father.
If you are in any of the above situations and feel you need advice, it is wise to contact the Citizens Advice Bureau or your local family services court for more information and support. It should be noted, however, that it is best – where possible – to try to resolve any issues between both parents with resorting to courts and solicitors as this can be as traumatic for the child as it can be for the parents. I am now a Grandad of two with a serious illness who wants to be re-united with his daughter before he dies.
My ex-wife has since 2007 denied me & my sons all contact with Lucy.
There has been no falling out as dad,brothers, sister have not met or been in the same room since 2007.

I separated from my ex when our little one was 7 weeks ago (he decided to end it and kicked us out) he still had FaceTime with her as covid was just kicking off wnd didn’t want to risk anything. When we moved back in with him she was 5months. He was working, always helping his friends out and never bothered with us. I remember asking if he’d spare me and our little one 2 hours a week for me to start running again, he refused saying he’s too busy wnd to get our parents to help out instead. September he felt ill and asked for us to go to my parents house, which he did. He then finished it a week later, ( and went on another dating app) and then didn’t speak or whenever he did it was he’s taking me to court. (I never denied him access I said it needs to be built up as you haven’t been around and our little one doesn’t really know him) he finally agreed to building it up (once in week wnd once on weekend) it didn’t last very long as things would come up, or he’d want me around and to come back earlier to pick up. He’s kept his distance for 10days as he came in contact with someone who tested positive for covid. He asked if we can keep in touch and do FaceTime regularly, I said that’s fine, it’ll be good that our little one still recognises him. He didn’t bother, he didn’t check in on her once. And now he’s messaging me and I feel it’ll go to “I’m taking you to court” as I’ll say time needs to be built up as you haven’t kept in touch. She’s now a one year old and very clingy for me as I’ve been her prime career. Anyone else been in a similar situation?

Maternal grama being an illegal resident was able to adopt my grandchild being mother of who my granddaughter should be protected from. Maternal had a 2 bedroom her husband 2 children and her other daughter along with husband and grandchild reside wth her. I had a townhouse 3 bedroom and was told my house was too small.. why were they In such a rush to put her for adoption if she was with family member? Why wasnt my son given the opportunity to be a father to his child? What can i do now is there anything I can do to have contact with my grandchild.

My issue is, her dad goes away for one week every summer with his friends. He tries to trick me into dropping our son off on the normal days and and doesn’t tell me he’s on holiday, however in the past I have normally found out before the date from other people. He expects that our son should still goes to his house on the normal 3 days in the week to be looked after by his wife. The way I see it, is that it’s an opportunity for us to spend a weekend together - which we rarely have due to the arrangements. I have made it clear that it’s no reflection on her (quite the opposite that I’m thankful of everything she does for our son who is 10) however when he goes on holiday he is my responsibility and I will keep her at home for most of the time with me. I have suggested that he can still go for dinner and maybe stay over one night in the week if that fits with his wife, however it turns in to a battle every year because he wants to control the situation. He says legally she has to go there because that’s our agreement however with all due respect my agreement is with him, not his wife.
Legally am I in the right to stick to my guns here? Am I being unreasonable?

The ex has had nothing to do with my son since 2014 (No maintenance and no visits - his choice) My son has his surname and i would like to change it to mine. Is this possible? If it goes to court, they will say he needs to visit my son. I do not have a problem him visiting my son, if he WANTS to and if he is not going to dip in and out of his life...messing with his emotions. However, i feel that this would not be the case, i feel that it would be false because the courts say he has to. My son goes by a known name. My question is do i just leave things alone and not pursue to change his name (As i know i will need his permission - Right?). She wants to move her child to another school, she is seperated from the father and he is threatening to take her to court if she moves the child to another school, even though it is only round the corner from the current one, as this move is in the best interest of the child and her education as the current one is not helping her progress and its below standards,
he lives in Spain which is over 1000 miles from here and only sees the child a couple weeks a year now.

What should i do?
My exhusband hasn't seen our children in nearly 8 years. He has sent an occasional card with money in for xmas and birthdays. I don't know where he lives as he left the country and we've had no direct contact since. His behaviour was such that if we hadn't split up, the children would have been removed.
Recently I've been ill, and if the worst were to happen, I would want my mum and my partner (6 years plus) to co parent.
He has legal responsibility as his name is on both their birth certificates but I don't believe it would be any good for the children if they were to see him, never mind live with him.
Is there anything I could do to protect them please?
12 months ago he sent me a letter from his solicitor asking for pretty much 50/50 custody my solicitor replied being fair asking to build things up and asking for certain conditions to be met (worries about alcohol his bad parenting and other issues)
He never replied and didn’t make contact for months he saw him once in sept and then not again until after Christmas I suggested he tried to call him each night but this lasted a couple of days he now wants him for a full day and to attend his wedding it’s the first time I’ve said a flat no after discussions with school and social services about a whole issue of things that have occurred since the last contact. I have recently split from my sons dad and we all lived in a house that was solely owned by my ex ( he was very clever not to put me on the deeds) He is now saying that he will either sell it, or will start charging me rent. Its a big house and would cost a fortune for me to run as I don't earn decent wages. I really don't want to move nor does my son. I stopped her from staying with him. She goes for dinner or days out but he knows he is not allowed to drink when she is there. In the last year she has stayed there xmas night and NYE and he drunk behind his daughters back. It has suited me and my daughter that she is only disrupted once a week..when she goes over he doesnt spend quality time with her..she sits in with her Grandma..however he has got married a couple of weeks ago and is on the verge of moving in with his new wife..he advised me today that moving forward he wishes to still have her on a Thursday eve and his wife can drop her to school on the Friday bit Grandma still also wishes to see her and he proposes Grandma picks her up Friday p.m until Saturday!..or he wants her every other weekend!! (Said as a bit of a threat...as he feels that he shd spend more time with her (now that he is settled 10 years later!!!) My daughter broke her heart as she doesn't enjoy going to Grandma's and doesn't want to be away from her home with me anymore than 1 night a week also..but she also doesn't want to offend her dad and Grandma by saying that she doesn't want to go! I also fear the disruption and feel peeved that after 10 years he has the cheek to change the order of things!! Where do I stand? I work a Saturday (1:3) is suggesting grandma has her fri nt until sat 1:3 a good compromise??

I currently have a 4 year old daughter but am separated from her mother but she has now decided she is going to be moving away from where she currently lives to a city 25 miles away, the current arrangement is because i work 5-6 days a week and alternating shifts I have my daughter every weekend but because of this move this will no more than likely change and will result in me seeing my daughter less is there anything I can do where I am to still constantly see my daughter under the current arrangement

Myself and my ex do not speak. Perhaps the odd communication by email or text. He pays his maintenance on a regular basis and sees the children regular. However, he feels I have to pay and provide everything. He is taking the children abroad for a week and expects be to buy and provide all their clothing. He says this is covered by the maintenance he pays me (communication through the eldest) . Child Maintenance service were not prepared to have the chat with me about whether this was covered. However I have just seen that he put a post on facebook early June showing him moving in to his new home. He has now said that he is living with his girlfriend but refuses to give me their address and says he wants the kids round to stay.
Now this girlfriend is the same one that he took out a police warning against for stalking our family home and threatening me and the kids. I even relocated and we sold or family home because of it.
So now he says she has taken him back as neit her want to be alone! But he will not give their adress but he has mine as (so the woman i moved to get away from now has my new address which makes me uneasy).
I don't trust him and for the kids safety feel I need to know an address just in case. He says he has dropped it now-but not theven point. I have asked to meet her and again she refuses and explained why would I let the kids stay in a strangers house and one who threatened us?
Now my husband is saying he wants to see he kids. Of course I want him to just want to have an address especially under the circumstances.
He also gets out of paying me maintenance he says as not giving address and saying working cash in hand and now paying the bills in his new home so can't help me.

she had tried to empty our house, left me with debt and i did not see my daughter until she was nearly 12 months old and this was by court order.
The court order was broken several times by my ex and i had to go back, her solicitor asked for a change of hours agreement and as i could not afford a solicitor i was not aware of this.
The court ruled i should have my daughter for 1 full weekend every 2 weeks, and on Thursday night taking her to school on Friday morning for the other time. half terms to be split, holidays are a week each and summer time is every other week, christmas is shared as is birthdays and fathers day.
my ex remarried (she had been seeing this guy before our divorce and in fact it has come to light that she moved in with him after 2 months of leaving me). my ex has 2 other children with thiis man and then she moved 30 miles away so i am unable to have my daughter on the Thursday and Friday visit, she did agree to friday and Saturday instead. She does not consult me on schools, medical issues religion or any of the other issues that she is suppossed to do.

So I have a child who is four .. and goes to school soon.. I personally have sorted arrangements for school and nursery ever since me and her dad had split... he is meant to have her every weekend currently sat a.m. to sun at 6.
It was recently becoming difficult to deal with as he kept letting me know 4 days prior having her, he couldn’t leaving me to deal with making other arrangements (with silly excuses and sometimes no explianation).
I since spoke to a Solictor and since arranged he was to pick her up from my parents and I picked my child up from his (I used to do all the dropping and picking up). Because it no longer suits them they want to pick her up on a Friday night instead and expect me to be ok with this (when we stopped it before as she got so upset- and with change happening for school soon along with child arrangement changes - when she goes to school obviously I would like to have every other weekend so I have quality time too - they also are unaware of this yet because he also is refusing to sit down with me and discuss things)

I have a 4 year old daughter, who while at nursery has been staying with me 2 nights every week which allows me to take her to nursery. I used to work from home every Monday to look after her and then have the every other weekend arrangement from Friday 7pm until Sunday 5pm. I am divorced from my daughters Mum.
In September my daughter starts school. My ex wife has not allowed me any say on the school, and not even considered options near to where I live and where my daughter has attended nursery for the last 3 years. I live around 10 miles away from my ex wife. The ex wife has picked the school closest to her for convenience which makes it difficult for me to have my daughter overnight and help with school runs. The ex only works part time and has to drive through the Town where I live so really a school near me makes more sense as we can easily share the school runs. The ex is now calling all the shots and gradually phasing me out of my daughters life now she has moved in with her new partner. My daughter is upset and wants to live with me but the ex is not listening.
Please help me, as I want to still have my daughter and cannot go 2 weeks without seeing her. Plus I want to be involved in her school life. Oh.....and because I will have her less the ex naturally wants even more money from me as a result!.

My experience tells me as a Father I have zero rights. I’ve not seen my son for well over a year, always a proud father my crime was that I failed to repair an 18 year relationship and literally had no choice to leave my ex. My son has nothing to do with me or his uncle and aunts and cousins (all my side). The heart break is truly saddening. Everyone misses him, yet the court accepts his wants and wishes (as they should) without consideration of the manipulation and unsubstantiated claims of domestic abuse against me. I have had full legal representation and even when I successfully defended against lies and allegations the court made no order for costs. So no consequence for clearly bad behaviour. I am at the end of the road now... I literally can do no more, I certainly do not need to hear another person telling me “he will come around when he gets older”. Family law is a debacle in supporting devoted dads when faced against a determined and scorned ex partner who is, in plain sigh,t mentally abusing a vulnerable little boy.
If anyone has an avenue to highlight which could be explored maybe there could be half a chance.... one can live in hope.

I have a new boyfriend on the scene were 8 months in, my son and boyfriend can not get along. I’m being forced to choose! My kid comes first of course but I feel he’s playing god. They’ve had their disagreements and arguements and called each other names, my son thinks he can demand my partner to leave the house. His dad is now taking him from me without concent. I was in regular contact with my daughter for 6 months after the split, days out, sleep overs, daughter over for dinner & 1 weeks holiday in August.
In October I received a telephone call from my sister in law, asking me for a short period if time not to see or contact my daughter, as she was struggling and blaming herself for her parents split. I've asked my ex, if I'm such a bad Dad, then why did my daughter stay with me, holiday, days out etc. Why did you allow that to happen. No responce from my ex.
Our daughter apparently has been having nightmares about me. This stems from me using my key and going into our matrimonial home back in August when they were not in.At that time my ex had no issue with me doing this, I had her permission.One in which I did not abuse. House is owned by the 2 of us. Daughters nightmares are because, apparently I broke into our house and went through their stuff.

She has also changed his last name without my knowledge and as far as I’m aware as a patently guardian I should of been involved especially when I only live half a mile away and was contactable.
What can I do to get more access?
He point blank admits that he’s a bad dad and can’t handle the children. I’m at the point now where he’s walked out because he “needs a break” and to be honest, I’m not willing to stand for his attitude or temper any longer. My issue is, I am petrified of leaving the twins on their own with him, without me, espesically since he admits he can’t manage them. He has previously said that if we split he would take them to his mother’s house for her to have them with him, although his immediate family are a tad dysfunctional... they’ve never met the twins, threatened me and bullied me for years (I have proof of this). I just don’t know what to do or where I stand.
He’s also stated that if we split he’d transfer all of his money (we have a joint account and I don’t work - he is the bread winner) into a separate account so that I cannot have access and that he will give me money for the children providing I give him receipts of what I’m spending?

The child was born 13 November 2003 but registered 24 December 2003 with both parents on the birth certificate. Does the Father have any parental rights, and Is the will's guardianship instruction safe?

After all this drama he wants to take her to court. She has promised 3 times to put him on the birth certificate and hasn't. Now she is saying she might move away but its none of his business where she's going.
If he applies through the courts to get on the birth certificate can they also file a junction so she can't leave the country while he's trying to get parental rights?

She refused to put him on the certificate so she could claim benefits as a "single mother" which I was furious about when I found out. I have regular contact with my grandchild however she insists on him taking her to Court, which he can't afford. She always wants to control him even now. My son pays maintenance every week for the child.
I don't know what I can do. It all seems so unnecessary. As my grandchild is now 4 they can speak and apparently Mum calls my son his old dad or his old bad dad which I find really upsetting. I have separated 2 years ago. My son ( my name in birth certificate) stays with my ex ,in house in which we have joint mortgage. I left the home because she brought new partner. Now she broke with new partner and left her job and stop mortgage repayments. House will be repositioned in this month, and she plan to leave the country with my son. She is drinking allot and using drugs, I'm taking my son every weekend and noticed that he is changed (long nails,dirty) and scared. Recently she went out with old friends they told me what she was saying. She left child alone and goes for shopping, talk's with him using swearing words. When her friends told her that he will repeat after her she said lath he dare and I will punch him.

We took the threats to the police and it is harassment. Also On the 25th my wife left our family home taking our 13 year old daughter with her. She has told me that she wants to sell the house. I do not know where my wife and daughter are and have been told by the police not to contact my wife, follow her, or try and trace her whereabouts or I will be charged with harassment. On the 17th of August my beautiful baby girl was born, this was meant to be such a joyous occasion that for me turned into a bit of a farce, and sadly that farce still continues to this day.
After the stressful birth, my girlfriend lost a lot of blood, I had an altercation with one of the staff. I was annoyed that I had been left alone for so long without any updates. I was stressed and anxious and the longer it went on I was concerned as to who would come back; girlfriend and daughter or just daughter or maybe neither of them, I was nervous.
Because of the altercation with the pediatrician I was made a note of and a referral to social services was made. I must note that at no time did I use any foul language nor were any police or hospital security called, nor was I asked to leave the hospital.
The referral stayed on the table but I was not allowed to be left alone with her and if II along with my girlfriend went to the doctors or hospital to check our girl's progress it would flag up.
The pressure got to use both and we argued on the phone and I said some things that hurt her and she confided to the health visitor. Next thing social services are now involved, and my girlfriend is referred to a domestic violence charity.
Social services did there thing and produced their report, they wanted me to have a mental health assessment and see my girl in a contact centre. I wasn't happy with that as it would of meant handing our girl over to a stranger to them bring her to a room to see me. So I declined, they tried to get my girlfriend to take out a non-molestation order but she refused. They then turned on her and weren't very nice. They closed the report and they are no longer involved.
Last time I saw my daughter was when she was 4 months old, she's now a little over one. It hasn't been easy. My girlfriend who wants me to see her is afraid that if she allows me to see her and we carry on together they will become involved again to the point of maybe starting proceedings and taking us to court. It's such a dilemma, neither of us want to go to court, and neither of us want them involved and being true they is no need for any of it.
Maybe I needed to write this just to clear some blocks or maybe I hope someone on here can give there opinion as to what to do for the best.

I went to see my son go into p1 for the first day however my ex arrived and took him straight into reception and refused to let me anywhere near him. I have PR and the school tried to convince her to let me see him go into p1 like other parents are as it is my right but she still refused. She stayed the whole time refusing to go away as if the school decided to let me see my son and wish him well in p1 she was going to drag him out of class. I ended up not being able to see my son even though the teachers were saying it was my right.
I asked the head teacher afterwards if i could maybe come in a day next week during a break or lunch to speak with my son and wish him well in school tell him to have fun etc. Just like a normal father should be able to do. After seeking info from a council lawyer of some sort she was advised that they need to only looking at the child's best interest and if hes affected. And it doesn't have to be directly. Even like if they let me then he went home and says to her 'oh i seen daddy today' then she might react and this would affect him then. So basically said she will speak to my ex and try to convince her to let me do that at some point. Said we will keep trying with her
My question is, aren't the school obliged to let me see my son if i want to see him. I have PR, have been involved in his life all his life, past 3 years fought in court to keep gettin contact orders where he stayed with me most weekends.
Am I entitled to go to the school and just demand i want to speak to my son and tell them they cant refuse this? Cos im his dad so why should they say no?
Surely I have a legal right to access automatically and I feel victimised by not being able to enforce this.
I am now facing a very lengthy and expensive process to regain the rights I should be entitled to with immediate effect. Surely by refusing access with no legal reason I should be able to simply arrive with police in tow and demand my rights as a father, if these were then denied my ex should be held accountable by law and arrested for her actions ???...why is this not the case ?, the law has and always will victimise the father and prove to be very detrimental to my daughters well being and the relationship/bond we have as father and daughter , I think it's absolutely rediculous that this is still the case !!!!

My son's ex partner has stopped us seeing my granddaughter, she says my son goes out most wkends when we have her. (Son lives with me) and said he'll take drugs.
Yes my son does go out and could go out less, but he still spends time with her.
My granddaughter is 3 soon, and we have had her every wkend plus more since birth, and loves it here.
The biggest problem is the mother is not the best of mothers.
For the first yr of my granddaughters life , she was in our care more, as she was out partying drugs n having lots of men.
Social services were aware of all this.
Eventually she started making an effort, and my granddaughter went back home, we still had her 3/5 days a wk, and still did until last wkend, because my son went out. He did, but my granddaughter stayed an extra 2 days with him.
Where also worried about my granddaughter, as mother is still not the best, she's had another baby, social services are safeguarding them both, domestics i think, no one will say.
Where out of our minds, what is the best way to go about this,
Yes my son does go out, my granddaughter is well looked after, and never will come to any harm.

Separated from childrens farther i have eldest girl with suspected asd/adhd and a boy diagnosed autistic and baby jake nuro typical all fantastic.

My son is 5 in Oct and only seen his father a handful of times for a few hrs. The last time his father saw him was at his birthday party last year which I invited him to. Before that he left a 2 yr gap.
He lied throughout my pregnancy with my son where he went with other women. Lied about his address, I have never been. He also lied about how old he was.
He did not turn up to register my son and therefore is not on the birth certificate. He denied my child was his for the first few years until I went through the CSA and got a DNA test . He has been ordered to pay a monthly amount towards care.
He doesn't phone my son or send any cards for birthdays and Christmas he's missed. I have also never met or heard from any of his family so I believe he has kept us a secret. I don't even know their names as He's lied about it.
I also found out through VS A that he also has 2 other children he is paying for that he has never mentioned and I one wasn't aware of.
He has contacted me saying he wants my son to stay at his house every weekend. This is the first time I've heard from him in a month.
I have no idea where he lives, who he lives with, who he is associated with and have always offered for him to our son at my house .
This really concerns me if he decides to act on it.

I have decided that I shall fight this in court and have emailed my Solicitor to request a PSO to prevent her taking them abroad or even moving home without telling me, she moved her elder daughter from Turkey to the UK to prevent her father having access.
She has lied to try to get a Non-Molestation Order and used text messages to achieve the same, but she has failed because there is no pattern of abuse or anything, that is not my way. I have been reading the legislation and found that I basically have no rights over my children other to pay for their upkeep..so to speak..The law needs to be changed.
In this vein I have signed up to do an Open University Law Degree and intend to specialise in Family Law so that I can fight to get the law changed to be more equal.
I will fight my ex for access to my children, not matter what it takes, I will not have her alienate me from them, and shame on the law for not recognising that some woman act in selfish and cruel ways when it comes to child access.

On one occasion when an argument broke out in the car, with my son in the back, the boyfriend ended up pulling up the handbreak of the car while travelling and they skidded.
He comes home with dirty clothes, school shoes are never cleaned and until he started cutter his own nails, they were always long. I have never ever denied him access and I fact often had to chase him to see his kids or pick them up.
At first our arrangement was him 3 days and me 4. There was numerous problems with this where the children were late for school/nursery wernt dressed smartly or bathed properly and I was paying 100% of the childcare fees even on the days he had them as we both work.

My partner is scared he wont see his kids because I am pregnant. He thinks that once his ex finds out he is having a baby with me she will stop him from seeing his two kids. She is being horrible at the moment by letting him see the kids only once a week for a maximum of two hours which we believe is not enough.
I have assured him that there are things we can do and the best option is to go through the court as she will not agree to any arrangements he tries to make with her. she blocks him on her phone and unblocks him only when she has something to say.

There are 365 days in a year, 190 of which are spent at school.
365-190=175.
175-80=95.
In total Jacks mother has 95 days a year social time that is 15 more than myself.
Jack is at school until 3pm, and although I am not aware of his sleeping times I imagine an average bed time would be 7pm.
This leaves 4 hours per school day Jack spends with his mother.Deducting time to eat dinner and prepare for bed I predict an hour.
This leaves 3 hours leisure time.
3x190=570 hours a year.
This works out to be around 57 days when you calculate it as 10 hours a day which is the average anybody would have in a day for leisure activities.
So in total Jack is with his mother 152 days where they can take part in leisure activities.
I on the other hand have Jack a total of 80 days,
152-80= 72 days.
Jack’s mother has jack 72 days more than myself, this is not putting into consideration the demand of a 4-4:30pm drop off every Sunday which limits my options of what to do with Jack every Sunday.
Jacks mum is now demanding a change in visitation commencing from the beginning of July.
These changes will deny me one of my three weekends so I only see Jack on the first and third weekend of every month.
This means Jack will only see me a total of 52 days a year in comparison to her 195 days.
Jack’s mother relocated Jack to Knaphill from Kingston-Upon-Thames without discussing or informing me. Before she relocated I was able to see Jack after school as I finish at 5pm. But now I wouldn’t be able to reach Knaphill until 6pm earliest, by which that time he would be preparing himself for bed. This makes it impossible for me to ever see Jack during the week.

I didn't believe her at first as I was thinking she only needs a visa to come to EU. And at the same time my mom and my sister were there in Africa and they had arranged to meet with her so that my family could confirm that she actually had given birth to a child. The written report would have disclosed any contact order or residence orders in place that relate to the child. Children under a Special Guardianship Order can remain in touch with their birth family. As a parent you can apply to the court to discharge the Order. The Court must decide such matters taking into account the best interests of the child.
I met my ex late 2015 and I got pregnant. I moved me and my two children 150 miles to be with him and have our baby. He became really awful - abusive mentally to me and to my children but he cleverly left no 'marks' I stayed in the area for no longer than 6 weeks before fleeing back home to a domestic abuse refuge with my two children (who aren't his) we have had little contact he doesn't know where I am or what my number is. The address I am at is a 'hidden address' being a refuge. I never reported the abuse to the police as its my word against his and I just want to focus on finding us a home before the baby arrives.
I am now 5 months pregnant via my best mate he gave me 15 mins to call him
If I 'ever want to hear from him again.' I didn't call. 1. He told me to call him in 15mins at 5.30. I was feeding my children and preparing for bed and wasn't about to let them see thier mum distressed and 2. I refuse to give into demands. I tried to contact him over the course of a few days. I left him a message saying that until the baby is here I didn't have to speak to him. He then said he would be getting a 3rd party involved and would no longer be having contact with me (I am gathering he means a solicitor)
So I am in a safe house with an unmarked address. However I am due to move out in 19 days to temporary accommodation.
So once baby is here what will happen? I don't plan on putting him on the birth certificate but I'm guessing he will have a tracer put on me and find me pretty sharpish so once he has my address (as I'm guessing there is no way that I can stop the tracer) then what's the process and time frames he will have to go through to see the baby? (I obviously don't want him in our lives) will it be a DNA, the a parental order, then contact order?
Can I request supervised access or stop him taking baby 150 miles away to his house and parents and new girlfriend when I haven't ever met them and I'll be breast feeding and then working full time?

It's just not fair on the kids being in the car for over 9 hours in total. I wouldn't be able to take them out anywhere for the day on Saturday to enjoy themselves for the day (or Sunday) and it basically means my precious time with them is taken up completely with driving from one club to the next.
I'm asking that they dont do there clubs alternate weekends, so that I can have them home at 8pm Friday night and return them Sunday afternoon spending a quality couple of days doing activities with them and having fun.
2 questions. Am I being selfish here? and what are my legal rights to being able to do what I want with them over the weekends I have them ? Am I legally responsible to maintain their current exact routine's despite the 9 hours of driving over 3 days and the lack of any time together outside their club activities?

He and his girlfreind split up and 2 weeks later she anounced that the was pregnant, he has told her that he is over the moon and wants as much contact as he can with the baby and that he will support financialy, she on the other hand is being obstructive and will not speak to him, if this continues and when my grandchild is born how much access can he have rightfully, as in shared access ??

12 months ago he got himself on a 6wk daily course 40hrs a week miles away each day having to use the mobility car. He said he'd still take the children to school and pick them up. I later found out my eldest daughter was taking my youngest to breakfast clubs before school and picking her up later in the after school clubs due to him not finishing his course til after 6 (I found out after I received my half of the school club bill) I was stuck during the day each day for help shopping getting out getting anywhere. became so stressed due to him leaving me without any help or care coping with my 5 year old (at this point) that I ended up ringing scope crying, who immediately got in contact with social services calling it neglect. Social services kicked into action with help from carers/agencies etc. Unknown to me he was still claiming carers allowance but was using the mobility car for the girls. Week by week after he'd got a placement at a gym after qualifying from the course. he'd drop taking my youngest to school picking her up even changing weekly days seeing her. Everything had to run around his self employed schedule. He has family which he'd cut off over 15 years ago for being violent & interfering in our marriage. (later finding out his sisters had fixed him up with their friends who he'd had affairs with, I guess he didn't want me finding out and take the risk of them telling me.)
He was still using the mobility car daily for his work had my bank card etc house key & came and went from the home when he wished. Slowly bit by bit with help from my soc
I have no restrictions against me.
He's been to family court & had a contact order to see her....is paying CSA...but the mother is refusing to let him see his daughter.
What's the way forward?
But I don't feel comfortable him having our son alone for the day or even overnight!! What do I do . I don't want to stop him as it would be unfair but he has had 1 year and half to learn . But he just didn't want to learn it .
My partner has a 7 year old daughter who he has not seen since she was three months old. Not through his fault. Up until his little girl was one he was driving down to try and see her but the mother would just shut the door in his face, so he gave up in a sense, he still pays child support every week (not through courts) and sends card with gift wouchers in at birthday and Christmas. He used to live in Cambridge with her but his parents moved back up north and it was after then that she told him she was pregnant so he was already moved. He already has two more children up here. I hav a child myself who'd dad chose not to be in our child's life. My boyfriend is a fantastic step dad and I cannot understand why a mother cannot appreciate how lucky she is to have such an amazing dad for their daughter and deny her access to him and all because she wants more money than what he already gives. And if i am honest i know that if he had extra money i kniw that he would give it her to just to hav a few extra moments his daughter, but she doesn't realise that he has bills to pay and needs to eat aswell, and needs to be able to afford to provide for her when he does have his daughter for the 2 nights he gets currently.
I am looking to see if anyone can maybe give me any details of finding a resolution to stop the threats of him having access for extra money until he can afford to get a court order to set in stone his equal access.
He has never brought the children anything, he believes my daughter should provide for them and not him, as he needs his money for weed. He has them for what was suppose to be 3 days, but ended up 24 hours, because he ran out of a pack of 30 nappies and 1 tin of babies milk. So spent £10 on a taxi to return the children to my daughter as she should provide and not him. The 3 year old comes home with a foul mouth and temper to match, he smashes things slams doors.
I don't want that man near my grandchildren, but my daughter will not listen, she believes that all fathers should see their kids. Which I agree if the father is loving caring and supports his children. This man does the opposite. He recently attacked someone with a baseball bat for looking at him. Which would explain why my grandson throws things at us and hits us.
Can she stop that man from seeing the kids? His name is not on their birth certificates.

I split with my ex nearly 3 years ago. We have a 4 year old boy. I am in the armed forces and try my hardest to see him. I can see him when it suits her but I am never allowed to have my child stay the night. I always need to take him home. Is my ex allowed to demand this or do I have a right that he can stay the night with me?

I moved with my girls 136 miles away to be near my family as I was moved away from them by my husband and the isolation caused be to become depresseddepressed and too isolated. Since then I have been left traveling to and from my husbands house every 2 weeks to make sure he sees them. I am trying to pay this fuel out of my income support and I. Struggling to put food into the table for my girls! I have to the food bank and they have helped but I still can't afford to do this. My ex husband pays the basic maintenance for the 2 girls but I can't make ends meet with my petrol. I feel as I am unable to work he should travel to see the children.. He works full time on a very good wage!

As part of a separation agreement I 'legally have to visit my dad every school holidays'
He works i the army and usually thinks he 'rules my life' sometimes if I say I don't want to visit him for the holidays he would threaten me by saying that if I don't visit him he might take myself, my brother (12) and my mum to court and try to take custody. Just the thought of having to live with my dad usually scares me so I usually just suck it up and visit him. When we are there we hardly do anything and it is always boring, He always buys stuff that he doesn't need such as spa's and big fancy speakers wasting all of his money on buy stupid stuff when he really should be chipping in on school fees and my braces (my mum was going to buy them for me but can't afford it) One time I he asked me If I wanted to go on a holiday to Japan with him and my brother. I was furious that he as soon as he gets money he decides to go on a holiday when at I can't get my braces because of money and he just frustrates me soo much.
Recently I have been starting to stand up to him saying, I don't want to go more and more often but I keep getting the same reply.

Our children are 8 & 9 he will not put proper visits in place it's as and when it suits him he says he's not a baby sitter.
He says I'm unreasonable all I want is routine in our children's lives if I ask either of our parents to babysit I'm accused of dumping the children. Their is no courts involved and a dad pays csa towards his child and has done since the day he left the family home. The child lives with the mother.
If the mother goes on holiday and hasn't informed the dad and leaves the child in the UK with an adult, and finds this all out on Facebook.
The dad is worried,if he can find out where his child is does he have a right to go collect that child and take her home with him.
Once again nothing gone to court yet or anything, so no court orders or anything place yet .

As he is still having contact can he force her to sleep over if she no longer wants to?
The main reasons is as she is becoming a teen she has lost interest in sitting in a bar or eating chippy.
If my children go for tea and are still having contact with him should they be forced to sleep over? I understand encouraging especially the youngest to sleep over but i dont want to force my children to sleep over. Some advice would be great as their father as threatened to take this further.
I have two boys aged 3 and 4. I have taken the boys tonight at my mothers but have concerns of the state of mind and also alcohol aspect from my ex. She sent me and kids away with no clothes in a taxi tonight so she could meet someone and drink.
I do not want my kids around someone I believe has drink problem and who sends their kids away in a taxi with only the clothes on their back.
Can I keep my boys as I am their best chance of stability I believe, and keep her away from them until I believe she is gonna be ok for them.
I must add she has full benefits regarding keeping them fed clothed etc although I'm more than happy to take this over myself. They do stay with her, well up until now.

My ex girlfriend is 5 months pregnant. Before I knew she was pregnant we had split then a week later she told me she was. I was delighted and we decided to give it a go unfortunately after 4 months of constant arguing and shouting I decided that we didn't really love each other I called time par say.
I didn't want to raise my child in a house with two parents that hated each our and were constantly fighting it's not right for the child. I have bought most of of the baby equipment already and have been given a crib pushchair and car seat by my sister. But my ex is not happy and demanding money from me so she can buy these things. I have also offered her £50 a week direct debit when the baby is born but she wants more money £70 I have used the calculator from the csa it says I should pay £31 a week but I'll keep with the £50. Because she is polish and her family are there I have a gut feeling she will run off back there and I don't know what to do she also says that I can not take my child on a weekend only for the day but I want to be there for him I want to be a father.

I have recently started seeing someone. My ex does not know about this yet but she does seem to suspect it as she has asked me on a number of occasions. I have denied it as I know that if she finds out I am seeing someone else that she will know that our marriage is well and truly over and she will start to be difficult with regards my visitation.
She has mentioned to me how she hates living in England and wants to move back to Scotland so I am worried that she may do that just to make things more difficult for me.
Our daughter is profoundly deaf and goes to a local deaf school. She is having behavioral issues and I am concerned that being suddenly moved out of the school will only add to the issues.
I want to protect my right to see my daughter and to have a say in where she lives, goes to school etc.
Should I look to obtain a PSO or PR in this situation? And what is the process involved?
Is there anything I can do, I am also on the baby's birth certificate and yet she still says she doesn't want me to see him. All because we split up and I wanted to go to mediation.

I have a daughter we live away from her father as we seperated two years ago.
He pays regular maintenance and is not wanting to have her with him overnight.
We live two hours away from him I as a parent am not happy with my daughter staying overnight with him. He only has a one bed flat and I do not want my daughter spending this time without me.
Her dad I feel us irresponsible and let's get down often.

My partner has now started a new job where there will be shift work, thus meaning that he will be working some, if not all weekends, so we asked the mother if we could change the days we have him to two weekdays, or whenever my partner has his two days off work a week (still only to have his son once a fortnight for two nights, so no increase in time we have him)
she has flatly refused to even enter into talks about this, as she says if we can't get him to nursery on those days we can't have him! I am just wondering what the thoughts are on dads that work weekends, how do they get to see their children if the mum refuses? and what is the point of giving my partner an ultimatum on when he does see his son, he has to leave him at nursery and effectively not actually see him? (he only attends the Free Grant sessions that is 3 hours per day) my partner has PR for his child as he is on the BC and the child is 3 years old. the mother has also said that my partner has threatened to abduct the child, which he has said no such thing! all he said was that he would like to pick him up from nursery on the odd day when he finishes his shift in time, this would be infrequent and only with the mother's consent!
Please advise on whether we have a case of merely changing the days my partner sees his child due to shift work, surely this is a reasonable request?

I split with my ex 3yrs ago moving from England to the Isle of Man. I lived with my sister and family for 2 yrs until i could afford my own place .I was left with a debt of £6000 plus monthly interest of £ 100+. I am now financially stable and living in a flat.

He was in a long term relationship with former partner (mother to his son) and having been through a miscarriage, they decided to try again, through out the pregnancy, my son was finding himself frequently being asked to leave his partners home, which my son put down to hormones and got his own place, but they still had a full relationship. His partner was told 3 weeks before her due date, that they could induce her due to her depression. She went into hospital and my son stayed by her side for 3 days till their baby was born. When they took my grandson home to her house, my son stayed with her at her home, to support her with the baby and her 3 other children from past relationships. He cared for her children and his own son whilst she was recovering from the birth. After 4 days of staying there she asked him to leave, which he did and returned to his abode. My son text and phoned her to ask when he could see his son, she totally ignored him for 6 days. My son finally went to her home to sought out with her amicably when he could to get see his son....... To which she agreed arrangements for my sons access to see him.
Towards the end of the pregnancy, my sons partner had agreed that the baby would be given my sons surname this was her decision alone and was not coerced in any way by my son or ourselves to making this decision. As their relationship had broken down at this point, but my son was still allowed to have his son on a Sunday for 6 hours. When it came down to registering the baby, she assured my son, she was still putting baby in my sons name, up until 15 minutes from meeting at the register office, she text my son and stated that she had been down to the register office, the week before and registered the baby in her name, and we think she has, put down on the birth certificate, that father was unknown. To this day my son still has his son on a Sunday for 6 hours. But I would like to know, does my son have any rights as the father of the baby, and to having his name put on birth certificate. Even though their relationship has broken down, my son would never abandon his son, and would want to provide for his up bringing financially and as a parenting his sons care.

This year her parents paid for a post graduate degree in law for her and she started work in a restaurant. Things got worse then, she started keeping late nights, very late nights and one day didn't even come home until the next day. I checked her facebook and saw she was messaging some guy she met in ton and and even inviting him for parties with her work mates and even to her job. I asked her and she said it was all innocent. late nights continue and had to watch my son until she returns or pay for a nanny. I started a new job in nov.
this xmas she claims that she needed to study so my son will have to go and stay her mum for 4 weeks. I said no that he should be back after the xmas for new year. after lots of emails and text. I got an email saying she was basically not coming back to live with me, my son is with her mother and she doesn't want contact with me directly. I was stunned two days later she showed up with the police and a man to pack the rest of her bags. I got a text thereafter that she says she had to bring the police and her cousin cause I would kick off if not.
its been a week now I have not heard from my son, I don't know where she is she has moved out and I cannot contact her. I am so confused what to do now. I am not from UK which makes it more complicated for me

His ex uses his daughter as weapon all the time and we are at our last tether now what is there that we can actually do now as this is going on to long.
Today things have deteriorated and she is now denying him any access and saying that any contact needs to be through the courts, my partner can not rally afford this, but he fears for his daughters safety as the living environment is poor. He is contemplating going for full custody of his daughter and I support him fully in this, as I too feel there are safeguarding issues that need to be investigated.
Any advice would be much appreciated on how best to move forward as my partner loves his daughter an been told he can not see her has broken his heart.

i married in 2002 - had a baby 2005
by sept 2006 we split due to him being abusive violently and emotionally - my divorce states unreasonable behaviour. anyway we didnt talk for 2 years. then i recd a solicitors letter stating he has the right to see his 2 yr old and i should arrange visits. so i did he was to come every sat twice a month from 10 - 5pm this lasted a few weeks then he did nt come again for a few months. and then just came once a month on a sat. then didnt bother again for weeks. then i said stop you not doing this and asked him to leave us alone. he not paying and not paid maintenance. He then worked cash in hand so that i couldnt claim csa. and as i understand he has remarried with 1 child and still cash in hand. he called me in dec to say he has a new child and wants his son to meet the baby for an hour and thats him done he will leave us alone. i asked him what - you just want your son for an hour and you will go away - he replied yes - he has no thought for his son and to use him just to say oh by the way we got another child now bye - is not fair. he has sent me (his solicitor) 2 letters stating he wants to see his son. I have ignored the letters, anyway now june i have recd a letter saying he has applied to the court and awaiting a date. I have contacted csa to ask if he has ever paid anything as i ve not had anyting and explained that im possibly going to court and want all my info to hand to throw at him. my argument is in 6 years he's done nothing never paid anyting well in total if im honest he's paid 425.00 in 6 years. and now wants 50 /. 50 im scared that he's going to get it. any advise or anything from anyone that has been in the same situation would be great - many thanks
I'm just after a little bit of advice really. My partner has two children with his ex wife. The money he pays her for them per month is set by the CSA guidelines, however they don't go through the CSA. This is fine, he wants to pay for his children, however the problem he is having is that she only let's him have them once a week, as if he had them over night twice per week her payments would go down.
He wants to see his children more, but is being stopped by her as she doesn't want to get less money. Can she do this? What are his rights where seeing his children are concerned?

I'm currently waiting to go for surgery on my spine and I'm considering moving from Scotland back to England where all my family are as I feel, as does my son that due to the remote setting we live in we will struggle during my recovery.
I want to leave with him and his mum on good terms, feeling he has an open door however would it be illegal to leave without some kind of consent?

Before I was seeing them pretty much everyday in London were we both live.
My son sees his biological farther a few hours every Saturday and hates going. He pays £10-20 maintanence a week, and his name is not on the birth certificate. The thing is, does my ex need to know if seek guardianship for my present partner and son?
Do I have to have his biologicals farthers consent if I persued the order?
He would contest it out of spite. I know for a fact that if anything happened to me my son would cringe at the thought of living with his real dad. Please could you help me I'd be very greatful.
I went to court and he was declared her father under section 27 of the child support act 10 years ago yet him and his present wife say I haven't proved she's his. He's always refused DNA tests which I am more than happy to do. I need advice as to what my daughters rights are to be recognised as his daughter.
